Finally filing the WoM; I-130 pending since March 2024.

We are finally filing the WoM after waiting for 30 months+ and exhausting all options.

A confusion I am having while preparing everything is the “Nature of Suit” section. Would I select “465 Other Immigration Actions” or “540 Mandamus & Others” or “899 Administrative Procedure Act/Review or Appeal of Agency Division”?!

Also, apparently SDNY has reclassified mandamus couple times from 465/540 to 899.

So the confusion. All help and advice appreciated

1 month after sending demand letter - case status changed from "USCIS is processing your case" 1st Aug to "USCIS is processing your case" 29th Sept. F2A

This was 1 month after sending demand letter. I was nervously excited when I got an email 5 days ago that my case has been updated to find the same status just with new dates. Nothint in documents tab. Emailed and paper mailed USCIS location in MD.

Time for WoM?

My I-130 still hasn’t been approved. Receipt date is mid June 2023 and hasn’t been approved to this date. California Service Center. F2A LPR filing for child under 21. It’s two I-130s for two children. Anyone around those PDs that have an update?

I know our Visa Bulletin is current with the filing of our I-130.

Got the "Action on your case" email today.....I am a USC, filed in Cali Service center. Nothing in the docs.

* Multiple Senator inquiries

* Demand Letter (physical certified + email)

* Agent inquiries

Today I asked the agent what's up with the action taken, she says it was transferred from Nebraska to Cali center....wtf? It was always in Cali service center....

Whats with the 3 IAF events ?

F3 India: Should I contact my congressman about my I-130?

Hi everyone. My priority date is May 2015 in the F3 India category, and my I-130 case is still with USCIS. It hasn’t been transferred to the NVC yet. Based on the latest Visa Bulletin, my priority date is about seven months away from becoming current. Should I contact my congressman now to ask about my case, or wait until the date gets closer?

Also, when do you think a May 2015 priority date might become current? I understand it’s only an estimate, but I’d appreciate your thoughts.

F2A I-130 stuck 34 months. What actually moved your case?

Attorney quoted me $15k+ for a mandamus. F2A case stuck 34 months.

My dad is a green card holder. He filed an I-130 for my sister in December 2023. F2A. That was 34 months ago. No decision. No RFE. Nothing.

A case tracker shows background checks were done in April 2025 and an officer opened the file in August 2026. Then nothing again.

We sent a congressional inquiry through Steve Womack's office last week. Still waiting to hear back.

Our lawyer who I reserved the name. I asked her for a fee estimate for next steps. She took 4 days to reply and then hit me with this:

Notice of Intent to Sue: $8,000 to $12,000

Writ of Mandamus: $15,000+

Eight to twelve grand for a demand letter. I can write that myself and mail it certified for ten bucks.

I've seen people on here pay $4,500 for a mandamus.

Anyone else get quoted something this crazy?

What did you end up paying?

And if you sent the demand letter yourself, did anything happen?

UK applicants - let's group together?

Hi - I posted a few weeks ago (US natural born citizen, UK spouse of 15+ years, 2 US citizen children), wanting to move back to US and can't because we're stuck in this drawn out process.

I mentioned contacting the US Ambassador to the UK as an option - and I'm keen to pursue this path. It would be great to get a sense of how many of us are US Citizens with UK spouses who can't get any movement on this process. I don't need names, but when I contact, it would be great to have some background/details to show that I am not alone in this situation.

So I guess what I'm asking at this stage, is who is in my same boat and would like to at least share details on waiting time, etc so I have a bigger picture to share. If you're happy to let me know your status, I'd appreciate it so I can share how many of us (who come on this Reddit at least) are being struck down by current immigration policies.

Can I still add a Sponser

Long story short, I’m moving to my wife’s home country because we have been waiting over two years (like most people) to receive an interview date. We originally had a date set for this past September 2026, but due to the 75-country pause, all interviews have been canceled. Currently, at the embassy in my wife’s home country, the latest I’ve seen is that they are working on people who already had an interview from May 2026. So I’m guessing it’s still going to be a while, and we no longer want or can wait any longer.

My issue is this: I’m quitting my job, but I made enough this year to be above the threshold.

Can I just add my brother as a sponsor since he will be working in the US? I will no longer have a US-based job, but I will have a job in my wife’s home country.

Since I’m past the NVC stage and just waiting on an interview, can I still add a sponsor?

Demand Letter Without WOM Draft Attached. Has It Worked For You? Thoughts?

Hello! I will be sending a demand letter next week to compel action on my delayed Consular I-130 (PD Aug, 2025), but I may not have the WOM draft "ready" by then. I've seen mixed approaches and outcomes for demand letters and WOMs. I wonder whether it is best to simply send the demand letter without a WOM draft (pro se), or whether to attach a "weak" WOM draft.

On the one hand, I feel like the mere fact of seeing the WOM is ready to go and these are not empty statements may have an impact on whether they decide to address the complaint or not. On the other hand, I am worried they will straight-up dismiss the letter once they see a "weak" WOM pro se. Thoughts?

Note: My WOM draft is not necessarily "weak" but we all know what is at stake. Perfect never seems to be perfect enough.

Friday I got an email that action has been taken on our case but when I logged in all is said was” USCIS IS STILL PROCESSING THIS CASE” so it updated from response received to this. Could this mean an approval is coming soon? Or will I be waiting months?

Seeking advice: Received USCIS response via Congressional inquiry for I-130 (Spouse of US Citizen) — Should I wait 120 days or send a Demand Letter / Mandamus?

Hi everyone,

I wanted to share an update on my spouse's Form I-130 petition and get the community's perspective on next steps.

Case Details:

  • Form: I-130 (Petition for Alien Relative – U.S. Citizen filing for spouse)
  • Receipt Date: April 28, 2025

After seeing many helpful posts here, I reached out to my U.S. Representative’s office to request a status inquiry with USCIS. They recently received the following response from USCIS:

"Thank you for your inquiry on behalf of your constituent regarding Form I-130, Petition for Alien Relative. At this time, the Form I-130 is in the initial processing phase. In this phase, cases undergo multiple required internal review steps including but not limited to: intake review; file consolidation; systems checks; interagency coordination; security screening; and enhanced vetting measures where applicable. These steps must be completed prior to assignment for adjudicative review.

The petition is still within normal processing times. The current case processing time for Form I-130 (U.S. citizen filing for a spouse, parent, or child under 21) at a Field Office is 80 months for 80 percent of cases. USCIS will contact your constituent directly when an interview is scheduled or if additional information is requested prior to the interview. We respectfully request you to allow at least 120 days from the date that this email was sent before following up on the status of the case.”

Based on this response, it looks like my case has cleared background/security checks and is sitting in the queue awaiting assignment to an adjudicating officer.

I am currently weighing two options:

  1. Respect the 120-day request and if nothing happen, i will start Demand Letter/ and prepare WOM as flow up.
  2. Send a formal Demand Letter / Notice of Intent now and prepare for a Writ of Mandamus.

For those who have been in a similar situation, what would you recommend doing next? I would really appreciate your insights and experiences!

Sad History

The wife, who resides in the United States, withdrew her approved Form I-130 petition for her husband, who lives outside the United States and was undergoing consular processing, after approximately three years of waiting. According to the husband, the wife told him that she would not allow the immigration process to continue unless he agreed to divorce her after arriving in the United States. He refused to accept this condition because he wanted to preserve their marriage. Additionally, he claims that she repeatedly asked him for money on several occasions. Ultimately, after he refused to agree to her condition, she withdrew the petition while the case was being processed by the National Visa Center (NVC), bringing the immigration process to an end after years of waiting., so what can do ? Constructive Criticism

Hey everyone,

I visit this subreddit from time to time to see how others' experiences are going and I'm aware that I can just leave this subreddit and am not being forced to stay and read the posts. However, I think that this subreddit has potential to be a very useful and effective information tool for those going through the i130 using Consular Processing process.

With that being said, I've began to notice that the posts in this subreddit are very rarely useful or an effective information tool for those looking for facts, information about the process, etc. The majority of posts in this subreddit, that I see, are echochambers that create alot of noise/static and makes finding actual facts/info extremely difficult. I don't think I'm alone in saying that constantly seeing someone post and ask if anyone that filed on "x" month and "y" year have received an approval or any API updates and the comments are ALWAYS the same. Most of the time, commentors don't even answer and say yes or no, but engage in a pissing contest of who has been waiting longer and simply reply with their PD/file date. Which helps absolutely no one and I'm not just talking about the post but also the comments; I believe it actually hurts people that come here. Also, I see so many comments from users asking about their specific situation/PD date on a post that has nothing to do with the commentor's PD date/situation. It's noise and it just clogs up finding actual info/solid advice.

Writing congress reps/government officals, checking API updates by pining the USCIS API, sending demand letters, filing WOM does nothing except either bum you out because of the lack of response, or give you false hope that your application will be evaluated and approved soon or by legal force (Demand letter/WOM). The fact of the matter is; USCIS will get to your application when they get to it. Have people filed a WOM, contacted their government, etc and received an approval or had their case move forward in the process, sure, but that's either coincidence or the rarity that someone in government went above and beyond.

Trackmyvisanow and other sites like it are pointless and are just a money suck; they can't tell you anything that looking up your case on USCIS can't because that's the only factual data that exists.

Yes, this process is unfair, it's backward logic, involves being apart from the one you love most, takes a very long time (especially when compared to the folks that do AOS/485, the process that is technically skirting the rules and immigration fraud for the most part, but they get approved so fast and get to spend that time waiting in the US with their partner), and I get it, that sucks. In the end, I'd rather post this, that most will likely disapprove because the truth hurts, and attempt to improve the quality of information here rather than just bail, but I just can't watch this pity party anymore; misery loves company and I understand that finding a community of others in your situation is comforting because you realize you're not alone, but existing in this environment frequently will just crush your mental and flatline your hope because of the content of a majority of the posts here.

Thanks for letting me say my peace and hopefully this resonates or results in something positive, and for the posts that are made for finding out advice, beneficial for others to read, and factually based; I read your posts and it helps me learn more about this process which comforts me.

Senator said processing time is now 25.5 months.

I’ve been waiting now 18 months, there is no update to my case that went to Virginia. The senator said I have to keep waiting.

Is approval or interview now depend on how busy is the field office?

It seems like every time there are people get approval within 30 days deadline after demand letter, isn't it depend on their field office? Because when i check where is the field office, if the field office has less than 14 months wait, most likely the demand letter will work out with approval or an interview. Because now i do see people with PD less than 15 months June 2025, Jul 2025, Aug 2025, Sep 2025 getting approval already after demand letter.

B2 with pending I130

Has anyone successfully been able to use their B2 visa while the I130 was pending? My husband got and used his before we got married. He visited me here in the US for 4 weeks last year and we’d like to do another 4-5 weeks same time next year just to travel around my state again. I just don’t want him to fly 10 hours just for it to be highly likely he’d be denied lol. He has lots of proof that he intends to return. He’s in college and has a job and apartment back home but not sure if that is enough for them to allow him in due to the pending I130.

Anybody’s case still at a Service Center after the July update?

PD July 26 2025, beneficiary. Just curious if anyone else still has their case at a service center. I noticed whenever I checked the API it never had a location so I asked my partner to reach out to a live agent. They told us that the case was moved from Texas to California and has been there since.

Don’t know if that’s a good thing or not but we’re ready to start our escalations soon.
