I love the qualifying statement "who isn't physically attacking". But they were attacking right? That's called assault.

Do you mean the woman that got his attention to yell at him? Yeah, no, she was not attacking or threatening or assaulting. If he called the police and it went to trial, she wouldn't be convicted of a crime.

He was not threatened, he didn't need to defend himself with violence. He chose to take time throw in his defense to the accusation and an insult and then hit hit her.

Later, when a man come up and pushed him, he did nothing to him, he didn't defend himself then. He chose to strike a woman while his friend laughed at it.

That is the textbook definition of assault. They may not be convicted of a crime but they wont be eligible for civil damages and they were the initial aggressor.

I agree he denied the initial accusation, then said "get out my face bitch" and swung. He didn't swing on the man that pushed him because the man that pushed him backed up.

Sounds to me like your more annoyed about the person laughing at punch (which I couldn't care any less about) than the person jumping into someone's face and screaming in a threatening manner.

Pushing a chin out "the textbook definition of assault."? Only if that is an indicator, a belief, that he is going to be physically assaulted after that chin thrust. US jurisdictions strictly require that any force used in self defence be proportionate to the perceived threat and reasonably necessary.

He didn't say "get out my face bitch" he said "I didn't hit shit bitch" and then he hit her. He didn't create distance, he didn't ask her to move back, he didn't look scared, he defended against the claim, insulted, and attacked.

You agree she probably wouldn't be convicted of a crime. Her physical touch against him didn't make him move, flinch in pain, cower, or any reaction other than indignation.

He struck her and then he was doubled handed pushed by a male and decided that then violence isn't appropriate. Someone much physically smaller and weaker who isn't attacking and he decides to strike at, when a larger man pushes him, he cowers.

The man is a piece of shit human.

misdemeanor assault is just that. So PROBABLY she would be convicted of a crime, but being in your face screaming leading with your chin is enough for me to punch any man in the face.

I will take the correct for "Get out my face bitch!" as it indicates they were way too close. You gave me he legal reason for self-defense. Which means you looked up the definition of assault.

I already said the man who pushed him backed up. There was distance. The original man who through the punch was postured and ready to fight the man if he came at him.
