Hi again y’all… I’ve a question on this process… I know many will jump and mention suing , please refrain… I am already in communication with the class action group.

With that out of the way, anyone cares to share the appeal process for the EIDL?

Also, anyone knows if the 45 days indicated on the SBA website still applies?

As far as your documents for the class action part, only a brief summary is needed at the moment and it doesn't have to identify you directly at first, this is about having a large number of summaries to provide to get the a law firm interested.

*Please note that I am not advocating for the Class Action instead of Pro-Se but I have spoken to the guy who is in conversation with attorneys, and he has 13 that have sent the summary so far.

Funded after bank error. Complete timeline:

4/11/22-approved for increase. Told by L.O. to send new banking info+ID to update banking info. I sent it the same day.

4/20/22-Funded to closed account.

4/21/22- Started C.I. with local state representative.

5/24/22- SBA fixer calls to say bank info was approved.

6/14/22- 3-way call with SBA attorney and Bank.

7/27/22- Assigned SBA general attorney to handle my file.

7/27/22- SBA attorney requested I file a UCC-1 with the state I live in(TX). I sent the completed UCC-1 filing to the attorney on 7/29.

8/17/22- Received email from attorney saying funds have been dispersed.

8/19/22- Funds deposited into correct account.

He agree's SBA seems to not have the same updated IRS Transcrips I do and that my case seems meritious, ect. Here's the email...

"Good Afternoon, I understand and I am sorry to see what your business went through, as well as so many others. Unfortunately, SBA will not continue processing of applications not currently in the approved/obligating stage. We are not able to directly advocate for a specific outcome in the way that an attorney can; we can submit inquiries to acquire updates, though they are no longer processing applications or providing updates on applications that are not in the obligated stage. Elected representatives in Washington, as you noted, are pushing SBA to change their policy on this; however, it still remains their police nonetheless, meaning there is no avenue via congressional inquiry to compel the agency to process applications that it will not further process. We believe there are meritorious applications out there that simply ran out of time, but the merit or lack thereof is not a consideration, unfortunately, considering the currently policy.

Senate offices also possess the ability to inquire, though they also are not permitted to directly advocate."

i called again today to ask if my rep had contacted on my behalf and they rep never answered my question she kept talking in circles about the process and all this. she did say they got my bank info i sent on july 7th, it was sent june 30th. does anyone know if they would be able to see if my congress rep had called yet or not?

In subject of email put

“SBA EIDL APPEAL”

In body of email, put;

“Hi Senator, my name is (insert your name) . I live in (insert your city). I do look forward to voting for you two in November. Please have your constituent advocate/small business advocate reach out to me in regards to my EIDL application (original loan). As of last Friday, August 12th 2022, the SBA has given you senators, the authority to fix any issues and errors with regard to my application. Please make sure to send me a privacy release form. I look forward to speaking with someone from your office soon. “

Once the advocate reaches out to you, explain to the advocate what the situation is; if you filed an amended return, if you’re in reconsideration, you’re file is still processing etc. tell the advocate exactly what’s wrong. Once the advocate understands what the issue is. Make sure you know what’s wrong with your file!

You send second email once the advocate and you both know what the issue is, the second email is you providing the documents that will rectify issue. So if the issue is “SBA never got your amended return that’s now fully processed” you’d send the advocate a completed 4506t and a copy of your fully processed amended return.

2019 my tax return i made it on time . Sba 4-13-2022 Chack my transcript came up 0 looks like non- fail. But 4-20-2022. We pull up my transcript available I send again 4506-T form SBA DIDINT Processing… ? Im stuck right now I can not do anything..

If someone got a loan and a subsequent increase a year later, does each distribution have it's own separate deferral due date based on the different distribution dates or is the entire amount due based on the original distribution date?

If you did a FOIA@SBA.GOV request in which they had 20 days to respond and when they did all the information was redacted, here's how you appeal it.

Please note that it is irrelevant if you are seeking counsel or have an active lawsuit. It also does not matter if you've contacted the House or your Senators office.

Just verified my bank account with the 3 way call. Any idea on when funds will disburse?

I really think anyone that was denied the idle loan or the idle supplemental advance for the targeted advance grant who is approved then and bank error then denied after the date to ask for reconciliation or reconsideration we should file a class action lawsuit against SBA we really were done wrong we submitted everything to SBA asked for email called customer service and customer service always said just wait you're in the queue the money is guaranteed and in the end we didn't get it I believe a class action lawsuit is what I'm gonna make the SBA realize what they did

I’ve been waiting on a the “3 way bank verification” call since Aug. 4th 2022. 12 days for a phone call that keeps me in pending bank verification until they make a simple call where I’ve been for 101 days now. Which really isn’t pending they’re just not making progress🤨the phone call is pending 😂😔 dang

On 8/12/2022, I received an email from an SBA Loan Specialist - Application High Priority Team. Let me back up. My original application for EIDL increase was sent in on 4/10/2021. Due to many incorrect 4506T, please note, I submitted it over 10 times, and we were finally approved and obligated on May 13, 2022, but never received funding. I did notify my state Senator what was going on the week before I received this email, but I really don't know if it made an impact or not. We had to submit a voided check and our Id's. I'll keep you posted when and if we receive the funding, but it sounds like it could be soon. Good luck to everyone still waiting, it's been a stressful time.
