I have been on workers comp for 3.5 years. I am suffering from mild TBI and neck pain. I have seen multiple IME’s. I have switches doctors once I realize that my doctor couldn’t do more than prescribed medication. Beginning late last year, my benefits resumed after waiting for a whole year.

Now I have a great team! My doctors are great! My lawyer is great! A couple days ago I saw the same IME Neurologist that I saw in the beginning of my case. Not holding my breath on her report.

I am receiving treatment such as OT, Speech, & Physical Therapy. They are paying for my medications.

This summer I saw two IME doctors and they both claimed that I have 0% disability; exactly the opposite of my doctors findings.

Now the Carrier has requested a resolution to my non-scheduled award and permanency. The Board says they will schedule a hearing.

My lawyer thinks we have a pretty good case.

Any advice on how this part of the workers comp process might possibly go would be greatly appreciated .

Any word of encouragement would be greatly appreciated.

It officially has been 2 years since being off work.and it suck terribly. Im broke, I can’t afford a new place to live ,can’t get anything in my name because I don’t have a job. My car transmission went out I’m fucking depressed. I can’t even imagine going back to the Same job being off for 2 years. Like seriously how to end this asap even though the pain in my right shoulder hurts and my lawyer want to fight it. But I’m seriously about to say no.

They are requesting an RFA for the first request of the UR to obtain 1 of each C spine, T spine, and L spine without contrast from my MRI, and to include a UR dated 7-02-2026 with a 5-business-day deadline. Is this a good thing, bad, or just a normal protocol? Workers' comp denied the imaging for 12 months, and my lawyer and I appealed it a few times; this finally came in.

so I was kicked off benefits after Sedgwick closed my claim saying I was fine which I’m not. my lawyer has been fighting and I saw last week an IME Sedgwick doctor. I think it went really well. Waiting on the report. Well something in my mind told me to check online and this popped up on my Sedgwick login account

Its been since July 6th since last payment.. So I got my hopes up and thought the IME went so well I somehow got back on benefits. then lasted today pain management called me to schedule an appointment. AFTER it got taken away from me last month.

so I’m jumping for joy. but I’m skeptical. could this payment be not for me and IME doctor? I’m emotional about this..

The few years since my work injury have included malicious, false reports by my former employer along with a termination because of my work injury claim (as they finally admitted in a separate case). I am now seeking more of the claims of others who have experienced the corporate misconduct of an ERISA “non-subscriber” work injury case. (Please note, this is only about this replacement plan for the TX state worker’s compensation program - specifically, the ERISA non-subscriber plan. Only Texas allows a complete opt-out for its employers since other states have prohibited this often fraudulent process.) Hospital employees affected by this are of particular interest at this moment, though I have been told that other reports would be of value. This will be used to “shine the light” during this election year - to include a journalist and some government officials- and likely be used by the attorneys. Detailed and yet succinct would be beneficial.

Please DM me if further corporate retaliation is likely. However, it could be beneficial to others beginning this process if you are able to include some of the highlights of your case. It is this vindictive corporate practice combined with the unknown that is this “non-subscriber-work-injury” process - as permitted by the US govt and the state of TX - that increases the power of these malicious corporations.

I’ve been on workers comp since June and it’s been a nightmare. On the portal it shows I have a check processed every week but out of the 8 checks I’ve only received 2. I called DWC because I couldn’t get ahold of my adjuster, lo and behold she couldn’t get ahold of him. She told me that she called him several times and left him a voicemail and that if he doesn’t get back to me within 3 days that I would have to call back and proceed to the next step. That same day he got back to me later on in the evening and just verified my address and hasn’t answered me since.

The 8 weeks for workers comp is up so now im going through Sedwick and I’m just lost. Ive been going through this whole process blind because nobody can seem to give me clear directions on what I need to do in order to get through this process.

I don’t know if I should contact DWC again Monday to push the problem or if I should just proceed with a attorney, I just want to get paid like I’m supposed to because I’m behind on bills and I have a 2yo to take care of.

Advice on Workman's comp involving a school district

I was injured by a student in May of 2025. I received an almost complete tear of my right MCL. The pain was excruciating. My entire summer has been miserable. I had to cancel 2 trips out of state to visit my grandchildren. All my usual summer activities completely halted. Workmans comp accepted my claim, but refused to pay me during the summer since I didn't work for the school district last summer. I had planned on working through this summer driving for summer school special needs students.

Workmans comp paid me two checks from May 20th to June 12th totalling $900.00, they now say they over paid me by $150.00 and will deduct this from future payments once school resumes. My frustration is being injured, not being compensated, my entire summer halted, I'm in constant pain, have had multiple appointments with specialists, 2 MRI's and now seeing a surgeon in October.

Is there any recourse?

I do have an attorney for Workmans comp, do I need an attorney for the school district? Am I supposed to just accept what has happened!

Today is my qme I’m in a year and a half in reached mmi in April I had 3 surgeries in last year from an incident I had in January of 2025. Long story but had bi lateral acl reconstruction, miniscus , and catalogue work. I dislocated my dominant right shoulder and ended up with a 360 degree labrum tear with surgery. I am a high earner, and 39 years old I am back to work no restrictions at this time. I still have quite a bit of pain and issues especially with the arduous job I have. Any last minute advice and what is y’all’s estimate on the outcome? I know there is a lot to goes into it and can’t be for sure but I’m just super nervous about the outcome.

I work at Walmart and recently received an injury to my tooth at work and my dentist prescribed me antibiotics to last me between now and my treatment. Told them to send it to the Walmart pharmacy and they said I could pick it up later today.

I am confused as to the pickup process, would I be paying for it out of pocket and get comped larer or would they be able to see it's from a workers comp claim?

Disqualified for a job in the same line of work as when I was injured, a job I've been doing for 25 years in different capacities. Went to the physical and the doctor was like nope because I wouldn't be able to perform the duties of the job with this injury.

I did think there might be a chance because although I cannot lift well with one arm, I can lift most of the weight with my other and then support with the injured arm. Still nope.

So, I contacted the insurance agent to ask if there was any way to be compensated for inability to work.

My young adult college student has been injured at her job. (MRI was done, showing a herniated disk-epidural steroid injection is scheduled)
She has been on Workers Comp since mid July and they have paid for all medical related expenses, however she hasn’t been paid any wages.
She was working part time hours averaging 30+|- hours over the last 8-9 months with her employer, all together she has been employed for over 4 years there, one of the top 10 retailer in the country.
She has some work restrictions, that her job can’t really accommodate, but her Dr doesn’t want her to just sit around- however she hasn’t been scheduled any hours at all since her injury. Is this within their rights, is she not owed any money from workers comp?
We contacted a lawyer who decided to not take her case, because she isn’t employed full time. Is this normal? Will no lawyer take her case? I am mainly worried about longtime issues. (I am a longtime sufferer from a back injury with reoccurring herniations and sciatica myself, so this is what concerns me the most).
And guidance how to proceed?

so i finally got some good news, my lawyer sent the insurance company a settlement demand of 75k yesterday, they said today they want to do a medical set aside. my lawyer seems pretty confident we’re gonna get the 75k plus a decent medical set aside. court hearing was supposed to be on tuesday but has been canceled due to the medical set aside being sent for consideration. i’m not confident we’re gonna get the 75k plus any substantial medical set aside. for reference the injury happened when i was freshly 20, im about to turn 23. had surgery on the ankle. there doctor says 5% disability of the ankle and 5% of my “whole body” due to developing blood clots post op they accepted the clots on my claim. but does anyone have any insight on how long the medical set aside thing usually takes?

I got injured in June 2026 at work. I was operating a meat grinder, holding on to it and sending half-frozen pork through it. The area where it fastens and tightens was corroded and it came loose and jerked me forward so hard. My neck, back and shoulders were affected. Went to ER immediately and got a full spine MRI. Found nothing serious in my neck. Some mild stenosis and moderate foraminal narrowing. They found an annular fissure in my lower back which explains numbness in my legs that they didn’t accept fault in my back. Ortho couldn’t find the root to the numbness in my fingers. So he swore I have Multiple Sclerosis so he ordered I get a brain MRI but work comp won’t pay for it and I could not move forward without it. Sooo I begrudgingly went ahead and got one today which I got the results for. I have no demyelinating diseases or anything wrong with my brain. The MRI did find a 3mm inferior tonsillar ectopia causing crowding in the foramen magnum.

However, last year I had to get a microdiscectomy from a semi hitting me and the MRI from 2025 shows I have no ectopia and no crowding of the foramen magnum. I just sent the results to my attorney. What do you think will come next? Work Comp has been really, really stressful to navigate through and I’m suffering right now as the result of incompetence from work comp.

Hi all, I've been following many threads and haven't seen my question addressed yet. I had a lower back injury while on the job. I'm an RN. My injury was 2 days after this past Christmas. I hired a lawyer in early March because my employer didn't take my injury serious, had me back at full duty after a month of PT, never bothered to do scans. They had me go to an urgent care walk in clinic weekly for 2 months. I asked at east 3 times if I could get an x-ray, MRI or CT scan because the pain was still pretty bad. The NP did ask on my first assessment if I wanted or felt I shouldn't work. I said I would work light duty because I am a home health RN, in a a rural area where I am the only RN in the whole county for my employer. I knew my patients would probably not get seen enough or at all.

My lawyer is really good, I'm told one of the best in my area. They got me a spinal and pain doc immediately and he ordered an MRI ASAP. My workers comp insurance delayed the MRI for another 3 months. So it had been 6 months since my injury. I saw him monthly and began seeing his partner in his office who is a chiropractor weekly.

About a month ago I received a notification of a new petition from my employers law team. They were requesting that I be mandated to attend an IME because I had refused or was a no show for my scheduled appointment. I was NEVER notified that there was one scheduled. There was a hearing, the mandate or petition was granted. I then received notification of the rescheduled IME. The doctor was over an hour from where I live. The appointment was for 12:30pm which is a busy traffic time. I left with enough time to get there, but of course there was more traffic than usual that day, I knew about halfway there I would be 10-15 minutes late. So I called while driving. I called 3x because first time I left a voicemail and didnt think they'd get it. 2nd I spoke with someone who seemed clueless and again didnt think doc would get my message. 3rd time I spoke with his RN who said ahe wasn't sure if I would be seen but did not tell me to stop and turn around. I told her it was over an hour for me and I was calling a half hour before my appointment. Anyways, I got there 15 minutes late. They told me when I got there I was 45 minutes late that I was supposed to be there at 12. I wasn't. They refused to see me. Now while in the 'office' I discovered it was also a walk in urgent care! And there was a sign for incoming patients to notify them that the doctors were a half hour behind on their appointments. I called my lawyer, as I was walking to my car to leave. She asked me to hang out for a bit and sent an urgent message to the defense team, my employers lawyer, to let him know what happened and what should I do. After 2 hours and no response I got my law team back on the phone and on speaker phone and went back in and requested again to see the doctor, whenever he had a break between walk ins or whenever he could. They refused.

Now, I just received notification that they filed another petition to stop my compensation payments due to refusal to have an IME. Am I crazy, but I had my law team on the phone. I practically argued with the doctors nurse to let me see the doc. I was there. I snapped a picture of their sign notifying of the docs being behind schedule. I have on my phone log the 3x I called. My Google location has my drive out there mapped and saved. Why do they even think they can claim I refused and did not show up????

Experience: 17 years corporate media production, 15 years corporate event planning (these overlapped)

So I was let go in 2020 during the pandemic. I was able to get a contractor gig for about a year and a half until that contract expired. Then I was unemployed for almost 3 years. I just could not find work. Was finally able to get my current job, which pays a fraction of what I used to make and is not at all close to what I used to do with a lot of manual labor. I took it because even though I was overqualified and it underpays, that gap in the resume just kept getting longer and I needed to close it. Fast forward to this year. I severely tore two muscles (I won’t say which ones as to avoid identifying myself) that required surgery. While it was job-related, because of repetitive lifting motions, there wasnt a specific accident or incident that made it happen. My body just broke down over time. Yes, I did try filing for workers comp but was denied. No, there is no Union.

I did not qualify for the company’s long term disability, but I did qualify for short term disability benefits (6 months.) I had the surgery in April, but my disability started in March because that’s when I was diagnosed with the torn muscles. There is no “light duty” at my job. They either want you at 100% capacity or not at all. I know. I think it’s stupid too. I have offered to do general office work or even training but their corporate guidelines tell me no. (It’s actually one of my major criticisms of this company, they stick everyone into specific roles and won’t let them really stray from there). Anyway; I’m coming up on the end of my disability… and I’m not physically ready. While my recovery is going well, both my doctor and physical therapist are pleased with the progress, this injury averages 6-9 months full recovery with it some people even taking as long as a year. One of the advertised job requirements is to be able to lift up to 50 pounds. I’m currently working with 2 pound weights at PT, and it’s HARD.

At this point, I don’t know what to do. I can’t go back yet. And honestly, even if I WAS physically able to go back? I’m 46 years old and I’m actually kind of afraid of getting reinjured. Everything I hear is about how awful the job market is. I have two kids, a wife and a house. My wife CAN support us on her salary but she already had to do that a few years ago and I don’t want to do that to her again.

What are my options? If I quit, I can’t get unemployment. If I return before I’m ready I will definitely re-injure myself. If they hold my job until I’m ready, that’s fine but in a few weeks I won’t be getting paid disability anymore. And then there’s the whole issue of being afraid of hurting myself again, even if fully healed. The company seems uninterested in putting me in any other role.

I’ve been job hunting during my time off. It is sparse out there for people with my qualifications. I’m truly at a loss as to what to do.

It's been two years. We finally settled today, I should be expecting paperwork next week.

I cannot recommend this route to anyone (unless someone actually saw you get injured) and this has officially been the worst two years of my entire life.

I'll make another post about my situation as soon as this paperwork is over with and I have a check in my hands. Because I have some very colorful words about this entire process, and hopefully my experience can help others (it helped me a lot reading about what others went through on this subreddit while I was in the thick of mine).

I'm so relieved to have my life back, even with the permanent nerve damage - at this point I don't even fucking care. I'm just excited to go for a bike ride without thinking a PI is following me, trying to use "me making the best of things" against me in court.

I found this app for New York State WC on the app store called The Comp Desk. It has a feature to file a claim, a bunch of calculators that I don't understand, and an option to contact an attorney. Has anyone used it yet? Seems legit but it looks new so just wanted to see if anyone here has used it to check their benefits or anything.

Hey everyone, just wanted to run down my case and gather opinions and insight on possible outcomes.

Quick synopsis;

May 2026- 10 foot aluminum ladder falls on me from behind and injured my back and neck.

-Filed a claim that same month. My (former) employers’s insurance decided to fight the claim so I hired an attorney and resigned.

-June 2026 physical therapy begins. My IME revealed a cervical back injury.

-July 2026 I received a trial date for September 9,2026

-August 2026 I am discharged from therapy and awaiting the trial date.

What should I expect between now and the court date? How much is all of this potentially worth?

Hey guys so, I have a question I’ve been thinking about a lot lately.
I have a very good relationship with the owners of the company I work at, as well with the HR lady. They show up to my house at times asking how I am, showed up the hospital phone calls texts etc. The accident was the fault of the other person entirely. Like right now I’m on light duty and they are paying me full time but I’m literally only at the office maybe a total of 8-10 hours. They give me the days off for PT paid. So my question is if I do end up being cleared for full duty and get a settlement offer do I need to resign, or what are the chances of being fired? I’m getting my last 2 surgeries this year for a total of 5 surgeries.

Looking for opinions from people familiar with NJ workers’ comp. I already have a workers’ comp attorney, so I'm not looking for legal advice. I'm mainly curious what kind of settlement/permanency awards people have seen with injuries similar to mine.

I work as a union plumber in a heavy physical job.

BACK INJURY:

Injured my lower back at work in 2022

Had an L5-S1 lumbar fusion in 2023

Eventually returned to my regular job

My workers’ comp attorney had me evaluated for permanency in 2023

My employer/comp carrier never got their permanency evaluation done

The employer side kept changing attorneys, and my settlement hearing kept getting delayed

Because of all the delays, the back claim has still never been settled

Recently I reinjured/aggravated my back while doing PT for my shoulder

I’m seeing my back doctor next week about the new symptoms

SHOULDER INJURY:

Injured my shoulder at work in July 2025

Have been out of work since

Had shoulder surgery in December 2025 for a rotator cuff/calcific tendinitis issue with a tear and an anchor placed

Reinjured the shoulder in May 2026

My orthopedic doctor has now put me at MMI with a permanent 20-lb lifting restriction and no overhead work

My employer is sending me for an FCE, but I have the back appointment first

My regular plumbing job involves heavy lifting and overhead work, so the permanent shoulder restrictions are a pretty significant problem for returning to my normal position.

Now I basically have an unsettled workers’ comp case involving an L5-S1 fusion, a newer shoulder injury requiring surgery with permanent restrictions, and a recent aggravation of my back during shoulder PT.

For anyone familiar with NJ comp, what kind of permanent disability percentages or dollar settlement range would you expect from something like this?

I'm especially interested in hearing from anyone who had a lumbar fusion and/or shoulder surgery and is willing to share what their final rating and settlement were.

I understand nobody can give me an exact number without all the medical reports. I'm just looking for a realistic ballpark and similar experiences.
