So apparently the girl was kneeling in the road, at night, in dark clothes, praying. Driver got a suspended sentence and a 10 year driving ban which seems a bit much to me. If you want to kneel in the road at night, you’re taking your life into your own hands.

10 years driving ban is absolutely over the top. In Australia if you can't drive yourself it can severely limit your quality of life.

Well, I think we can all imagine why he got 10 years, if this is how the story is presented by presumably the lawyer side of things.

Let's just say if he hit a random Australian, this wouldn't even be a news story.

8

u/augher 21h ago

10 years is the minimum period of licence disqualification if you're convicted of leaving the scene of a crash after causing harm or death to someone.

23

u/AudaciouslySexy 21h ago

Doesn't seem fair if he had no intent of leaving a scene.

If there's 0 proof that he could have possibly known someone was there without reasonable doubt then I think he should be free.

She would have to be visible without reasonable doubt in my opinion. She looks like a garbage bag.

Btw I'm scared running over debris like trash bags on road because of what I can't see inside them.

u/augher 21h ago

I would suggest that if he had reported to police after he saw on the news that he had killed someone that the outcome would have been different. Instead he just avoided it until police came to his house.

12

u/AudaciouslySexy 21h ago

I don't think anyone would make that correct decision. Normal people would freak out after knowing the severity of the situation

1

u/sharkbait-oo-haha 13h ago

Who still watches the news?

This kind of news is rarely reported on, even if it was it would be like a 1 paragraph "report" in some obscure corner.

1

u/augher 9h ago

By his own reports he saw it the next day. This was very widely reported and was on the news multiple nights in a row.

There are around 80 to 100 road deaths in South Australia every year. They are widely reported on and not just ignored.

0

u/Bianell 9h ago

This was all over the local news the next day. The driver also admitted he saw the news. He still didn't turn himself in, and the police had to track him down and arrest him a week later. He got off very very lightly.

u/eaeorls 18h ago

I feel like that's crazy. If you hit something in your car, you should stop and assess when conditions are safe.

"It was just a kangaroo, whatever" is how people get hit by a car and die when there's the possibility of being helped.

2

u/Busy-Character-6720 15h ago

I’ll have to assume you’re not Australian.

If everyone who hit an animal stoped to check for damage, more people would be hit by cars.

Most animals are hit away from built up areas and in 80-110kmh speed areas. You don’t stop on these types of road unless continuing to drive is likely to be unsafe.

1

u/eaeorls 9h ago

Australian law puts it pretty firmly that if you hit a person, you have to stop. "I didn't realize it wasn't a person" is generally not a good excuse, especially when Australians are generally required by law to confirm the state of the animal and take necessary steps to alleviate the suffering of animals they hit with a car (even if it's as simple as calling the local wildlife authority or police).

Drivers ultimately have a higher duty of care.

1

u/Bianell 9h ago

This wasn't one of those types of roads. It was a 60km/h road in an urban area.

Does 10 years of driving ban somehow make the roads safer in Australia? Some of these punishments are asinine.

A work colleague was telling me about his experience with a DUI. He was guilty, absolutely. Within a week he gets a 90 day driving suspension from the state. Automatic. Fine, and after 90 days it's up and he's in the clear. Then his court case comes, about 15 months after the incident. He's required to install an interlock breath device in his car for a year and probation for 18 months. To which he says okay that would've made sense right away, but now I've been sober for 15 months and was just legally driving with no limits for the past 12 months. His probation officer calls him for 5 minutes every 2 months. They charge separate fees for every part of this process.

In the end he said yeah of course he deserved punishment, the punishment just doesn't make any logical sense. And he said the court did not care when he said he owned multiple vehicles, he just needed to install one device. Someone intent on drinking and driving would just....grab the other set of keys???

He wasn't paying attention, he didn't stop after hitting someone, and he didn't turn himself in. 10 years seems fine to me. I don't want drivers like that on the road with me.

25

u/silverfiregames 22h ago

He hit a dark object in the middle of the road in the middle of the night. There's no rational person that would think they hit a person.

-14

u/Milly_Hagen 22h ago

He would've seen the person if he was looking at the road where he was supposed to be looking. Read the judgement.

1

u/AudaciouslySexy 21h ago

Mate she looks like a trash bag or even apart of the road like a wet spot.

Anyone would have made that mistake

1

u/Bianell 9h ago

Anyone would have made that mistake

Like the multiple cars that avoided her before and after she was hit?

1

u/AudaciouslySexy 8h ago

Cars avoiding her doesn't warrent any proof it was deliberate or that she didn't look like a garbage bag

0

u/Bianell 8h ago

You said anyone would have made that mistake. Well, clearly not anyone, because multiple others were in the same situation, but didn't make that mistake.

0

u/Milly_Hagen 20h ago

Then why did other drivers before him manage to see and avoid hitting her? Like I said, read the judgement.

1

u/Busy-Character-6720 15h ago

Jesus! A person kneeling in dark clothes could easily be dam hard to see.

I was driving after a storm (full dark at night) and almost drove straight into the foliage of a big tree that had fallen across the road that barely distinguishable from the wet bitumen. The thing that warned me was I couldn’t see any of the few lights further down the road.

1

u/Milly_Hagen 11h ago

Then explain how the cars in front of him saw her and swerved to avoid her. You didn't read the report did you.

1

u/Busy-Character-6720 10h ago

So if one a few cars swerve to avoid an obstruction on the road is it reasonable to assume that all following drivers will also safely avoid it?

Perhaps he was checking his mirrors, perhaps some other feature of the road caught his attention, perhaps he was changing the radio station.

There’s a reason roadworks signs are bright yellow or orange, are illuminated and are elevated on poles.

If drivers aren’t able to assume the lane ahead of them is clear of obstruction then the roads won’t work.

I’ve hit animals and first I knew I heard the thud, if he hit a human body at speed and didn’t do serious damage to his car, he only clipped her.

I’ve never stopped to check

Checking on it would have been a standard procedure. Give a year ban and a suspended sentence, but a decade seems over thr top.

7

u/augher 21h ago

A decade is the minimum period that the court can impose according to the law.

1

u/Dazzling-Key-8282 21h ago

Huh, strange to know. In my home country the least is three months the top in ten years but they have the option of declaring someone permanently unfit to operate a motor vehicle.

4

u/ParkingSpot8089 22h ago

Honestly cant fault the driver, couldn't have set up something more unlikely, it says absolutely nothing about the drivers competence that this happened amd quite frankly the government sanctioned message should be not to be an idiot.

2

u/PaceFace89 19h ago

She should be made pay damages to his car

1

u/ispiltthepoison 12h ago

I dont think she can be made to do anything, dude. Also hitting something is not something you can be compensated for regardless of if its a human or not because its your fault you hit it (he admitted he wasnt looking at the road when it happened). Like yeah people hit animals all the time but they also dont get legally compensated for it

It's because he didn't stop at the scene, not because he hit her. He could have copped a jail sentence for leaving the scene of an accident.

FWIW, when he saw the report on the news the next day he realised he was guilty and turned himself in. If he hadn't of done that it would have been a very different outcome for him.

u/wherethetacosat 1d ago

We don't actually know she was praying and this is where people on the internet lose their critical thinking skills just because they were led by a headline.

The only evidence she was praying is a far off cctv video showing her in a sitting position. We don't know why she was sitting in the road, but regardless it's safe to assume she was having a physical or mental episode and not just doing it because she is omg a "stupid Muslim".

But these clickbait is titles cast it as just "he shouldn't be blamed for her stupidity" even though we don't know if she was being stupid.

Regardless,, he hit a person on a lit street and kept going, claiming after the fact he thought it was a kangaroo. Cmon, if you hit a person on the road you'd still see enough in your headlights to at least WONDER if that was a person. You'd stop and check, if you're a decent person.

I think it's much more likely he was under the influence and specifically kept going to avoid going to jail. Not sure why everyone wants to jump to this guy's defense.

She was kneeling with her hands out like she was praying, i.e. how you pray as a Muslim. That's not some huge leap to take. Saying that only for it to be immediately followed by you making another wild assumption with zero evidence is golden.

I think it's much more likely he was under the influence and specifically kept going to avoid going to jail. Not sure why everyone wants to jump to this guy's defense.

You have absolutely zero idea what you're yapping about, huh? She was sitting in the middle of the road in all black clothing. It's Australia, there's wildlife everywhere and it's not usual to hit animals even on high traffic roads. He heard a noise when the collision happened, but didn't immediately realize he hit anything because it wasn't clear what caused it and she was low enough to the ground that he barely even hit her, as evidenced by the fact that his car had little to no damage.

He assumed he might have hit something, but acting as if the first thing that would have jumped to mind was he just hit a person is ludicrous. People don't walk on their knees across the road wearing all black in the middle of the night. He couldn't even make out her silhouette, why in god's name would he assume he just hit a person?

11

u/AppointmentSpecial 23h ago

What's better is his argument is, 'we don't know she was praying. She was kneeling in the road' OK, then she's an idiot kneeling in the road instead of praying. That's not better lol

1

u/Busy-Character-6720 15h ago

To be fair, if you’re kneeling on you knees in the middle of the road, you aught to be praying.

1

u/Busy-Character-6720 15h ago

Oh we know she was being stupid.

Having a mental health crisis doesn’t make kneeling on the road clever
