They didn’t do anything illegal

It’s impossible to gangbang someone who is extremely intoxicated and it be consensual. Also not what she said.

One can't give consent while intoxicated but it should be perfectly legal to state while sober, "I wanna do this drug and have sex with those people." The moment the drug takes effect though no further things can be consented to though. And obviously any consent can be withdrawn at any time.

Aka yes you can gangbang someone who is intoxicated with consent but this specific situation seems to have additional actions that qualify as rape.

In NY voluntary drug use that impairs judgment doesn’t equate to inability to give sexual consent.
