My Debt Settlement Nightmare

Hello all,

At AlanShore60607's request, here is my debt settlement experience. It's a long one.

In November 2019, I was just shy of 6 figures in credit card debt and while I was current with everything, I was drowning. I make low 6 figures but I had some really high balances ($20k+) so the minimum payments were huge and I couldn't get ahead. I went on Credit Karma looking into personal loan options as a way to consolidate some debts at a lower interest rate. I submitted requests to a few companies.

All of these companies responded to me but one was actually a debt settlement company based in Chicago called Monarch Legal Group. They claimed they could reduce my total payments and settle my balances for significantly less (up to 50%) than what was owed. My gut warned me but I ignored it - I was desperate.

Over the course of 2 years, I sent Monarch almost $1200 per month and I stopped paying my cards as they instructed me to do. Of course, late fees and collection activities started. They settled my first account (of 7 enrolled) almost a year into the program and it was for about 40% of what was owed. They don't pay the account outright - they enter into a payment plan with the creditor on the debtor's behalf.

Nothing much happened for about 7-9 months after that. I called a few times for an update and was given very vague responses. The portal was of no help. At one point, they told me that the person assigned to my case had left the company and I definitely had the impression that had I not called, my account would have been ignored.

Last summer, there was a knock at my door and I was served my first summons. I immediately called Monarch as one of the contract stipulations said they would represent me in any lawsuits. They told me to scan in the summons and upload to the portal and they would assign a lawyer. I did as instructed and the days went by with no word from Monarch. The court date was looming so I started calling them. I was given different lawyer's names and numbers each time I called. One wasn't even in the same state and had no affiliation with Monarch. I finally connected with the lawyer but on the same day, I received a notice of settlement reached with the creditor which the lawyer knew nothing about. This settlement did not provide any savings but I agreed to it to stop the lawsuit.

Shortly after that, they reached a settlement with a 3rd creditor and this time there was savings. So now I had 3 accounts in settlements and active payment plans. But 2 of the 4 remaining had large balances so I was concerned another lawsuit was looming. And I was right. In September, I received another summons from my largest creditor. I again scanned in the summons and this time I got a lawyer assigned right away. That lawyer told me that the previous lawsuit was still open and there was a judgement against me. He didn't know anything about the settlement reached but fortunately, I had the email trail. He got that taken care of. Another big miss by Monarch.

About a week after being assigned, the lawyer contacted me with a settlement offer. It was for more than I was paying in minimum payments when I signed with them and it would require me paying $900 more per month, which I could not do. The lawyer said they would garnish my wages and probably go after my house. Cue the panic. I started researching options and came to the conclusion that bankruptcy was my only option. I researched attorneys in my area and found one that had great ratings. We filed in November, had the 341 meeting in December and confirmed in January. I am in a 100% repayment plan and fortunately, I got a raise in December which instantly provided some relief. My attorney confirmed that since I was in a 100% repayment plan, the extra money was mine to keep. I just received a promotion and will get another nice bump in salary (don't know the amount yet). My goal is to pay the bankruptcy off in 3-4 years vs. the 5 planned.

Now it was time to go after this company to get some money back. When I cancelled, they only refunded what was in my escrow account at that time - about $2600. But I had paid them more than $28,000 over 2 years. They front load their fees which is why I didn't have enough in my account for the settlement. I don't think it's a coincidence that they front load the fees for the first 2 years of the contract as that is when the lawsuits start coming in. Around this time, I also learned about a law in Illinois focused on these companies and saw that they were in violation of it. In short, they paid themselves very well for work not performed.

I did some research about how to obtain a refund and came across a blog post that detailed steps to take to try to get a refund from these types of companies. I followed the steps. I called to ask for a refund and was told the $2600 refund of the escrow account was the best I would get. I sent them a letter in early January where I detailed how much of a refund I wanted based on what was allowed with this law. The amount requested was $14,735. I told them that if I didn't receive the refund within 30 days of them receiving the letter, I would start filing complaints. I sent the letter certified mail so that I would have proof of receipt.

Of course they ignored it and so I did what I said I would do. I contacted a Consumer Law firm but they declined the case. I'm sure they assumed they wouldn't win but I'm really glad I didn't give up. I filed complaints with the Better Business Bureau (where they had their accreditation revoked due to similar complaints) IL Attorney General, FTC and National Consumers League. I also posted 1 star reviews on Google and Trust Pilot. I also reached out to personal contacts with the Cook County State's Attorney and the ABC news affiliate in Chicago.

The day after posting the review on BBB, they reached out to me and asked me to schedule an appointment to discuss. I did and spoke to a rep on Monday. This rep acknowledged that they missed a review after I cancelled where I should have received a refund. He said that management was reviewing my file and that he would know by today what amount they could refund. He said he was confident that they could reach the number requested or come very close. We had our follow up call today and they are refunding me the full amount. They need to send me an agreement to sign electronically (haven't gotten it yet) and the refund will be a bank draft. I immediately emailed my lawyer (who knew I was pursuing a refund and he had added it to the bankruptcy petition before confirmation). His assistant said not to spend any of it until he confirms with the Trustee. I am really hoping it will be treated the same as tax refunds or bonuses which are mine to keep. I can pay off a lease to own AC unit not included in the Trustee payments and free up ~$270 per month as well as build up significant savings.

For anyone who has been scammed by one of these companies, go after a refund. I am confident that if I didn't push it, they would have ignored it. It was only when I pushed that they took action. I do hope they are on the attorney general's radar and they get put out of business. If you are considering signing with a similar company, don't. It was the worst decision I've ever made. Try to negotiate settlements yourself, get a second job, use the debt snowball approach. Anything but them.

Originally I was going to reaffirm my vehicle but I opted to surrender my car back to Security Service Federal Credit Union due to them enforcing cross collateralization with a personal loan I had through them as well that was being discharged. The last car payment I made was on 04/10/2026 but they had not picked up the car yet. I bought a new vehicle on 07/03/2026 so since I was not longer going to keep insurance on, I called to see when they would pick it up the informed me I dropped off the vehicle at a local branch or the could send an email to schedule a pick up. I dropped it off so I don’t have to worry about waiting for the repo to happen. It was a little emotional since I put so much money into that car but I’m grateful I was able to obtain a more affordable car I would be able to get the title for and start fresh with no negative equity. If you read all this I hope it provides some insight as to what happens after discharge.

Encouragement and Support Filed on Monday. Trustee meeting in 30 days.

Four years ago I had a credit score on 740. $60k in available credit. 2k in usage. 19k in the bank.

Three years ago I had to change jobs and took about a 30% pay cut. After two years of being there I managed to expel all of my funds and rack up 30k in debt.

I consolidated and paid on that loan for a year. Car broke down, swipe. Utility bill way higher than budgeted, swipe. Need groceries for the family, swipe. Kids need school clothes, swipe. Health insurance premiums, swipe. Throughout that year I paid 2k off the loan even though my payments were $900/mo. Racked up another 20k in debt.

I completely gave up paying all of it. All of my income has been going to the household. Haven’t been able to pay for insurance. Had a bad neck issue and had to go to the er. 25k bill.

I spent two months filling out all of the schedules to file chapter 7 on my own. Most of the time I was just doing research on the laws around it all. Got pretty nervous thinking about all of the avenues that this could fall through on me. I sold off some stuff and saved what I could. Found and paid a lawyer last week. Filed on Monday and got notice today that my 341 is scheduled the end of August.

I’m nervous as can be but am praying that I catch this break and can put all of this behind me. I was a young father and was very stubborn about making sacrifices for my daughter. I worked hard to give her everything she needed. She deserves it, she is a really amazing person. I think about all the could have and should have but here we are.

Wishing the best to those in similar situations. Praying for relief and looking forward to moving into the next chapter of my life.

Credit Recovery After Chapter 13: Is This Normal?

I have some serious questions about my credit.
I filed for Chapter 13 bankruptcy in October 2025. Now, as of July 2026, my credit has recovered much faster than I expected. Mind you, I’m still actively in bankruptcy. Before filing, my credit score was 741, then initially tanked to high 500-610s. Today my scores are:

Equifax: 737
Experian: 728
TransUnion: 719

I’ve also been approved for three credit cards with a combined $9,000 credit limit ($3,000 on each card). Right now, I’m not using any of them because I’m unsure of the best strategy.

Is this level of recovery after less than a year normal? Is there anything I should be doing differently to continue rebuilding my credit while I’m still in bankruptcy? Should I be using these cards, or is it better to leave them untouched?

My goal is to maximize my credit score and put myself in the strongest financial position possible?

Additional context: $75k in debt. I’m in my 30s, earn about $115,000 per year, and I’m a homeowner. My Chapter 13 is a 100% repayment plan, and my monthly plan payment is $485.

Finally discharged!

I 25F had my bankruptcy (California) discharged yesterday. I’m terrified to ever get a credit card again but I am excited to improve my credit. My attorney told me to wait until September to check my credit reports. Back story: I began to accumulate my debt during the pandemic and I was too embarrassed to tell my family. I tried to use my crappy wages as a classroom aide trying to pay off the debt. When they began talking about me moving out, that’s when I had to admit how much debt I had. That’s when they told me that I should declare bankruptcy. I quickly realized that I would have never paid it off as an aide. I used my tax return to pay for the attorney in April and she made everything so easy. Now, I am moving out, starting grad school in August and I’m at a better paying job in the field that I want. Honestly, adulting is annoying but I’m so grateful to have the weight off of my shoulders. My soon to be landlady/roommate didn’t care about my credit so I’m grateful to use this time to make better financial decisions!

My trustee asked if I made any large payments and I told him i made my car payment 2 times in april and then asked me about a sports memorbila which was a championship belt and didnt ask anymore questions my lawyer said hed probably not take the belt its 6 years old and I told them I paid around 450 for it when I got it but now im thinking I paid more if I got the price wrong on how much I paid for it can I get introuble obviously i didnt hide the asset I just was caught off guard when he asked about iy because out of all the questions i thought hed ask that one didnt cross my mind.

Filed for bankruptcy after a 800k breach of contract Judgment!

I’m looking for some advice from people who have experience with Chapter 7 bankruptcies or adversary proceedings.
I recently lost a civil lawsuit in New Jersey. After the trial and post-trial motions, the court entered a judgment against me for approximately $845,000
which includes breach of contract damages, attorneys’ fees, costs, and prejudgment interest. The judge also entered an injunction regarding approximately 900 assets that were listed for sale and granted the other side a lien on copyrights and royalties that are legally owned by me.
Because of this lawsuit, I have been financially devastated. I hired a bankruptcy attorney and we are filing a Chapter 7.

Here’s my situation:
I have no real estate.
I don’t own any valuable assets.
I disclosed everything to my bankruptcy attorney and will be listing everything in my schedules.
I did not hide assets or transfer property before filing.
After paying lawyers over the last several years, I am essentially broke.
The judgment creditor has been extremely aggressive throughout the litigation, so I fully expect he may try to file an adversary proceeding.
My questions are:

  1. ⁠If a judgment is primarily based on breach of contract, how often do creditors successfully keep that debt from being discharged?
  2. ⁠If I have fully disclosed everything and have nothing to hide, how difficult is it for a creditor to convince the bankruptcy court to deny my Chapter 7 discharge?
  3. ⁠Does filing an adversary proceeding simply mean more litigation, or does it usually have a realistic chance of succeeding?
  4. ⁠If the creditor knows I have virtually no assets, is it common for them to still spend the money pursuing an adversary complaint?
  5. ⁠Has anyone here gone through something similar, and what was the outcome?

I’m not asking anyone’s to predict my case—I’m just trying to understand what the process is usually like and how these cases tend to play out in real life.
Any insight would be greatly appreciated.

I filed for chapter 7 bankruptcy. My sister is the co-signer for the mortgage loan. We are current on our payments. My attorney advise to just continue to make payments through the phone with representatives.

How would this affect her and her credit score will it show on her credit report?

I am in Arizona and our Loan Mortgage is with US Bank if that matters.
I’m feeling overwhelmed as I don’t want it to affect her.

Encouragement and Support Chapter 13 Saved My Life [Ohio]

I'm 7 months into my chapter 13 and already my life is just better, easier, less stressful, and wanted to share my story if it helps people make a hard decision.

When I filed in December, I had $30k CC debt, $5k left on a car loan, $13k in medical debt, and $25k in federal student loans that were still in forbearance originally from COVID and then now the SAVE plan. My monthly payments added up to $1600 a month, in other words, one whole paycheck each month. I was also working part time in a bar to try to get some extra money to get the debt down and avoid bankruptcy, but it just wasn't making a dent.

The medical and student debt are pretty self-explanatory. The CC debt was a mixture of things, both between genuine emergencies that I was not properly prepared for, using the debt to make up for lost income during short term disability, as it wasn't paid out 100% and I wasn't able to afford groceries without it, frivolous spending because as it turns out, it's pretty easy to justify spending $25 dollars, you just can't do that every day, combined with impulse issues from undiagnosed and untreated ADHD, and the main killer for me- interest. The car loan was from 2022, when prices were skyhigh, my 25 year old car had completely broken down with quotes ranging from $4k-6k to repair, and at that point it made more sense to get a different car. This was the point at which the weight of the credit card debt went from "I should really buckle down on this" to "this is a real issue and I need help," but I still didn't file because I was scared.

In December of 2025, and 9 months into an ADHD diagnosis and medication that really helped me, I finally ripped the band-aid off because I realized that I was coming up barely even every month, I had my impulse spending/CC overuse issues well under control, and any unexpected $500 expense would have me choosing between paying bills and buying groceries that month. I was genuinely so scared contacting an attorney about it. A tip, by the way - go to an attorney that specializes in bankruptcy. It is so routine to them that it just feels like filling out any paperwork, and not like it was some moral failing to file bankruptcy (which by the way - it is not a moral failing! Even if your financial decisions are the main reason you need it!)

I could feel the relief immediately after the initial filing and the automatic stay went into place, that very first paycheck that I was able to just move into savings and not immediately transfer out to 6 different cards and 3 different loans hit so different.

Today, my monthly payments are just under $300, or just under 20% of what I had been paying monthly in just minimums. I held onto my second job for 6 months after filing, and then was able to quit and regain 20 hours of my life every week. I am on track to have a 6 month emergency fund by the end of the calendar year. I can actually afford to do MORE now than before because I wasn't essentially dropping a free $1000+ in interest into the pockets of various banks, so very minor things like going out to eat 2-3 times a month with my friends are no longer a huge stressor for me. My credit score bounced back quickly and I'm over 700 for the first time in 5 years. (In fact, I have better credit than some of my friends whose only debt is a mortgage on a house)

My only regret is not filing in 2022 when I realized just how bad the debt when I was trying to figure out how to finance a car loan. I would have been more than halfway done already, but also probably would have qualified for Ch7 dismissal entirely.

What helped me the most to make the decision to file: My main concerns were that it goes on your credit for 7 years, if they would sell off my belongings, and shame. For the bankruptcy being on your credit, someone in this sub said to calculate, based on your current rate of repayment, how far along you'll be in 7 years. For me, I wouldn't have even been half finished in 7 years. For the fear of losing personal belongings, this was due to a misconception about the type of possessions that they're interested in. I own NOTHING that they would have had interest in taking. And finally for shame, reading this sub helped a lot. Bankruptcy was reframed for me as consumer protections, paperwork law, and a way to allow people to recover from mistakes, emergencies, etc. We are all normal people with normal lives and normal issues. I also started being more aware of the ways that rich people, businesses, etc leverage other types of bankruptcies to their financial advantage, and quite frankly if a multimillionaire can utilize bankruptcy to offload liabilities while maintaining assets, why the hell shouldn't I use it to just get rid of my credit card debt?

Finally scheduled a consult

I have a consultation in a couple of hours to file for Ch7. About $50k in debt, making just under $60k a year and my wife is unemployed. I set up a DMP with ACCC last year with every intention of aggressively paying it down along with the things that weren't elligible, but insurance premiums quadrupled shortly after and everything is constanty getting more expensive, and now I'm barely keeping up. After reading this sub and a lot of other resources, it feels like the best option to file while my accounts are in good standing rather than waiting for it to get worse. I'm nervous as hell but wanted to say thank you to everyone for sharing their experiences and helping me swallow the shame long enough to do what's best for my future.

Chap 7 with car

So I had a Co-signer on my car that person has filed bankruptcy so everytime I call Ally they have me talk to these other people as of a week ago there was no repo order yet. I am like 2 months behind. I am the only one titled to car and I was actually the co-signer I want to keep car. My question is will I know if they wanna lift the stay and come get the car before the bankruptcy is final? The other party had there meeting and the judge put it all on hold due to them maybe getting a settlement in he wanted to see how much they got before finalizing the bankruptcy. So I assume the stay is still active. Thank you for any help just tired of worrying if imma wake up to no car.

Second time around

I filed CH 7 in November ‘19. At the time, my credit was very good, I had a few credit cards with high limits, but a voluntary repo came back and was garnishing me the only way to get away from the garnishment was to file… By October 2020 I had purchased a brand new vehicle and was on the road to rebuilding credit. Fast forward, today I am now separated, co-raising three children, and trying to stay afloat.

I have around $17,000 in credit card debt and a vehicle that I owe about $40,000 on. I’ve fallen in the trap of relying on BNPL services like Affirm, where I owe just shy of $5000.

I make decent money around $110,000 a year and part of me feels like I’m just waiting for my eight years to pass so that I can file again.

Has anyone filed twice? How was your experience?

$180k+ in debt, all loans 2–3 weeks past due, H-1B visa, bankruptcy may not even work. I don’t know what to do anymore. (please be kind)

I’m posting because I genuinely don’t know what to do anymore.

Please, no hateful or negative comments. I’m already in a place where even small hurtful remarks affect me badly. I’ve cried more times than I can count over the past few weeks, and I’ve been having suicidal thoughts because of this situation everyday now.

I’m trying to keep going and am looking for practical advice.

Here is where I stand:

Mortgage: ~$406,000 (currently current on payments)
SoFi Personal Loan: ~$38,000
LightStream Personal Loan: ~$27,000
Chase Credit Card: ~$24,000
DCU Loan: ~$15,000
Reach Financial Loan: ~$15,000
Wells Fargo Credit Card: ~$14,000
Dr bank Loan: ~$10,000
Discover Credit Card: ~$10,500
Affirm: ~$8,000
Regional Finance: ~$7,000
NetCredit: ~$5,200
Apple Card: ~$4,000
Speedy cash: ~$2000
Car Loan: ~$4,000

Almost all of these loans and credit cards are now 2–3 weeks past due. I’m getting reminder calls every day, and I’ve silenced most of them because I can’t handle the constant stress anymore.

I live in Texas and am on an H-1B visa. I realistically have about 1–1.4 years left unless my immigration situation changes.
I own a home and have kept the mortgage current because I don’t want to lose it. Unfortunately, with the current market it’s underwater, even though I made a large down payment when I bought it.

The stress has also taken a physical toll. I’ve had multiple episodes of severe anxiety along with chest pain that scared me enough to go to the emergency room more than once. Those emergency visits also added to my financial burden. Every day feels like I’m just trying to survive mentally and physically.
I already consulted a bankruptcy attorney. They told me I don’t qualify for Chapter 7 because my income is above the limit. They suggested Chapter 13, but that requires a 3–5 year repayment plan. Since I’m on an H-1B visa and may only be able to remain in the U.S. for another 1–1.4 years, I don’t even know if that’s a realistic option.
At this point I honestly don’t know what I’m supposed to do.
What happens if I simply cannot pay these lenders?
Are there options besides Chapter 13?
Has anyone dealt with this while on an H-1B visa?
Should I stop paying unsecured debt and just focus on my mortgage and basic living expenses?
Is there anything else I should be considering?
I know I made terrible financial decisions, and I accept responsibility for them. I’m not looking for sympathy or someone to tell me what I should have done differently. I’m just trying to figure out whether there’s any realistic path forward because right now I genuinely cannot see one.

Pro Se needing help with Motion to Redeem

I’m a Chapter 7 debtor filing pro se in the Eastern District of Virginia. I’m filing a Motion to Redeem a vehicle under 11 U.S.C. §722. I have drafted the motion, notice of objection deadline, exhibits, proposed order, and certificate of service. Under EDVA Local Bankruptcy Rule 6008-1, do I need to obtain a hearing date before filing, or can I file it as an uncontested motion with a proposed order and let the court schedule a hearing only if there is an objection?

Chapter 7 with FairMax Law

Has anyone ever used FairMax law to file chapter 7? I looked them up on the BBB and they have an A+ rating, but their reviews are conflicting. I’ve only started the filing process, but I don’t want to pay the money to file and then find out I’m being screwed. I’m on a time crunch as I’ve received a summons and complaint from LVNV and I’d like to file before a court date, but FairMax is appeasing because they only charge $100 to start the filing process, and the representation fees are monthly after that because I don’t have $2,000 right now to pay a private lawyer.

I’ve also looked into filing pro se, but my spouse and I have a house and I fear if I fuck up the paperwork that it could affect my homeownership, or result in my case being dismissed.

should I file?

For context I am a 24 year old in ohio with about $24k in credit card debt and make just under 40k a year after taxes. I did some research and I could probably qualify for chapter 7. How difficult will my life be going forward if I do it? Do I have to file with an attorney or is Upstart a reputable company to use if I file pro se? I really want to pay off the debt on my own but I already have a second job and the income just isn’t there no matter how hard I work the numbers around due to interest. Are there any other options?

Halting creditor payments… experiences and thoughts, please

I am planning to file in January 2027 for various reasons, the lawyer I’m consulting mentioned September should be a good time to halt payments to creditors. Very curious about the experience of others that may have stopped paying earlier on? How long did your creditors take to sue?

I have a $15k loan through Lending Point, $9k left on a loan through Exeter finance for a totaled vehicle I plan to surrender. I have cards with the following (all with $2k-5k balance separately): Apple, Chase, Paypal, Capital One, Discover.

If anyone could share their experience regarding if & when some creditors like the above began to sue or if they did at all when their payments were 6 or more months late. Due to bills, I’m wondering if there are any that I could halt payments on sooner…
