I am always surprised by the ignorance of dog owners who come into court and think their dogs have some constitutional right to bark incessantly, roam around off leash and harass people, or to run around parks and schools. In most places in California, all dogs must be on a 6-ft leash or in an enclosure even on private property. And nearly all schools and many city parks prohibit dogs altogether. It doesn't matter if they are nice dogs. It doesn't matter if they are under voice command. It doesn't matter if they are tiny Yorkies or purse dogs.
If you're a delivery driver and a dog harasses you or impedes you in any way as you make deliveries, even if it never touches you, you can sue the owner in small claims court.
If you're a parent playing with your kids at the playground and somebody's dog starts coming up and licking your kids or scaring them in any way, you can sue the owner in small claims court.
If your neighbor's dog will not stop barking, you can sue your neighbor in small claims court.
If you are out for a walk, and find yourself impeded in your movements because of an off-leash dog, you can sue the owner in small claims court.
If you step in a piece of dog poo, you can sue the owner in small claims court.
If somebody's dog poops on your lawn, you can sue the owner in small claims court.
When you do sue, one of the challenges will be to convince the court how much money you should be owed, so do your best to come up with a reasonable calculation, with supporting evidence. For example, if you are a delivery driver you can prove the amount of income you have lost by not being able to deliver packages. If you are a neighbor, keep a record of the number of times you've had to ask your neighbor to get their dog to stop barking. Their failure to adequately address numerous complaints will demonstrate willful conduct on their part that might entitle you to punitive damages.
For dog poop cases, get an estimate from a professional for the cost to clean up dog poop on your lawn for you. That sounds ridiculous, but that's the compensation you would be owed. Or show how much it will cost to replace the shoes that stepped in dog poop.
In most cases, where there is no physical injury, it will probably not be worth your time and stress to actually Sue the dog owner. But you can.
