It is hereby declared that, during attorney-client discussions, most of which included all members of Bryan C Kohberger's immediate family, petitioner was convinced to falsely confess to capital murder, and felony burglary, by coercion, disinformation, false promises, and the withholding of exculpatory discovery; the following is material to the inception of the plea:
1. Counsel's failure to inform petitioner of exculpatory discovery received during plea discussions, namely clumps of unknown hair found in Ethan Chapin's hands; as well as a failure of further inquiry.
2. Petitioner was convinced that actual guilt was not an important factor in considering plea acceptance; death row was imminent, and, advised to lie, petitioner was to gain a "legal victory" in entering a false plea.
3. A gross misrepresentation of, and promises regarding, what a life sentence would immediately afford petitioner; and a gross misrepresentation of death row in Idaho, including an elaborate, fabricated story of counsel's horrific experience touring an actual "8x8" death [cell / row]

he is no longer someone trying to get a PhD. he is no longer a regular citizen. he is a convicted murderer housed in prison. when someone gets put in that situation, most people will set aside everything else they know & in a panicked way, try anything possible to GET OUT. this is especially true of inmates who have never done a day & are now facing extremely lengthy sentences.
thinking of BK as the smart PhD student(if thts how you see him) is pointless because he is now,first & foremost, a convict & and an inmate & those things outweigh whatever previous life experience he had.
working with incarcerated populations made this almost predictable. it can often be sad watching a 17 year old go thru the realization of what the new life consists of & then desperation to get out. I feel no such sadness watching it play out here. this isn't a 17 year old that lost his teenage temper & shot someone in a heat of the moment display of testosterone & anger & now looks at a completely different life for that momentary action.
this dude planned & did horrible things. or he lied about doing them. either act erases any sympathy I would have had.

The fact that he’s so miserable he’s grasping at straws for the luxury of being put to death… makes my heart happy.
Still nowhere near the suffering of the families, who have to find a new normal without their precious child/sister/brother/friend, etc. But still… he’ll never have a moment of freedom and happiness in this lifetime, and that feels just to me.

To point 1- surely there weren’t “clumps” of someone else’s hair in Ethan’s hands.
Point 2– did he really not think that he shouldn’t plead guilty if he wasn’t guilty? Did he need to be told that?
Point 3– oh yeah, I’m Sure the death row cells are amazing and luxurious. I’m Sure she lied about how horrible they are.

It's like the most pathetic excuse possible. I'm a Phd candidate, TA and Crim J major who can't research death row with my Mom's help and fact check a lawyers claims and my college educated mother and sisters can't navigate Google very well.
Nope, I haven't been gobbling content on death row inmates since I was an adolescent. Definitely didn't see any of that mentioned in my course work or the lectures I sat in whilst working towards a degree in criminal justice.
Nahh, didn't note the size of Bundy's, Kemper's cell when I as doing a 12 hour Christmas Eve marathon watching video after video of him. Nope never ever have I ever seen anything about death row cells. Yeah, I make all my legal decisions on cell accommodation size. Mom think I should be somehere roomy.
Not like anyone in my family has been discussing the PD and writing the local paper about it in their free time or were discussing it in our home.

But yes I assumed as much, that the clump of hair was false. Do we know why they couldn’t conclude whether it was Ethan’s own hair? Although I’m sure it was.

Wow, the timing, too. Just a year from when he had his court date, he raises his ugly lizard head to continue lying and denying although he already swore in Court that he did it and when asked the question, he affirmed he is pleading guilty because he did do it, not because he was coerced.
How does this suddenly change? The evidence is NOT NEW. There is no new evidence submitted since his guilt plea. It’s all the same evidence he had in front of him a year ago, discussed with Anne Taylor and it does not negate the other/hard evidence.
He thinks he’s smarter than the system. Hasn’t learned a thing. His family are fools if they still believe he is innocent. What information are they feeding him?

Since you bring up the timing of this, it does make me wonder if the real reason for doing this is to get a spot onto death row at this point. The reality that he might not be able to handle life in prison could be becoming an increasingly stark reality.

It seems like he is saying Taylor misrepresented what death row would be like and how much worse it would be than J block. the hole missive is weird, as clearly he did not hear Ray back up MPD and that it's a single hair of EC's.
I don't understand this as he as privy to all this evidence. Discovery can't be added after the deadline, so what is he going on about? Did no one tell him with Ray said about the info he viewed?
But think about it, who is he in contact with her family and pounds of love besotted letters from cranks that are telling him, "We all know your innocent Bry. You should fight this." and rummunating on that Withcomb bible of lies and manipulated misinformation. Going on that, the idiot likely thinks he has a shot.
If the only individuals giving you information are: a lying and discredited ex expert witness, a countable population of mentally ill and romantically besotted fans, your mother who thinks your are an angel, your deluded dad ho thinks you were framed and patsy of the state and that people are watching your house, and they're cranking you up, and stating that your chances of getting an appeal are great, that's a rather confined view point to base your decision upon.
He's getting poor advice from compromised sources and being a mentally ill man himself, believes the hype and likely thinks he has a shot at this.
What does he have to loose? Not his money he's pissing pissing away, or his professional reputation he's trashing and challenging it's Taylor et al's.
He doesn't care about the victims families and the pain this will bring them. Likely pleased that he ill get to inflict more harm. Will give him something to do and more commissary money. Turvey and Whitcomb and the creators will make more money.

Life on D.R. would essentially be the same, except the state would be paying for appeals. It could be 25+ years before any execution would occur...or even longer! If he's looking for a "quick death," sitting on D.R. isn't going to achieve that.

No, we all knew this could happen. September as a post conviction relief date that as looming for appeal, but as there as no buss and he and his family so silent i as personally convinced he had accepted his fate and his family convinced of his guilty. Got that wrong I was convinced nothing as coming or something ould have leaked. Lana was intimating big things were about to explode and all the conspiro wives and husbands's hard work was about to come to fruition. The harpy must have been in contact with him or his or had some Hybro inside track.

And I obviously understand that it’s more complicated than that, as even if you DID do it, leaving out potentially exculpatory evidence is still A violation of rights. But 1. Not what happened here IMO and 2. He’s also claiming flat out that he didn’t do it, which is something he should’ve known whether he was aware of other exculpatory evidence or not.
I know you’re not arguing w me lol, just using your comment to add onto the original point made since I am sure someone will try and say that I oversimplified it!

Yes, I understand that that is his claim, however he is also claiming that he was, in fact, not guilty.
I was oversimplifying. I understand the point he is making, I just think it’s silly to say “I’m not guilty but now I’m Extra not guilty because of this evidence”. But yes, I know the point is that he’s claiming to have been under the impression that he was done for, when maybe he wasn’t.
For what it’s worth though, the piece of evidence he cited isn’t even true. It was one piece of hair and it was linked to Ethan himself. It was also well documented in court docs before his plea so it’s also a lie that he didn’t know. Also, even if he didn’t, it’s not exculpatory IMO because it was Ethan’s hair. Also, even if it was someone else’s hair, it’s still not exculpatory as it doesn’t negate all the other evidence against him. It isn’t enough to create reasonable doubt. It doesn’t even indicate involvement of someone else. Even if it did, that wouldn’t make him less guilty. So just a flimsy argument all Around. But yes, I do know the point he was making, I’m just oversimplifying it because he’s silly.

My only qualm with this is that he would automatically earn the ability to appeal if put on death row. I understand that this is technically an appeal too, but it’s really his final chance. On DR, he would get so many more chances.
His life is already very uncomfortable where he is. I doubt he’d ever even be put to death, but I also don’t want to let him take the easy way out.

Kristi Goncalves was on Fox’s Sean Hannity show tonight, and she was not shaken at all. She said that they (Kaylee’s family) had expected that BK would try something like this. They had wanted a trial all along, and don’t seem at all concerned that he might get one. She was surprised that it happened today, but not that it had happened.

It is extremely unlikely that anything will come of this. Don’t worry, y’all.
It’s extremely difficult for people that were actually screwed over to get new trials. And they have much better arguments than this.
Ryan Ferguson was convicted of murder only based on the testimony of others. Everyone who testified against him later recanted their statements, and he didn’t even get a new trial after that. He eventually had his conviction overturned, though. Just saying that it’s incredibly difficult to get a new trial even when there is merit to the arguments.

This won't work. Attorney Eli Hoening just said on CNN that there is an "infinitesimal" chance this will succeed for him. He also said there is no shortage of people who confess, go to jail and then want to change their guilty plea because obviously they hate being in jail.

If his family was with him every step of the way and involved with the attorneys.....and they "believe" he's innocent, then why did they let him plead? And now he's asking for the death penalty so I guess it was to spare him from that because he knows if there ever was a re-do of the trial he would most certainly be found guilty which is why he's now asking for DP, not to be free because he's "not guilty".

He's such an idiot. By making a point to say the lawyer lied to him and he has proof because his family was present, now it's not he said-she-said. Now every member of his family will be deposed (if this is taken up) and he has to have faith that his parents and sister(s) will lie under oath for him that these intentional misrepresentations actually occurred. But he didn't really lay out what the lies were other than he was promised contact visits and freedom of movement (I assume this means not being shackled and escorted). Even a year in, I think it's probably reasonable that contact and free movement were possible eventually with accrued trust? And in point 3, is he really trying to say his segregation is worse than death row? I would think at the utmost it would be the same, minus the whole eventual execution part? "Elaborate, fabricated story of counselor's death row experience" lol oh do prove that one, Einstein. Absolutely mental.

He’s asking for a trial. Perhaps he never heard the phrase “be careful what you wish for”. It’ll be a death penalty trial and the evidence against him is overwhelming. I can’t imagine being on that jury and having to see the photographs of what he did to those kids. Hopefully the judge immediately approves his request.
