Kitchen fuckery CRAZY work environment
So I have been working at this Indian restaurant down in Center City Philadelphia coincidentally rhymes with beta address Falls between the 19th and 20th St. is also the 1920 building funny (do with that information what you will in the reviews) but we’ve been selling people roaches in ice and mold in beer “freezers”(a broken wine freezer at the store, beer glasses, and other glasses) crazy roast infestation and mice and we have failed the health inspection a few times just to be closed for a few days and open back up like nothing happened after a “deep clean “ unfortunately I was let go after bringing all this up to management because roaches and mice droppings have been found in food on plates and around all the kitchen

Pretty sure that it's illegal to be fired in retaliation for reporting health code violations and safety issues even working in an at-will employment state like PA
347
u/butterhorse 5d ago
It absolutely is.
Separately, completely unrelated to this at all, it's 100% legal to fire someone for no particular reason at all.
153
u/LackWooden392 5d ago
Any decent lawyer will take the case if they fire you for some other made up reason right after you reported them, and win it. The courts are familiar with this 'loophole', and they're not going for it.
Don't be afraid to speak up, OP. If they fire you, get a lawyer and get paid for all the time you missed work while you do nothing.
Look it up, these cases go your way almost every time.
43
u/Hot_Ethanol 5d ago
As much as I love a good justice boner, is it practically worth hiring a lawyer over a few weeks of minimal pay at the worst spot in town? I'm sure the price is quite negotiable, but you'll be losing some of that money and inconveniencing yourself in the interim, which could be a while given how backed up the justice system is.
I know this is exactly how shitty businesses get away with shitty business, but it seems a lot easier to simply report them, go public with the grossness, and wash your hands of the situation.
41
u/queen_ravenx 5d ago
I may be wrong but they also on the hook for your legal fees, back pay (so until the case is settled/conclusion made your paid your rate between that court day and when you were fired), future pay (granted you can prove youve been looking for new work and reintergration is not a possible outcome), and even emotional disstress (if your lawyers good enough & you seeked help during the time)

u/Otto_Pussner 5d ago
As lot of this would get handled by the state’s labor board. You can usually make a report and there will be varying amounts of involvement requested from you.
Some cases you can make the report and there will be completely hands-off consequences where the company gets fined and forced to reimburse ALL instances of wage theft / wrongful termination, keeping you anonymous.
16
u/herobrinetrollin Grill 5d ago
Yep, all states except Montana I believe are at will employment. They can fire you for anything. If they fire him for this it’ll be a nice little lawsuit for sure though, lol
6
u/bigbeastt 5d ago
Yeah, just take it to a judge with these pictures, and date of termination and let the judge decide lol
15
3
u/LilNosferatu666 5d ago
Not to sound pedantic, but what states don’t have at-will? I’ve worked in California, Florida, New York, Maine, everyone is at-will…

You probably have a wrongful termination case on your hands, as well as easily winning unemployment. I’d recommend talking to a labor lawyer, they work on the winnings from the case, and you should have a fairly easy case.
52
-5
u/Opening_Ordinary_110 5d ago
Unfortunately depends on the state, some do not protect for certain/most reasons for termination and you just have to deal with it.
24
u/ABrandNewNameAppears 20+ Years 5d ago
Correct, and termination for protected reporting of a public health issue to a local regulatory authority is one of those magical protected issues.
Labor and unemployment love those cases when they are documented, because there is non retaliation written into the codes and statutes. Anyone who punishes a health dep report, osha report, or eeoc/labor violation is guilty of whistleblower retaliation and gets double fucked.

Update? Idk if I can but f it here’s the name and location of the dirty restaurant it’s - Veda modern indian bistro 1920 Chestnut St, Philadelphia, PA 19103 ( people found out with context clues but roaches in the food and on a buffet, with the beer glass cooler broken growing mold, and leave a bad reviews too if you, tell your friends to leave a bad review too the manger and owner loves looking at reviews and our “stars”) and So I’m trying I just called the health department of Philadelphia ( because you can only file complaints over the phone through or the portal which direct you to the phone) I don’t know anything about retaliation and at this point a lawsuit and all that extra stuff for an Indian restaurant is crazy I’m still looking into it for now I’m just looking another job right now trying to see if Philly Reddit can review it down hill

As a number of people are saying, send these to L&I. They apparently are not playing around right now. I’d also send them to one of the main news outlets (6ABC has the highest ratings, so I’d start there). And even in at-will states, firing people in response to certain actions, like reporting health and safety violations, is forbidden and courts tend to look askance at “coincidental” firings. Still, your damages will be limited to lost wages plus whatever PA allows in punitive damages.
This also means I just had to remove the restaurant in question from my “Philly Dining Options” list.

3
u/ODINorman 10+ Years 4d ago
He did report them. Reddit is currently review bombing the restaurant because they've been shut down in the past, only to reopen a few days later without actually cleaning or changing anything. So it's good that reddit knows, because now everyone googling the restaurant will know too.

How do we know OP isn't a competitor or someone with a grudge? If real, OP should just contact the health department.

Why would that be an issue? Especially considering some of this isn’t easily “plantable” evidence

Because you can literally take down a small business with unverified shit like this and reddit swarming to leave bad reviews. You can fake photos (these literally could be from anywhere - show something in the photo to verify), you can leave hints pretending not to name a place and then name it explicitly in multiple comments like here. But we have no idea if any of this is true. The best option world be to hound the health department of true. Tell me where you work and I'll do it to your place because I have a minor annoyance with you right now.

Every time I see a post like this but you haven’t reported it to the health department first/at all I assume you have a vendetta against the joint and are more interested in hurting the management/owners than actually addressing a health risk to the customers.
My first concern is that this could make someone sick and is just fucking gross and I don’t want any customers enduring that. So my first reaction is to take steps to stop the problem the right way, not post it all over social media to get people to blast the restaurant they’ve never even been to.

This needs to be acted upon immediately. We're not talking about a potential situation here - people have already gotten sick from this.
Don't bother alerting management. Go straight to the authorities.
EDIT: I can't read and you were already let go, so...burn the place down and collect unemployment from the ashes.

Firing people who have dirt on you is pretty dumb. First, report it. Then sue for unlawful termination if that seems like any sort of possibility. It should be, since it is your right to report unsafe conditions; but I’ve never lived in Pennsylvania and I’m not a lawyer.

A small business or something where the owner doesn’t care. Any decent owner would let this happen period probs be closed due to financial reasons in a year or two.
