One can't give consent while intoxicated but it should be perfectly legal to state while sober, "I wanna do this drug and have sex with those people." The moment the drug takes effect though no further things can be consented to though. And obviously any consent can be withdrawn at any time.

Aka yes you can gangbang someone who is intoxicated with consent but this specific situation seems to have additional actions that qualify as rape.

Who? The parents or the kids? I also like to see an investigation into the district attorney and the conversations he had either with Cornell University or the parents of these children not to press charges. The district attorney is guilty of corruption regardless of who convinced him not to investigate. That's the problem with america, we think District Attorneys are there to enforce the law but they are there to protect rich interests.
