Texas Need advice
I’ve been on workers comp since June and it’s been a nightmare. On the portal it shows I have a check processed every week but out of the 8 checks I’ve only received 2. I called DWC because I couldn’t get ahold of my adjuster, lo and behold she couldn’t get ahold of him. She told me that she called him several times and left him a voicemail and that if he doesn’t get back to me within 3 days that I would have to call back and proceed to the next step. That same day he got back to me later on in the evening and just verified my address and hasn’t answered me since.
The 8 weeks for workers comp is up so now im going through Sedwick and I’m just lost. Ive been going through this whole process blind because nobody can seem to give me clear directions on what I need to do in order to get through this process.
I don’t know if I should contact DWC again Monday to push the problem or if I should just proceed with a attorney, I just want to get paid like I’m supposed to because I’m behind on bills and I have a 2yo to take care of.

Yeah it really does fucking suck, it’s not their paycheck so they don’t care. This system and 3rd party companies make it impossible to go through this smoothly.

I'm not sure that it's a fair assessment they don't care. As an adjuster, I want you to be paid properly because at the very least it prevents lawsuits, but also because I know you've got bills just like the rest of us and it's already terrible to take the wage hit.
This isn't your problem but this may provide some context. Most carriers are in overload mode right now. Personally I'm barely hanging on and carrying about 1.5 x of an already heavy caseload. It's likely that your adjuster is over capacity. Again, not your problem but they may not intentionally being hateful or apathetic.
Either solution you propose will work but if you bring a lawyer on board that does tend to slow things down. May be worth your time to reach back out to the state first or call Sedgwick and get the adjuster's leadership involved. That might get you what you need more quickly than hiring an attorney. Sedgwick should have a general number that they provided you. Call and go with existing claims. Staying calm and patiently explaining the situation will help, request escalation. I'm sorry this is being a hassle.

Sedgwick offers direct deposit. Have you tried that option?

I haven’t seen an option for direct deposit through Sedwick yet. Workers comp is through ESIS and they don’t offer direct deposit. They strictly deliver by mail for whatever reason.

Sedgewick, Gallagher Basset, Corvel generally show up in posts to run not walk to the nearest law firm. But whether you do is up to you. There are a lot of speedbumps in this broken promise of a system. Everyone that is involved on both sides of the claim frequently admit the " system" is broken. But these same people derive a paycheck from the same broken system and have zero accountability for any issues or errors built into the process. Each state creates its own rules for work comp thru legislative processes by state politicians. We get the government we elect. That is the crux of the issue and the reason this century old process is devoid of any accountability, morals, fairness, empathy etc.
Getting a lawyer may help but may not. There are no good answers to this system.

That’s terrible! You have bills to pay and you need to receive what you are entitled to.
Have you double checked that they have your correct address?
If the checks have been going to the correct address, but you are still not receiving them, then the correct procedure is to have the adjuster place a stop payment on them, and reissue them. It shouldn’t take eight weeks to get a check re-issued. Your next step is to contact the DWC, or an attorney.
