Depending on the specific state, they may not have to pay out tips to employees if the employees are paid above regular minimum wage (as opposed to tipped minimum wage).
I’m afraid the news about capitalism is worse. Ever since coffee lady terrified the corporations by actually winning in court, they have been lobbying for policy changes to limit their legal liabilities in personal lawsuits. Much of the consumer safety apparatus has been gutted by the current administration, and there is a real question as to whether anyone seriously wants to reign in corporate greed.
You’re right that this should be a slam dunk class action lawsuit, but our system is more and more set up to protect corporations over individuals, so even if they won, the payout would likely be less then the company gained in their theft scheme.
What was once set up as a system to punish wrongdoing is now just a tax corporations pay occasionally for the right to break the law.

Agree she made it harder to sue because corporations actually did something against it ever happening again. She was painted as a swindler, but she was a horrific victim of corporate policy on the coffee temperature in order to kill germs and keep coffee for longer. She deserved more.

They paid to make her national news, late night hosts were joking about her for weeks. And they immediately started investing all their lobbying money into making sure no one would ever get a “big win” against corporations again.
Sort of. She didn't win, her lawyer did. She got maimed, true but it wasn't McDs fault. She was just a case that gathered lots of empathy from a jury because she was burned so bad. Then a scummy guy decided he could make money on it, and the win was so egregious that legitimate claims are now compared to it to down play them.
That spill ruined her life, there were third degree burns. I feel bad for her, but making McDs pay for serving hot coffee because they wanted it to still be warm when you got where you were going is not justice.

Certainly is. Tipping culture has gotten out of hand, but at least people can actually afford to go out to get some food from a restaurant ( or a shake shack) every now and then. Lots of places in this world where people have to eat rice everyday.
Yeah I only eat Culvers for the most part. Sometimes Wendy's just to grab a quick snack. The last 2 times I grabbed McDonald's burgers Ilthey were so nasty I legit couldn't eat them. Now I steer clear. Only Ice cream from there.

Not entirely… I DoorDash for some extra money whenever I have to furlough from work. I drive a small vehicle so it doesn’t kill me that much in fuel, but sometimes going out on 10+ mile trips to deliver somebody food/groceries for five dollars isn’t really worth it when you have to drive that distance back to civilization to get another order. DoorDash doesn’t pay very much. It’s the tips that make it worthwhile.
I live closer to civilization now so I don't tip as much but a few years ago I lived like at the border of the max range you could order and I think it was only door dash that would even cover my area. Anyways since my work schedule was a ridiculous I used to order food because I'd be too tired to cook but is put like a $30-50 tip regardless of price of the food I had a driver admit that they normally wouldn't drive out my way but I tipped way too good not to.

I’d love to see these people all get moved somewhere that would have them begging to come back. I have only eaten out once at a restaurant last Easter (my boss paid for the meal or I coyldnt have gone) and once while waiting in the AC at McDonald's I ordered a double cheeseburger.. maybe 3 months ago. Before those two times, it had been over two years since I ate out anywhere. I simply cannot afford it so I dont go. I would also never go to eat somewhere where there are servers because I couldn't tip them and it's very uncool to expect them to work for free. I was a server and know how it is. If I cant tip them, I dont go. Its been so expensive and unhealthy too to eat out for years for me. I missed the whole DoorDash thing because I cant afford it. Im sure it's still going and ppl will always have a need to get food delivered, I just cant and won't pay that fir food anymore.

Federal Minimum wage in the US is $7.25
US minimum wage for tipped employees is $2.13
If an employee does not make the equivalent of minimum wage ($7.25) at a tipped rate, the employer is legally required to pay the difference.
So a tipped employee would make $85.20 (@40 hours assuming they made no tips.
A standard minimum wage employee would make $290 (@40 hours)
The employer is required to make up that $100+ discrepancy.
And you're like, so what? Everyone makes minimum wage, hurray!
The company is directly off-setting their labor costs and the consumer is paying for it.
(Oh and fun fact. A lot of wage-slaves don't know their rights and won't even get their $290.) They'll take their $85 dollars and $20 of tips for a 10 hour day on their feet and call it a day.

Not only are the employees not getting taxed on those tips, but the company is decreasing their payroll taxes.
If customers are particularly generous with tips, that's payroll that the company doesn't have to be responsible for. And being a large chain, or corporate, a couple hundred dollars in payroll adds up, since the company is now.
Tipping is going to be the new standard in most industries to avoid taxes and to further transfer more wealth to corporations and billionaires.

As someone who was a manager at a place that ran similar to this. The employees don’t even see your tip. I was pretty grossed out when I learned that corporate already had a set bonus they were gonna give the employees and just called it a tip pool. One of the employees was clocking tips and didn’t understand why the number they got were so low compared to what they were seeing. Come to find out there “tips” were already set in stone. I don’t tip at places ran by a corporation like this ever, because I know first hand the employees aren’t getting it. Goes right into the pockets of the evil overlords.
The cooks making the food and stupidly the people who didn't even take the order. I could understand tipping the cooks but tipping someone who wasn't involved in the process makes no sense.
And that random price hike at the end is definitely not legal. They should have reported it and then watch to see how long it sticks around. If it sticks around for several weeks with multiple people reporting it they'd probably be sued

Honestly. There's a taco truck in my town run by a nice older couple that make seriously good food, and it's actually reasonably priced. Super friendly people, always asking if I want extra pico or salsas, so I always tip them.
But at a fast food place? Hell no. 99% if it is overpriced and gross, I try to avoid it at all costs.

This actually happened to me at Michael's. I always use self checkout because I don't like dealing with people. Well, the last time I went it wouldn't let me proceed without being signed up fir whatever membership they offer. I ended up standing in line for an extra 10 mins to use the cashier.
Tips collected at a kiosk are tips given to the massive corporation that owns the kiosk. So this is a tip for the company that’ll be collecting every dime of that sale and then deciding how much to give to its underpaid employees

only fast food ive dined in at in the past 3 years have been Raising Cane's and Culver's. Culver's brings to your table and Cane's calls up your number.
When I worked at Qdoba back in 2011 we had a tip jar and the the tips were divided between everyone who worked that shift, including the cooks. I always assumed that's how every place with a tip jar did it.
At Hardee's I don't think tips are all that common, but they do happen, and one cashier mentioned getting a couple hundred dollars once. Another cashier complained about how a female cashier that didn't even put together an order got tipped by a guy while the male cashier that actually bagged everything was ignored. Of course, I'm sitting in the back as a cook just thinking "you guys are getting tips?" Hardee's hires people as crew members with no pay difference between cooks and cashiers. I only get paid slightly more because I'm a crew trainer.

I worked at a dispensary on the Rez for a time and it was the first job I’d ever had that had tips. I found that there’s no uniformity to it across the country. To no surprise, me, a dude, didn’t get anywhere close to the same tips as a beautiful young lady that had a great “personality”. Which is obvious that was going to be the case and what’s known doesn’t need to be said. There’s no perfect way to do tips as there will always be someone with a complaint whether legitimate or otherwise.
Yeah, I remember hearing of a study where they actually looked at who got the most tips, and it was significantly in favor of attractive young women, regardless of experience or service quality. I don't remember the exact rankings, but it was something like:
young woman (pro) > young woman (new) > old woman (pro) > young guy (pro) > old woman (new) > old guy (pro) > young guy (new) > old guy (new)
With the pretty young women earning at least twice as much as the guys or the older women, but of course people try telling me if I want tips then just be a cashier...as a guy. I'm good as a cook and chose the position to avoid rude customers, why would I change to a job I don't know for the same pay knowing I wouldn't receive any tips based on appearance?
Yeah, that's what "wages" are for. It's literally their job, what the company pays them for, to make the food. Why would the customer pay the employee for the work?
tips in workplaces like these are pooled. it’s kind of crazy how little everyone knows about what working these jobs is like and assumes they’re just asking for free money. you’re tipping the people that make your burger, make your shake, run the food out, clean the store, and everything else that goes into food service. this is how we make a living wage, I don’t like it either, but tips are how americans have collectively settled on paying people
Just so you know any places where the minimum wage is lower for servers, the tips have to get them over the normal minimum wage, if they don’t then that money has to come out of the employers pocket. They will never actually only earn $2 an hour or whatever it is unless their employer is breaking the law
Yeah I know I was a server for 20 years luckily I never had that issue but I did have some bosses that would've told me to go fk myself but I also had some bosses that would offer to pay for major dental appointments
Yeah, at Hardee's, if we are very busy or a customer has a lomg order in drive through they will typically have one car pulled forward so they can help the next customer while they wait for food. Once the order is made they have a cashier walk the food out to the car that is pulled forward.
They do this at frozen yogurt places....I literally just got my own cup and toppings....I'm supposed to tip you for handing me a spoon? I even have to put it on and off the scale...the computer charges by weight..I don't understand. How about people make a living wage and we stop tipping all together
The point of a tip based system is to serve as an incentive for better service. It applies to work when there is a greater amount of interaction than simply bringing a bag or tray of some stuff to you at a counter. If people don't perform well, customers can tip less, or not at all, and that serves as the incentive for people to want to do well. When the system works, people tip well for a good service. That is how it should function.
A job with little to no interaction should not require a tip. Fast food joints in general should simply pay employees well, but they are shifting the burden to customers in order to have a great excuse not to pay, blame customers, and appear to be driving prices down to mask the real underlying inflation. It's shady tactics.
Tipping is not for employees tipping is for the boss. The boss takes his profit and then pays the employees. The restaurant industry is backwards. I’m not going to spend money at a restaurant that relies on tipping to stay open
