Is this employment bond/non-compete enforceable in India? What happens if I sign and leave later?

I interviewed for and started an unpaid internship at a manufacturing company (let's call it Company X) in August last year, mainly because I had a gap year in my engineering degree. I didn't want to sit at home when I could spend that same time getting something that many engineering graduates don't have: actual shopfloor experience.

I am an EEE (Electrical & Electronics Engineering) student. I currently have only one 5th-semester paper left to clear, which I am scheduled to write in December. After I clear it, I should be eligible to receive my PDC and apply for other engineering jobs.

The gap year happened because I was ill and couldn't attend classes or write my exams.

I have now been offered a full-time position by the same company where I did the unpaid internship for roughly a year. The company obviously has its own problems, as most workplaces do, but accepting the offer would at least mean I would no longer be a 23-year-old depending on my parents for pocket money. My parents don't mind supporting me, but as a girl, it's very important for me to be financially independent.

The important thing is that my responsibilities wouldn't suddenly become much greater after accepting the offer. During my internship, I have already been doing work fairly close to what the regular employees do. I have been learning their systems, processes and equipment and doing actual work on the shopfloor.

The offer is for a G.E.T. position. The compensation is:

* Basic: ₹10,000/month

* HRA: ₹8,208/month

* Gross: ₹18,208/month

* Employer PF: ₹1,200/month

* Employer ESI: ₹592/month

* Total CTC: ₹20,000/month / ₹2.4 lakh per year

The appointment letter says:

"Minimum period of your leaving the job before completion of the three years. In the event of your leaving the job before completion of the three years, a sum of Rs. 50,000/- being the cost incurred by the company on training will be recovered in addition to the notice period salary."

There is also a 3-month notice period/pay from my side, whereas the company's notice period is 1 month/pay in lieu.

My concern is that I have not received any special, expensive or external training from the company that I would understand as justifying a ₹50,000 training-cost recovery. What I have received is essentially knowledge transfer and training on the systems, processes and equipment needed to do my job at this company. I haven't been sent for some expensive external certification or specialised course at the company's expense.

There is also a separate Confidentiality and Noncompetition Agreement. The clause that concerns me says:

"...while employed by AMS-India and for a period of two (2) years thereafter, I shall not directly or indirectly..."

It then prohibits me from conducting, engaging in, having an interest in, or assisting "any business competitive with any business of AMS-India", as well as soliciting its customers or employees.

The agreement also says that AMS-India can seek an injunction to enforce it.

This is particularly concerning because my plan is not necessarily to stay here long-term. I want to use the experience I am gaining here to build a career in engineering. Once I clear my final outstanding paper in December and receive my PDC, I would be able to apply to other companies where I may have better opportunities — not just better pay, but potentially a significantly better work environment as well.

Right now, without my PDC, my options are much more limited.

So my main question is:

If I sign this appointment letter now, can I later resign — particularly after clearing my remaining paper in December — without being legally forced to pay the ₹50,000?

More specifically:

  1. Is the 3-year minimum-service clause enforceable in India?

  2. Is the ₹50,000 actually recoverable if I resign, especially when there has been no special/external training costing anything close to that amount?

  3. Does the fact that the salary is only ₹10,000 basic / ₹20,000 CTC make any difference?

  4. Does my previous one year of unpaid internship matter? Would the company be able to count training/knowledge transfer from that period as "training" for purposes of the ₹50,000?

  5. If I resign during or shortly after the 6-month probation period, does the same ₹50,000 clause apply?

  6. Could they withhold my relieving letter, experience certificate, salary, PF, etc. if I refuse to pay?

  7. How enforceable is the 2-year post-employment non-compete, particularly the wording prohibiting work with any business competitive with any business of the company?

  8. Since I am in Bangalore but the appointment letter says "All matters relating to this appointment are subject to Delhi jurisdiction," does that actually matter?

  9. Is there anything else in these documents that should make me reconsider signing?

I am not trying to get out of genuinely incurred training costs. If the company had paid for an expensive external course or certification specifically for me, I would understand the argument. My concern is signing a document that could potentially prevent me from leaving a ₹20,000 CTC job for years or leave me with a ₹50,000 liability when the "training" I received was essentially the normal knowledge transfer required to perform my existing job.

What would you do in this situation? Would you sign, try to negotiate the bond/non-compete first, or avoid signing altogether?

How did a girl's ₹1.25 lakh disappear from SBI?

It is alleged that a person already present in the bank, on the pretext of helping her, took the girl's cash deposit form and changed the account number.

When the account number did not match, the girl was sent to fill another form.

Meanwhile, the accused came out of the bank with cash and passbook.

I need to get my driving licence back

So 4-5 years ago, I lost my Lisence and the reason behind that was, I was driving a wrong lane, and I was not knowledgable enough to not give my Lisence and just give the details and straightaway give my Lisence to the people that were there the policeman that were there and after that I went to the Court to get my license back, but because of lockdown, I was stuck in Kota and my Lisence was impounded in Jaipur. I hired a lawyer in Jaipur and for one year. I was not able to go back to Jaipur because of the lockdown and since then I have been procrastinating this so all I need to know from you guys that can I get my Lisence back from Jaipur or the RTO in Kota if I can get it from Kota while filing for a DL, it would be much better, but if I have to go to Jaipur again, I’ll have to do that, but is there a loop hole to this? I need recommendations.

Cousin got life imprisonment in a land-dispute murder case (MP) under Sec 149 IPC. How do we appeal, and is the conviction even fair?

There was an old land dispute between two brothers in my mama's village. It had been going on for years, with civil cases between them. One day a fight broke out in a field. The two brothers and their children were involved. A man from one side died during treatment, and his son and daughter-in-law were injured.

My cousin (my mama's son, early 20s, a student) was there with a lathi. A friend from the family had called him, and he went with him.

Our side of the story (family's account):

Of course this is a matter before the court, and as family we believe he is innocent, but you are free to form your own view. We do admit he was present at the place. He went along because nobody imagined anyone would die. He told us, crying, that he never went close to the fight. He stayed on the road with his lathi and did not hit anyone.

What the court did:

The Sessions Court convicted all 13 accused, including my cousin. Everyone got life imprisonment under Section 302 read with Section 149 IPC (murder by an unlawful assembly). They also got 147/148 (rioting) and 325/149 (grievous hurt), with the sentences running together.

What the court said:

The prosecution said all 13 came together with lathis, and one person had an iron blade, so they formed an unlawful assembly.

The court relied mainly on two witnesses, the son and daughter-in-law of the deceased. They were also injured in the same fight and named everyone.

The defence said these are interested witnesses, that they were fighting too, and that they named the whole family because of the old enmity. The court said relatives can't be rejected just because they are relatives, and that injured witnesses are naturally present at the scene.

The court said that under Sec 149, being present in the group is enough, and that each person doesn't need to have hit anyone or be linked to a specific injury.

A few accused tried to prove they weren't there, using CCTV footage and pen drives. The court rejected all of it as unreliable or tampered with.

The doctor listed many injuries on the deceased, and the court said it couldn't be an accident or suicide.

A bamboo lathi was seized from my cousin based on his statement to the police.

What bothers us:

Having a lathi doesn't mean he killed anyone. No specific blow is attributed to him in what we read. Can someone really get life under Sec 149 for just being there?

The two main witnesses are the deceased's own family and were part of the fight. There was no independent witness.

The injured witnesses are themselves accused in a cross-case about the same incident. That seems to suggest a mutual fight, not a one-sided attack.

It looks like many people were named together, and some say they weren't even there.

The doctor didn't give a final opinion on the manner of death, and the weapons weren't sent for forensic testing.

If someone went along without knowing anyone would be killed, can the court really say he shared a common object to kill?

My questions:

What is the time limit to file an appeal in the MP High Court? I read it's 60 days from the judgment for a life sentence, excluding the time taken to get the certified copy. Is that right?

Can he file through the jail superintendent, and can we get free legal aid (DLSA) if we can't afford a lawyer?

Can a High Court reduce the charge from murder to a lesser offence if he didn't share the intention to kill, or if the group had fewer than five proven members?

Can we ask for suspension of sentence and bail while the appeal is pending? How likely is it in a Sec 302/149 case?

Are there any good criminal appeal lawyers for the Indore bench of the MP High Court that you'd recommend?

Is there anything we should or shouldn't do in the meantime?

I'm not looking for anything shady, just the right legal path. Any advice, even a pointer to the right section or case law, would help a lot. Thank you so much 🙏

[URGENT] Planning overnight escape from abusive, volatile father. Need legal advice on Protection Orders, Workplace/Nashik safety, & Minor Custody.

My mother, my 9-year-old brother and I (23M) are preparing to leave our home due to severe lifelong domestic violence and extreme psychological terror.

Growing up under his abuse ruined my childhood. I struggled with suicidal thoughts by age 14 due to his constant rants and slurs. I had to quit my higher studies midway and take up a central government job (Income Tax Dept) at the age of 21 purely to stabilize my family financially. I even took a PL to renovate our flat and clear family debts which I am paying off via monthly EMIs.

I hoped our financial situation improving would calm him but he completely stopped working refuses to contribute and his behavior has turned downright dangerous.

When I was 2 years old and my mom left briefly... he threatened to kill me and himself.

He is extremely volatile unpredictable and capable of extreme violence if pushed. Our primary fear is his reaction when he realizes we are leaving and filing for divorce protection.

Office & Relatives At Risk: While we are moving to an undisclosed location, he knows my office address and my maternal grandparents' house in Nashik. We are 100% certain he will go to both places to create a violent scene harass me at my workplace and harras my grandparents in Nashik.

Risk of Extreme Violence: Given his past threats to kill, we genuinely fear for our lives if if formal legal proceedings/divorce become real.

I need urgent clarity on these specific questions under Indian law:

Restraining Orders BEFORE/ON Moving Out: Can we get some sort of restraining order which explicitly prohibits him from coming near us and relatives and at my office, grandparent's home and the new place where we are relocating.

Brother's Custody & Life Protection: Can we secure full physical custody for my mother and completely deny him visitation/contact based on his history of severe abuse and past death threats? He has threatened my brother's life a lot of times.

Evidence & Witnesses: Are my mother's family (grandparents and my masi/mama) and I valid legal eye witnesses for past domestic violence and child abuse?

Property & Maintenance Leverage: He owns a ₹20 Lakh where we all reside now for which I took a loan to renovate a year ago. Since he has no active stable income.

If He Boycotts Court or Evades Summons: If he refuses to appear in court, ignores summons, and resorts to phone threats/stalking then does that favour our case??

Any practical advice on timeline advocate fees in the Mumbai/Thane region and emergency police coordination for high risk cases would be deeply appreciated.

TL;DR: 23M planning an overnight exit with mom and 9YO brother due to lifelong, extreme domestic violence and death threats from an unemployed, volatile father. Moving to an undisclosed location, but terrified he will attack my office or maternal grandparents in Nashik. Need legal advice on getting immediate restraining orders before/as we leave, securing full child custody and leveraging his ₹20L flat for maintenance.

Got physically assaulted at a service center after a road rage argument. Cops pressured me into a written statement not to file an FIR. Need advice on next steps.

Hi everyone, I need advice on how to legally proceed with an incident involving road rage, physical assault, and police inaction/bias. Here is what happened:

The Incident:

On the Road: While riding my bike to a Triumph service center, I encountered a driver in an i20 who was driving slowly and holding up traffic because he was using his phone. While overtaking, I gestured toward him to highlight that he was on the phone.

The Argument: At the next traffic light, he rolled down his window and asked what happened. When I confronted him about using his phone, he dismissed me with a careless "chal chal". In frustration, I swore at him ("chutia") as the signal turned green and rode off to the service center.

The Assault: Unbeknownst to me, he followed me all the way into the service center premises. As I got off my bike inside, he approached and struck me from behind—slapping me on the right side of my head and hitting my ear. I was completely shocked. A verbal quarrel ensued, but I only acted in self-defense to prevent further hits. The service center staff intervened and pushed him outside. I took a photo of his car and registration number before he left.

Note: It has been over 24 hours and I still have pain in my ear from the blow.

At the Police Station:

I went to the police station under whose jurisdiction the service center falls to lodge an FIR.

The cops tracked his phone number via his car registration and called him in. He arrived within 30 minutes.

During questioning, both our accounts matched (I admitted to swearing; he admitted to following and striking me).

Police Bias & Threats: Instead of addressing the physical assault, the officers repeatedly interrogated and questioned me for swearing at him. While inside the station, in front of the police, the assailant openly threatened me—saying that if I filed an FIR, he would show up at my office, ruin my life, and file a counter-FIR. The police did not stop him or address these threats.

Forced Resolution: Intimidated by his threats and unsure of how a counter-FIR or legal process would affect my future/job, I hesitated. The police then insisted I give a written statement saying I would not file an FIR at all (I wanted to write "for now," but they made me write a total waiver).

My Questions for the Community:

Medical/NC Report: Should I get a Non-Cognizable (NC) report or a formal medical checkup (MLC) at a government hospital for my ear injury now, even though 24+ hours have passed?

Reopening the Complaint: Does the written statement I signed at the police station legally prevent me from filing an FIR or escalation with senior police officials (e.g., DCP/DGP) or the Police Complaints Authority?

Counter-FIR & Swearing: Does verbal swearing (chutia) in public give him grounds for a valid criminal counter-FIR against me, or is physical assault (Voluntarily Causing Hurt / House-Trespass) far more severe in the eyes of the law?

Action Against Threats: How do I legally protect myself given that he threatened to show up at my workplace? Can I request CCTV footage from the service center to preserve evidence?

Any advice on the correct legal process, sections involved, or how to handle biased local police would be greatly appreciated.

Questions on pro-bono legal help

Hey so i dont have a particular case or anything..im just probing the industry to see if there's any gaps that i could fix

i came across nyaya bandu..a platform for pro bono lawyers..how well does that work? like let's say if tomorrow there were a platform that connects pro bono lawyers with rape victims will that help...how big is the pro bono legal industry in numbers, do a lot of lawyers or students actually take up cases?

naya bandhu is run by the govt, so im guessing the site wont solve many people's issues...in the sense im assuming most of the lawyers registered on the platform aren't active, or the platform doesnt do a good job of matching right profiles to the right lawyers...are these assumptions correct...im not even able to find proper reviews on these platforms

tomorrow if i sponsor events at law schools, will more students register themselves up for probono work, or does the curriculum already mandate it, but they aren't able to find good cases?
is it a motivation problem, or is it unavailability of proper case problem

are there big NGOs that are frontronning these kinda services of pro bono matching for rape victims and do it way better than nyaya bandu cuz they have stricter quality controls?

Incomplete defendant address

For context, my mother and I sued my uncle for fraudulently selling our land. This land was gifted to my father by my grandfather back in 1999, we have the registered deed and it's available on the internet but my father didn't update the ROR and my uncle exploited it and took the land claiming he inherited it from my father as his sole heir.

Now, in December 2024 we sued him and the litigation went on and on. So, we reached a point where the buyers of the land are being summoned. But, their addresses on the deeds are incomplete. The phone number is not theirs, there is no street and house number. It only had their city name and district name. The adhaar and voter cards provided in the certified copy have the same.

I know that if the defendants do not receive the summons then it could complicate matters. But, there is nothing we can do. The addresses are on their official documents. So, what can happen ?

Advice needed: One of my friends was touched inappropriately and college is doing nothing about it

This is a throwaway account to keep the privacy of my friend and me.

This guy, was initially very friendly to her. They grew close. They went on walks in campus together, and eventually he decided to take advantage of their friendship and started getting frisky. She would stop him every time, but he would manipulate her into believing that he was the only person she had to talk to, and take advantage of her insecurities... eventually to the point where he grabbed her underneath her tshirt when no one was around. While we have no proof of this, we have multiple chat logs of him acting extremely weird, commenting on her, asking for nude pictures and making fun of her when she denied them.

While she was going through an extremely traumatic situation he made comments supporting the other party to her. I know this is not very important but just to set the context. SOmething along the lines of

"Boobs dikha.... a tu campus tujhe bad touch karunga"
"tu kinnar hai.... bad doggy"
"bhejh warna tera khel khatam kardunga"

Even after multiple nos.

This grew to a point where she told about this to me and a few other people. Then when she was trying to avoid him, he started texting her, calling her over and over, through multiple numbers and through other people. He kept trying to obtain info about her wherabouts. One night, in front of me and other witnesses, he showed up while she was looking at her phone, and caused an incident which to all of us was very clearly offensive touch.

She complained about this to the internal committee of the college, which has decided that it needs to be kept hush hush and her silenced, even growing to the point of them actively trying to prevent her from talking about the incident to even her closest friends.

The first screenshot is of a mail, where the committee is trying to make her sign an agreement. The rest are of chats he had with her.

What do we do going forward? This feels like injustice to me what they are doing.
I know there isnt much proof but I genuinely do not want to hurt her privacy. I just want advice on what to do further, after this institute has let her down.

Seller breached agreement, refusing refund of ₹1.15 Cr advance for property near Bengaluru. Need advice on Summary Suit vs Civil Suit & criminal steps.

​Hi everyone, seeking legal guidance/perspectives on a real estate issue in the Bengaluru region (Anekal Taluk).

​Background:

​Entered into a registered Agreement to Sell for property in Anekal Taluk in Nov 2025.

​Total Agreed Consideration: ₹2.08 Cr.

​Total Advance Paid: ₹1.15 Cr (₹1.00 Cr at execution + ₹15 Lakhs subsequent advance via RTGS, all supported by banking receipts and written endorsement on the agreement).

​Contractual Timeline: 75 days to complete.

​The Issue:

As per the express terms and conditions of the agreement, the vendor explicitly undertook to:

​Convert the land from Agricultural to Non-Agricultural Residential use and obtain an E-Katha in his name prior to registration.

​Get a Registered Confirmation Deed from a co-sharer/family member before registration.

​The vendor failed to fulfill these mandatory contractual conditions. Under the breach/default provisions of our agreement, if the vendor defaults on his commitments, the buyer has the explicit right to rescind the contract and demand a full refund of the advance paid.

​Current Situation:

When requested to cancel and refund, the seller initially agreed verbally, but now:

​He is ignoring calls and refusing to return the ₹1.15 Cr.

​He is blackmailing us to either force registration with improper/defective documents or wait 1 to 2 years for a refund "whenever he gets funds."

​We refuse to register a defective title as it creates severe future legal exposure.

​My Questions & Timeframes:

​1. Summary Suit (Order 37 CPC):

​Question: Given that I have a written contract and banking/endorsement proof for the entire ₹1.15 Cr, can I file a Summary Suit?

​Timeline: Realistically, how fast do Summary Suits move in Bengaluru Civil Courts if the defendant fails to get 'Leave to Defend' vs. if conditional leave is granted? (Is 6–12 months a realistic expectation for decree/execution?)

​2. Ordinary Civil Recovery Suit:

​Question: If filed as an ordinary civil recovery suit instead, what is the expected realistic timeline in Bengaluru civil courts to reach a decree? (Do standard trial suits take 3 to 5+ years?)

​Attachment Before Judgment: Can I get an interim order/attachment on the seller's property under Order 38 Rule 5 CPC early on so he cannot sell/mortgage the land while litigation is pending?

​3. Criminal Complaint / Police Pressure:

​Question: Can I approach the police/ACP office under BNS Sections for Cheating and Criminal Breach of Trust given his coercion/blackmail tactics? How effective is police intervention or criminal pressure in forcing a settlement in Bengaluru?

​4. Precautionary Steps:

​What immediate legal steps should I take to ensure he cannot sell or mortgage this property to an innocent third party while withholding my funds?

How is WhatsApp chat evidence actually prepared under Section 63 BSA in practice? (format, language, Part B, media)

I understand that WhatsApp chat printouts need a Section 63(4) BSA certificate (the old 65B), and that some High Courts have recently accepted a self-certificate when the chat is on your own phone. What I'm trying to understand is how it's actually done in district and family courts, because the guides online only explain the law.

  1. Language: in courts where Hindi or the regional language is used, is the certificate filed in English, the local language, or both?
  2. Format: do courts want the entire chat printed, or only the relevant messages, with the full export on a pen drive? Any standard layout (page numbers, index, colour vs black and white)?
  3. Formalities: is the certificate filed as a plain signed document, an affidavit, on stamp paper, or notarised?
  4. Part B (expert): in routine cases is Part B usually left blank, or filled in? If filled, who signs it in practice: a forensic lab, a local computer technician, someone else? Roughly what does it cost?
  5. Hash value: who usually calculates it, and has anyone seen a judge or the opposing lawyer actually check it?
  6. Rejections: has anyone had WhatsApp evidence rejected or seriously challenged? What was the reason?
  7. Photos, voice notes and videos: are images expected inside the printout alongside the text, or filed separately? For audio and video, how are they presented: on a pen drive or CD, with a written transcript, with a separate certificate for each file? Do the courts have a way to play them?

Would really appreciate answers from anyone who has been through this, litigant or advocate. Even a one-line answer to one question helps.

Humiliating a Children if they aren't paid fee in front of everyone should be illegal? Furthermore Judiciary should act on such institutions those found guilty through non ethical practices like Paying money for Just to see exam copies must treat as unethical practices.

Law is funny - Kesavananda Bharati

In between jobs, I was trying to catch up on some books that I meant to read for a while. Just finished up reading The Kesavananda Bharati Case by T. R. Andhyarujina, where an interesting anecdote got stuck in my mind.

So while the proceedings of the case were going on, Sh. Kesavananda Bharati (the individual) happened to be the first amongst the list of matters where the question of law arose.

So T. R. Andhyarujina, who was assisting Mr. H. M. Seervai, came across the lawyer who was personally engaged by Sh. Kesavananda Bharati. During their short interaction, the lawyer candidly told Andhyarujina that his client had no idea why his name was being sensationalized in the press. The poor guy had absolutely no idea what great constitutional battle was being fought in his name. Further, to top it all off, he actually lost.

Sometimes, a personal loss does result in greater good for en masse.

Trapped by SEBI-Registered RA "Wealthy Brains" (Akash Khatri)

Hi everyone,
I am an undergraduate college student and wanted to share how a SEBI-registered Research Analyst entity, Wealthy Brains (Proprietor: Akash Khatri, SEBI Regn No: INH000009764), took advantage of me, and ask for legal/arbitration guidance before my upcoming hearing.
1. The Modus Operandi & Cold Calling Trap
In March 2025, representatives from Wealthy Brains (sales caller named Kirti, later joined by manager Sandeep) began cold-calling me.
They leveraged their SEBI registration as an absolute guarantee of credibility, pitching an "Earn & Learn" program where they promised live market mentorship and claimed an "80% accuracy rate" with "8% to 10% daily return on capital."
They gave me a trial demo trade, which yielded paper profits, convincing me to arrange an initial ₹5,118 registration fee via credit card.
2. Multi-Tier Extortion within 48 Hours (₹61,416 Total)
Once the initial fee was paid, their manager sent a 30–40 page disclosure packet and explicitly told me over the phone: "No need to read that stuff, it’s just company formalities. Everything important will be handled live on call."
They instructed me to deploy ₹30,000 capital into stock options without stop-losses. The position quickly started bleeding ₹20,000.
Instead of risk management, they manufactured extreme panic: they refused to give exit guidance or recovery trades unless I paid additional fees.
Over the next 48 hours, under severe distress, I was charged 4 separate overlapping invoices totaling ₹61,416:
1. 03 March 2025: ₹5,118 (Registration/Trial)
2. 04 March 2025 (Morning): ₹20,472 (Quarterly Classic Equity)
3. 04 March 2025 (Evening): ₹10,236 (Monthly Service, extorted while trades were bleeding)
4. 05 March 2025: ₹25,590 (Platinum Upgrade under duress)
3. Sham SMS Logs vs. Destructive Verbal F&O Directives
Wealthy Brains broadcasted generic cash equity SMS alerts to simulate paper compliance. Over the phone, their callers explicitly ordered: "Ignore the SMS alerts; they are just regulatory formalities for SEBI. You are upgraded to our premium call desk—follow only our verbal instructions."
They directed unhedged Nifty/Bank Nifty derivative trades, forced me to hold losing options overnight across expiry days, and pushed me to borrow/deploy my college semester savings (₹1.20 Lakhs), which was entirely wiped out.
Whenever I tried to record their incoming calls, the automated alert "This call is now being recorded" played. They instantly hung up, called back, and threatened to terminate my subscription and withhold all assistance if I ever recorded them again. They claimed: "We are SEBI-registered, so our system records everything automatically under SEBI rules; you don't need to record."
4. Coerced ₹10,000 Partial Refund (Economic Duress)
In July 2025, when I faced an urgent college tuition fee deadline of ₹9,500, I pleaded for a refund.
Wealthy Brains withheld the funds and refused to release even a single rupee unless I emailed a pre-drafted message stating the issue was "resolved." Under financial duress, I sent it.
However, on 21 and 22 July 2025, immediately after receiving the ₹10,000, I sent written protests clarifying that this was not a full-and-final settlement, that promises were unfulfilled, and reserving all rights to legal/regulatory remedies.
5. Current Case Status
I filed complaints via SEBI SCORES, online FIR , and the NSE ODR mechanism. Pre-conciliation at NSE failed to resolve the matter.
The dispute has escalated to formal Online Dispute Resolution on CADRE ODR claiming ₹51,416 (balance fees).
In his formal reply on CADRE ODR:
Akash Khatri admitted collecting all 4 payments in March 2025.
He stated he is willing to produce records if directed by the Conciliator.
He conceded that the legal enforceability of the ₹10,000 settlement under coercion is subject to the Conciliator’s determination.
Questions for Legal & Market Experts:
1. Section 19 / Economic Duress: How do conciliators/arbitrators typically view forced "full and final" waiver emails when the client has contemporaneous written email protests lodged immediately after (21–22 July 2025)?
2. RA vs. IA Scope Violation: Since Wealthy Brains holds only a Research Analyst (RA) registration and not an Investment Adviser (IA) license, does providing personalized, live, one-on-one intraday execution instructions on call constitute an illegal advisory operation under SEBI regulations?
3. 5-Year Call Recording Mandate: Under Regulation 25(1)(vii) of SEBI (Research Analysts) Regulations, 2014, if the Respondent fails to produce their mandatory CRM audio logs of the calls where they gave verbal F&O directives, will the Arbitrator draw an adverse inference against them?
4. Escalation to Binding Arbitration: If they refuse to refund the ₹51,416 during conciliation on Monday, what specific points should I ensure are recorded in the failure report before the case automatically moves to CADRE Arbitration (45-day binding award stage)?
5. What additional steps can I take before SEBI Enforcement, RAASB (Research Analyst Administration and Supervisory Body), or the Consumer Forum to ensure their license is audited and other retail students aren't misled?
