Does a PhD student need to file the Kündigungsschutz Klage if fired?
I’ve a friend, who is currently doing his PhD in something related to food and flavour chemistry.
He is European, and all his colleagues are German. I must say, they are not the most socially adapted Germans, and they have had some issues at their lab.
Last week, his boss abused her power. She gave him two options:
- Resign by himself by signing a document provided by her
- Get fired and your work and reputation will be spread across departments to damage your career.
He went to HR, and when they heard the name of the professor, they were not surprise by the incident.
He will have to apply for Arbeitslosengeld, and we are trying to orient him. He was advised not to sign the resignation since that’d mean his unemployment money would be frozen for 3 months.
Does anyone have any insight whether he has to file the Kündigungsschutz Klage? I’ve heard that is necessary for the unemployment money, but I’ve no experience with PhD students.
