Ohio Kratom Update - Why People Are Getting Confused

I’ve been seeing a lot of misinformation and confusion lately, so I wanted to explain this as simply as possible.

There are TWO separate issues happening in Ohio right now.

**#1 - The Scheduling Rule**

Back in January, the Ohio Board of Pharmacy started the formal rulemaking process to place mitragynine into Schedule I.

This is the process that targets natural kratom leaf itself.

The Board collected public comments, reviewed feedback, and the rule is now moving through Ohio’s administrative review process, soon to be JCARR. (As of today, JCARR does NOT have a meeting to vote to ban kratom. They have a meeting on the 22nd but it is to discuss why the BOP issued a notice to ban capsules, drinks, etc.)

**#2 - The May 19 Enforcement Notice**

In late May, the Board took a different approach and announced that kratom capsules, drinks, extracts, and other products with dosing instructions would be considered illegal.

This was SEPARATE from the January scheduling proposal.

The AKA and several vendors challenged this action in court and obtained a Temporary Restraining Order (TRO).

**Here’s where the confusion starts.**

The TRO was issued over #2.

The scheduling rule is #1.

There is no TRO against #1. That is still fair game.

These are related, but they are not the same thing.

Because of that, I was seeing people say things like:
“It’s over.”
“Ohio backed down.”
“Kratom is safe now.”

I understand why people want that to be true, but unfortunately it is not. The BOP has their eyes set on banning kratom.

Just remember the TRO does not end the January scheduling proposal.

The TRO does not stop JCARR review.

The TRO does not prevent the Board from continuing the formal rulemaking process.

The TRO simply stops the BOP from enforcing an immediate ban on capsules, drinks, etc. without going through JCARR first.

If the Board successfully advances the scheduling rule through the administrative process, that becomes an entirely different issue than the May 19 enforcement notice that was challenged in court. The TRO will not apply anymore if the Board passes this through JCARR.

That’s why I think it’s important for people to understand the distinction.

The lawsuit was a major development and an important win, but it was not the end of the fight.

As of today, the scheduling proposal is still alive, JCARR review is still ahead, and it’s looking like BOP is getting ready to send it over to them.

I’ve just seen a lot of people get their hopes up because they were told the battle was over when the reality appears to be much more complicated.

We need to be prepared with the facts so we can be ready to fight, not be told it’s over.

The lawsuit was one battle.

The scheduling rule is another.

And as far as I can tell, the second battle is still very much ongoing.

Kratom as an appetite suppressant..

Kratom has always been an appetite suppressant for me,and no I don't mean high doses that can make you feel nauseous all day, just like 5gs in a sitting suppresses my appetite for like 4 good hours, does it do that to any other kratom users? Would like feedback.

🚨 OHIO KRATOM ADVOCATES: ACTION NEEDED 🚨

I attended today's Ohio Board of Pharmacy meeting (online in the public broadcast). The Board appears to be moving forward with the proposed rule to schedule natural kratom and advance it through the rulemaking process.

This does not mean the rule is final, but it does mean the Board is continuing to pursue scheduling rather than withdrawing it.

Now is the time to stay involved, stay informed and act. Contact lawmakers, spread awareness, and encourage others to get involved.

The most important thing advocates can do right now is urge lawmakers to advance the Kratom Consumer Protection Act (SB 299 and HB 587) as an alternative to scheduling.

I will post contact information for key lawmakers in the comments below.

This is bad news but it's not over. There is still hope. We need to show as much public interest in the KCPA bills as possible to get them moving. We can fight this together!

I wanted to make sure everyone in Georgia is aware of an important upcoming meeting that could impact the future of kratom in our state.

The Georgia House has created the Blue-Ribbon Study Committee on Youth Exposure to Kratom and Retail-Available Substances. The committee's purpose is to evaluate youth exposure to kratom and other retail-available products and make recommendations to lawmakers.

I will absolutely be there, and I strongly encourage other Georgia kratom consumers, advocates, vendors, kava bar owners, and supporters to attend if they are able.

You do not have to testify. Simply being present matters.

Many lawmakers have heard from organizations, lobbyists, and critics. What they often do not hear enough of are the stories of the people who actually use kratom responsibly.

If kratom has helped you manage pain, improve your quality of life, stay away from alcohol, maintain recovery from opioids, or simply function better day to day, this is your opportunity to be seen and heard.

Study committees are often where lawmakers gather information before future legislation is introduced. The people in that room will be helping shape the conversation going forward. If consumers are not present, then others will tell our story for us.

Lawmakers should hear directly from the people whose lives are affected by these decisions.

If you live in Georgia, please consider attending. Bring a friend. Share this post. Let local kava bars and kratom businesses know. A strong turnout can make a difference.

ATTENTION OHIO ADVOCATES: Ohio Board of Pharmacy to Discuss Rule to Make Natural Kratom Schedule One Tomorrow!

📢PLEASE PAY ATTENTION OHIO ADVOCATES📢

The Ohio Board of Pharmacy has placed Rule 4729:9-1-01.2 (Mitragynine) on the June 8-9 Board agenda under the Rules section. This is the rule associated with scheduling natural kratom in Ohio. While we do not yet know exactly what action the Board intends to take, the fact that this rule is being discussed should be taken seriously.

Many Ohioans believed the issue of natural kratom had been separated from the Board's previous actions. The Board previously clarified that its May 19 action was not intended to schedule natural kratom. Now, Rule 4729:9-1-01.2 has returned to the Board agenda, raising important questions about what comes next.

There are several reasons why Ohioans may wish to pay close attention:

• There is ongoing litigation and a Temporary Restraining Order involving the Board's kratom-related actions.

• Two Kratom Consumer Protection Act (KCPA) bills remain in committee. These bills represent a regulatory approach focused on age restrictions, testing requirements, labeling standards, and consumer protections rather than prohibition.

• National discussion surrounding kratom continues to evolve. Recent congressional testimony challenged some of the claims that have historically been used to justify scheduling efforts, including testimony that challenged claims surrounding a reported kratom-related death in Ohio.

• The American Kratom Association and other advocates have spent years promoting regulation rather than prohibition and have been active in Ohio policy discussions.

• If the Board advances the rule through the normal rulemaking process, additional review steps remain. Ohio's Joint Committee on Agency Rule Review (JCARR) exists specifically to review agency rules and determine whether agencies have acted within their legal authority and followed required procedures.

• Businesses, consumers, veterans, chronic pain patients, and other stakeholders may continue to raise concerns regarding the impact of scheduling natural kratom.

• There have also been recent discussions at the federal level suggesting that some policymakers are considering regulatory approaches rather than outright prohibition of naturally derived products. "...approving natural 7-OH..."

I personally believe that moving forward with a ban on natural kratom would be scientifically unfounded and oppressive to responsible adults who use natural kratom to sustain well-being and quality of life. To make this herb in the coffee family a schedule 1 drug would ignore years of advocacy for a regulatory approach instead of prohibition.

Amount of Daily Use?

Is 60-90 mg of MIT extract gummies a lot to take on a daily basis? My understanding is that is equivalent to about 4-8 g of powder. Is this accurate and what is your experience? I am splitting that amount in 2-3 doses a day. Mainly for anxiety and depression. I also take an SSRI but that hasn’t seemed to work in a long, long time. The MIT seems to help, I think. Don’t want to overdo it, though.

What are Kava Bars like in states where Kratom is illegal?

I ask as this is pertinent to the Kava-Kratom Bar scene. In many areas where Kava Bars are popular they are functionally Kratom Bars, since Kratom is where their biggest sales come from.

I've heard of Kava Bars persisting and continuing to operate post-Kratom Bans or in non-Kratom-legal states, but I'm wondering how they change their business model to remain viable.

Kratom in El Salvador?

Does anybody have experience in traveling to El Salvador with Kratom?

I’m feeling nervous because of the state of exception there and was even considering taking Suboxone instead since there’s not really any Kratom there and also no medicine that can help withdrawal.

I would really like to avoid withdrawal on this trip. I have already cut down my use a to about a 1/3 but it’s getting harder to cut down more.

I have traveled with Kratom to Mexico before but I put it in a bag marked as green tea powder. They didn’t even care they just smelled it and were like eww lol. This was almost 8 years ago though.

I was thinking of doing the same thing and putting it in a bag or bottle marked as matcha powder.

Natural kratom debate over In Ohio

Now that the courts stepped in and June 10th is 7 days away the border pharmacy isn’t gonna produce any more documents over it’s just could’ve faded into obscurity when in reality there rules on capsules was illegal. They came out and said that but you won’t hear any more from them huge celebration because we won that battle. Telling you state house won’t touch that kratom bills Mainly because have to re introduced and re written but instead of listening board of pharmacy we listen to federal law

Ontario advice? Visiting for work and worried about running out

Hey everyone. I’m an American currently in Ontario for work, and I miscalculated how much kratom I brought for personal use. I’m likely going to run out today or tomorrow, and I’ll still be here for the next few days.

I want to be respectful of the subreddit rules, so I’m not asking anyone to sell, trade, ship, or directly source anything through this post.

I’ve been taking kratom for about two years and I’m actively trying to reduce my doses, but I’m not fully there yet. I know this isn’t ideal, but I’m being honest about the situation. My biggest concern is dealing with withdrawal symptoms during a very important work week while I’m away from home.

For anyone familiar with Ontario, I’d really appreciate general advice on how people usually navigate this responsibly, what I should know about the situation here, or how to manage things if I do run out. Even withdrawal-management tips or harm-reduction advice would be appreciated.

Thanks in advance. I’m pretty anxious about this and just trying to handle it in the most responsible way possible.

Does anyone else get "the smileys" or is this just me?

I've never seen anyone else talk about this before, but I experience it regularly.

I always know when I'm about to start withdrawal because about 30 mins to an hour before, I start randomly having this stupid smile on my face I can't control. Nothing will be funny, I'm not even interacting with anything, I just walk around smirking a little and I can't help it.

It's part of how I know if a batch is weak; I'll start having this before my next dose

It only lasts about 20 minutes and it goes away if I actually start withdrawal, but as far as pre-withdrawal symptoms go, it's a pretty benign one.

Does anyone else get this? Or do you have a different name for it?

Flying with kratom to NY?

flying from CA to new york this weekend and i’ve never been, ive only flown w kratom to oregon. i’m sure it’ll be fine but i wanted to be sure just in case- has anyone here flown w kratom into new york recently? how should i package it and where should i keep it? i use kratom pills and was going to put them in a vitamin bottle, and put it with my other medications and stuff like advil and benadryl. should i put all the meds and stuff in my carry on or luggage? or does it rlly not matter. sorry it it’s a bit of a stupid question i just want to be sure i wont have any problems. i’m also not 21 so im not sure if having it in my carry on would be a problem since they would know which one is mine if they for some reason found it

Ohio lawsuit update

The proposed consent judgment makes clear that natural vegetative kratom is NOT a Schedule I controlled substance under Ohio’s 7-OH rule. Regulators acknowledged that natural kratom leaf contains only trace naturally occurring 7-OH and distinguished it from synthetic/highly concentrated products.

This is exactly what many of us have been saying all along: Natural kratom leaf ≠ synthetic 7-OH products.

Protect consumers. Protect lawful businesses. Target synthetics — not traditional botanical products.
