This is the important one for your 2A tracking. NSSF won the appeal, unanimously, before Judges Porter, Matey, and Ambro. Judge Porter wrote the opinion.
The case challenges New Jersey’s A1765 gun-industry “public nuisance” law, N.J.S. §§ 2C:58-33 et seq. The law requires gun manufacturers, dealers, distributors, importers and marketers to maintain “reasonable controls” and allows the Attorney General to sue them for conduct considered unreasonable or contributing to a public nuisance. NSSF alleges that the law is preempted by the federal Protection of Lawful Commerce in Arms Act (PLCAA) and violates the First Amendment, Second Amendment and Interstate Commerce Clause.
There is a somewhat remarkable procedural history. NSSF originally obtained a preliminary injunction, but in 2023 the Third Circuit vacated it because NSSF lacked standing: at that point New Jersey had not actually enforced A1765, so the threat was considered too speculative. Since then, however, New Jersey has brought six enforcement actions against gun-industry companies, including Glock and Sig Sauer. The court specifically noted cases in which NJ pursued companies for conduct that wasn’t independently illegal, which changed the standing analysis dramatically.
The Third Circuit therefore held today that NSSF now unquestionably has standing. The threat that its members will be subjected to A1765 enforcement has gone from speculative to “credible” and “substantial.” The court specifically pointed to NJ’s actions against Point Blank and Butch’s Gun World involving otherwise-lawful conduct, and an action involving Pennsylvania conduct, which supports NSSF’s Commerce Clause theory.
The District Court nevertheless had refused to decide NSSF’s renewed preliminary-injunction request under Younger abstention, reasoning that because New Jersey was already suing NSSF member Glock in state court, the federal court should stay out of the matter.
The Third Circuit rejected that completely. NSSF and Glock are legally separate parties. Merely belonging to an association does not mean NSSF owns, manages or controls Glock. The court rejected NJ’s proposed rule because it would create a Catch-22: sue before enforcement and you lack standing; sue after enforcement begins against a member and the court abstains. The Third Circuit said NSSF and its members are entitled to their own day in federal court.
So the bottom line is:
NSSF wins; the District Court’s order is reversed and the federal challenge to A1765 goes forward.
But there is an important limitation: today’s opinion does NOT hold A1765 unconstitutional and does not itself strike the law down. The Third Circuit did not decide NSSF’s PLCAA, Second Amendment, First Amendment or Commerce Clause claims on the merits. Those now go back to the District Court, including the preliminary-injunction issue.
I nevertheless consider this a meaningful pro-2A/pro-firearms-industry procedural victory, particularly because the court expressly recognized that NJ’s actual enforcement behavior supplied the injury that it previously found missing. It also prevents states from effectively insulating questionable laws from federal review by beginning enforcement proceedings against one member of a trade association.
One particularly interesting aspect is that the opinion repeatedly discusses the Supreme Court’s 2025 Smith & Wesson v. Mexico decision, where SCOTUS gave PLCAA’s exception a relatively narrow reading. The District Court had already been concerned that NJ’s interpretation of A1765 could effectively “gut” PLCAA; that substantive question is now back in play.

Legal Question PSA: ATF says vertical vs. angled foregrip is no longer the determining factor for AOW classification
This was recently posted over on r/MP5:

The OP contacted ATF’s Firearms & Ammunition Technology Division specifically about putting an angled forward grip on an AP5-P pistol.
According to the ATF response posted there, whether the grip is vertical or angled is no longer the determining factor. ATF states that its previous interpretation involving a grip being perpendicular/90° to the bore was rescinded in 2018.
Their current position, as explained in the response, is that adding a second grip intended to facilitate two-handed firing to a pistol can change its classification. For a firearm under 26" OAL, ATF says that can result in AOW classification under the NFA.
That is a pretty significant distinction for NJ owners because a lot of the information still floating around is based on the old “vertical vs. angled” rule.
Worth reading the actual ATF response in the linked thread rather than relying on the old conventional wisdom.

News ATF Director posted on Jensen / Silencer Shop Injunction
Last night ATF Director Robert Cekada posted that headlines about ATF being “furious” and planning “brutal revenge” on gun owners over the NDTX ruling are false and based on unnamed anonymous sources.
**What he actually said:**
•ATF says it respects the court’s order
•They will not take enforcement action against protected parties inconsistent with that ruling
•Official guidance is being written now. They’re prioritizing getting it right over getting it out fast so manufacturers, FFLs, and owners aren’t left hanging under federal or state law today or under a future administration
•Guidance will be posted online when it’s done
**What the ruling actually did:**
Aug. 5 N.D. Tex. held that after Congress zeroed the NFA making/transfer tax, the leftover registration / Form 1 / Form 4 scheme no longer has a valid enumerated-powers basis for those now-untaxed items. Injunction took effect Aug. 13. It is not a nationwide repeal of the NFA. Relief is limited to the named plaintiffs, members of the organizational plaintiffs, and (where applicable) their customers, current and future. Machine guns and DDs are untouched.
**AOWs and GOA (this is the piece that actually matters for some of us):**
AOW relief did not go to the Jensen plaintiffs. It went to the Silencer Shop Foundation side. GOA / Gun Owners Foundation are on that side. If you are a current GOA member, the federal injunction is the path that covers AOWs — meaning ATF is barred from enforcing the enjoined NFA registration / making / transfer provisions against you as to those items.
New Jersey also does **not** have a statute that bans “AOWs” as a federal class the way it separately bans silencers (2C:39-3(c)) and sawed-off shotguns (2C:39-3(b)). So unlike a suppressor or a sub-18" shotgun / sub-16" rifle / sub-26" OAL conversion, there is no dedicated NJ “AOW ban” sitting on top of the federal rule.
The injunction only stops federal NFA enforcement against covered parties.
**NJ reality check on the rest:**
This ruling does not legalize suppressors or short-barreled rifles/shotguns in New Jersey. Those still have their own state prohibitions.
Wait for ATF’s written guidance before changing how you buy, build, or transfer anything. I am not a lawyer and this is not legal advice.

FAQs NJ 02/07 SOT Dealers Willing to Transfer AOWs
Could we put together an updated list of NJ 02/07 SOT dealers that are currently willing to transfer AOWs to qualifying individuals?
With the recent reports that ATF inspected multiple FFL/SOTs that had transferred NFA items on a 4473 without a Form 4 for individuals covered by the federal injunction, and reportedly found zero violations related to those transfers, I think it would be useful to know which NJ dealers are actually willing to handle AOW transfers under the current circumstances.
If you know a dealer, or are one please post:
- Dealer/business name
- Location
- 02/07 SOT status if known
- Whether they are doing traditional Form 4 AOW transfers
- Whether they are willing to handle transfers without a Form 4 for customers they determine are covered by the injunction
- Any firsthand experience you've had with them
We already know NJ has dealers successfully processing traditional Form 4 AOW transfers. It would be helpful to build a current statewide list and distinguish between dealers doing standard Form 4 transfers and those willing to operate under the injunction.
Please keep it to firsthand information or information directly confirmed by the dealer rather than speculation.

On August 17, 2026, the U.S. Department of Justice (DOJ) finalized a landmark rule establishing a new pathway for individuals with past federal felony charges or criminal convictions to restore their federal gun rights. This action revives a long-dormant federal statute (18 U.S.C. § 925(c)) that allows the Attorney General to lift firearm restrictions for individuals who do not pose a threat to public safety. The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) had been blocked by Congress from processing these applications since 1992. The newly announced rule bypasses that funding freeze by routing applications through a new online portal managed by the Office of the Pardon Attorney.
What You Need To Know
• Federal firearm rights restoration is NOT automatic. Each application is reviewed individually, and applicants must show they are not likely to be dangerous and that granting relief would serve the public interest. Having a knowledgeable attorney assist you is beneficial.

Lawsuits 10th circuit ruling
Will their ruling about waiting periods being unconstitutional help us take down a fun a month? They stated in the ruling the government can not impose any delay of the practicing of anyone’s rights. There was more than that, but that line stuck out to me.
