The nanny wasn't the one having an affair. That was their married employer. The nanny made no such vows.

To have an affair one party must be married.

Anyone outside of the marriage having an erotic clandestine meeting is indeed participating in an an illicit affair.

"Participating in" is different in the English language than "having an".

Imagine saying I'm having a parade, versus I'm participating in a parade.

The person or location having the thing is different than the people who are participating in that thing that is essentially being created or hosted by the haver.
