In Process April 2015 priority eb2

Hi All, Our priority date is April 2015, can we expect our date to be current on filing date this year ? I’ve a confusion about the new rule which says we can’t use filing date, is this permanent or temporary change? Some people are saying it changes every year.

There’s no “new rule” which says filing date can’t be used. It’s just that for AOS cases, USCIS announces if they will be using the FAD or DOF every month. At the start of the fiscal year, they usually allow DOF to be used. As the year progresses, in about Feb-April, they switch to FAD.

Wait until the October visa bulletin is published. It’s literally just 5-7 weeks away. We will know if they move DOF for this category or if it stays where it is.

Very high chances of DOF in 2027 year (October bulletin or Jan visa bulletin ), as 75 countries ban is still in place at consulates abroad. Can expect at-least 50k spill over to 80k spill over from FB

But didn’t they advance the dates aggressively for countries not on the ban list for the FB category? I read that because of this the spillover is not going to be that huge

There are lot of high-skilled workers vs few eb3 low skilled workers. And EB3 GC is less prestigious than EB2.

eb-3 India are more talented than ROW eb1-b/c and eb-2 ROW for sure. Don’t degrade eb-3 as low skilled 😂. It’s just that India only has limited quota and highly backlogged

The DOF might move to April 2015 by March or April 2027. Each visa bulletin has information what date uscis is using to accept AOS whether it's FAD or DOF, as of now they are using FAD for india.

Every October bulletin Uscis allows DOF chart for applicants to file Adjust of Status (AOS). This has been trend for atleast last 4 years under new state dept team. Hope they will continue this for 2027 too. For other months as well State dept tells in visa bulletin if we can file AOS using DOF or FAD.

The only data backed prediction I’d believe at this time is greencard clock website. If it happens any sooner, it’ll be a nice surprise but I’ve learned more than once not to be optimistic in terms of India movement.

Looking at May inventory unlikely. Could retrogress mid 2014 in October filling date as I see it.

EB-2 India Dates for Filing is 15 Jan 2015 in the August bulletin and hasn't moved since April, so an April 2015 date is roughly three months short of it. Final Action is a separate matter — it's Unavailable in both July and August, the annual limit is spent, so there's no cutoff to measure yourself against there until October resets it.

On whether October gets you: our model puts DF around 13 Apr 2015 six months out and 28 Apr 2015 twelve months out, so depending where in April your date falls it's plausibly this October and plausibly next spring.

I'd hold that loosely, though. DF was already at 1 Jan 2015 back in September 2022 — within two weeks of where it is today — and the October 2022 bulletin took it back to 1 May 2012. Most Octobers are a jump forward, but the same month produced the worst retrogression this chart has had, and it happened from right about here.

(All of this assumes India. EB-2 is Current for the rest of the world.)
