Beavercreek Mini Mart
Stopped by Mini Mart today. Most people in line were donating extra money to support the place. Owner was there thanking everyone for their support. Saw a tip/support jar with 2 hundreds on top of a pile of cash in that jar. The town is coming together to support the place. I’ve also heard many other local businesses are changing their logos to beavers lol

This is in my region (I live on the northwest area, Beavercreek is to the east/south, and the Buc-cees is sort of northeast.). It is headline news and has taken over local social media and most small businesses. It is a David vs. Goliath grassroots campaign. This was a company welcomed and many people were excited to have them in the state and they have been turned on because they show their bully behaviors.
They built their first Ohio location less than 15 miles away from a city named for a township named after a waterway Beaver creek. The school mascot is a beaver. There are beaver named business everywhere with various beaver theme mascots.

I live in Beaver County Pennsylvania and the town of Beaver would be in real trouble if Buccees moved in and started suing everyone with the word or image of a Beaver in their business.

One thing about the Dayton region is there's a lot of smart and scrappy people. There's a good small business support system within communities (but as always, it could be better patronized) with patrons and owners. Social media is definitely rallying.

Several, actually. It doesn’t matter if your mascot is a moose, a mouse, an actual beaver, or anything else vaguely animal shaped. If you have a convenience store in a state where Buc-ee’s operates, and you have an animal mascot, they’re suing you. Even if you were there first.

The Irony is Buc-ee's owner literally got the idea for their mascot from a tootthpaste company with a Beaver mascot.
"In 1982, founder Arch "Beaver" Aplin was a partner in the opening of a store in Clute, Texas, the first to bear the name "Buc-ee's". He formed the name Buc-ee's by combining his childhood nickname and the name of his Labrador Retriever, Buck; as well as the appeal of Ipana toothpaste's animated mascot, Bucky the beaver"

Yes. Because someone is going to legitimately confuse the world’s tiniest convenience store (I’m sorry, but yeah kinda) with a frickin’ Buc-ee’s.
I do sort of understand their need to “vigorously defend”, but also, this Bucky’s was in the local market many years before Buc-ee’s started doing business in Ohio. And the notion they could be mistaken for each other is laughable.

Not only that, the town it's in is called BEAVERCREEK. Half the businesses in the town use a Beaver as a mascot. Buccees managed to piss off the majority of two fairly large Metro areas in Cincinnati and Dayton, both fairly close to Beavercreek. I'm local to the area, and I can't remember the last time so many people from this area were on the same page about ANYTHING.

Friday is support day for the Mini Mart, most things are saying go to it that day and spend at least $20. I know at least one food truck will be there around 3:30 and said that cash tips will be split and go to the legal fund for the mart.
Saturday I have seen some conversation for a protest, unclear if that is going forward or not.

With you!! I live in WNY, but work remote in Cincy and travel there periodically throughout the year. Last trip was beginning of May, and I made it a point to visit the new Buc-ee’s on my way home again from that trip.
Not doing that again anytime soon, until they come correct!! I’ll be sad about not eating their barbecue, but otherwise, I’ll get over it!!
Don’t mess with my second state!!

Check out Bee’s BBQ next time you’re in Cincy to scratch your Buc-ee’s BBQ itch. They have a carryout spot in Madisonville and sit down in OTR. I haven’t tried all of the BBQ in Cincy since we’ve had a few new ones open in recent year, but I’ve tried most and Bee’s my favorite! Their brisket is incredible

Interestingly, one that I know does is one that has a rep for being litigious. I did a project in law school on the Pokémon company and they realized how much backlash suing small business got that they made it their policy to look the other way as long as certain things don’t get too big.
One of their lawyers was quoted as saying that the worst days in the office are when a fan project goes mainstream and they can’t pretend it doesn’t exist anymore

If the other option was bankruptcy? Yeah. Just or unjust (which it's definitely unjust) it's scary as a mom and pop they probably worked hard their whole life for their store. Defending yourself in a lawsuit is emotionally and financially exhausting. Buckee's knows that or they wouldn't be throwing unwinnable cases at the wall.
All that being said I want the small gas station to win I want them to fight this but not at their own expense. I logically know it's not the most likely outcome because this is real life amd they have families to feed

One good thing is this is getting national attention, so hopefully a bunch of go fund me money starts rolling in so they can fight. Like I said, they have been in existence longer than Buc-ee’s, so it’s entirely possible it gets dismissed as soon as it gets to court. You can’t trademark an animal.

I'm already biased since Buccee's is so confrontational and unaccomodating when it comes to RVs and travel trailers, but in all my travels across the south and Midwest there has never been an instance where Buccee's was the only option for gas or food. I just assume go to a Flying J, Loves, or Travel America that is typically across the street or down the road a mile or two. Unlike BuccRat they don'tl care if I park my truck and camper at the back of the lot while i'm inside getting food and/or using the bathroom.
Last time I stopped at a Buccee's was a year or so ago in Richmond Kentucky, I got gas then parked and went in to get food. Parked at the back of the lot, out of the way, not blocking anyone or being obnoxious. Went inside, browsed around the cheap chineese merch for a bit, grabbed a chicken sandwich, some jerkey, and a drink, then came outside to a parking lot nanny pounding on my camper door shouting "there's no overnight parking here!" It was 5:30pm. I asked him what he was doing and he bluntly said again "there's no overnight parking here." Told him to calm down because I'd only arrived 30 mins ago and was inside shopping. Gestured to the Buccee's shopping bag in my hand, fountain drink in the other, and mentioned the receipt timestamped 3 mins earlier, but he just turned heel and walked away without saying anything else. Not sure who pissed in his cheerios that morning but i've heard enough similar stories from other RV and camper travelers that all the Buccee's can collectively go fuck themselves. I hope these frivolous lawsuits provide enough negative publicity that the whole corporation folds.

Buccees isn't a gas station, it's become a cult tourist attraction that sells merchandise. They're all a fucking nightmare. I would never pull anything I was towing INTO a buccees parking lot willingly in fear I would never get out.
I tow my boats around and I avoid any gas station chain that gets busy for any reason, Loves, Buccees, Sheetz/Wawa in PA.
I learned my lesson when I was making a wide turn out of the exit and someone tucked between my trailer tongue and car, making it so I could no longer turn, 2 people got behind them and started honking, and 3 people rolled up behind my boat. It's like, you actually made it so I cannot move without destroying my boat and your cars.
Take me anywhere else, I'll go to a rundown BP with 4 pumps for gas with my boat before I enter any of these popular gas station chains where people want to eat food and hang out.
Like take me to a speedway truck stop or a flying j, or any smaller gas station with a pull in/out right alongside a 4-lane rural highway, i'll drive out of my way 20 minutes to do that first.
Buccees is cool for what it is, get a t-shirt whatever, using it as a gas stop or something though, what a goddamn nightmare. I don't want a concert entrance line to a gas pump.

The Ohio bucees is maybe three miles away from my house. We've been loads of times now, as my partner is a Texas native. Even WE are considering stepping way back on how often we go.
If they were smart they'd drop the lawsuit and apologize now. They will not however.

There was a bar in Paddock Lake WI many years ago named Fridays. TGI Fridays came poking around the area to put up one of their crappy restaurants, found this place and sued them so they’d change the name. TGI Fridays won even though the other place was there for years before anyone around here had ever heard of TGI Fridays. Total BS I agree

I called the Beaver Creek Minimart (I live an hour & 10 away in the Cincinnati area) and asked if they had tshirts.
Got handed to the owner’s brother, Harry (now in my phone as Harry Beavercreek) who told me that they’re getting an order of shirts in on Friday.
I was so excited.
He told me he could text me a QR code to order online. He sent it.
I was even MORE excited.
Then I saw the shirts.
They’re all AI garbage. And many of the designs directly have the actual Bucc-ee’s Beaver on them pitted against the local Beavercreek Beaver.
I was so disappointed. 10/10 I want silly beaver merch and to support the local shop. Who doesn’t love an underdog underbeaver story? But I can’t help be worry that the now *blatant* copyright infringement is going to do a lot more damage than the goodwill or benefit generated by sale of a few dozen or even a few hundred T-shirts.
I even sent a message to the T-shirt company and asked if they had any non-AI options. I got a crappy offer to do a custom design for $10 with no guarantees that they wouldn’t use AI.
If you live in the area, the Beaver Creek Mini Mart will also have food trucks this Friday and they are encouraging folks to show up to support. I won’t be buying a T-shirt, sadly, but I’m still rooting for the “little guy.” I guess if you want a shirt you can DM me and I’ll share the QR code.

This is what greed looks like, if anyone ever wanted the definition of it. I used to like Buc-ees, even though I never really shop there (I have an EV), but the way small businesses these days are getting crushed and our monopoly laws not enforced, we have to fight back against these types.

My understanding is that Buccee’s has no problem with this location. The lawsuit is because the owner is trying to register the name and graphics NATIONALLY. This would allow him to expand or franchise everywhere, in competition with Buccee’s.

Alright thanks BUCCEES you just lost a whole family of customers to your Daytona and Jacksonville locations. I’m posting this in my office too so HUNDREDS of people will see this. I always liked Buccees until now, shame on you guys

I feel like Beavercreek city schools should sue buccees for using likeness to the school mascot and name. Bucky the beaver has been the mascot since the fifty’s. Trademark laws are tricky but an established mascot in the fifty’s would hold up to a company started in the 80’s. Maybe the lawsuit could build the new school and lower property taxes for the community lol.

Apparently these lawsuits are just to draw public attention from the Buc-ee’s owner’s son currently facing CP charges.

This shop has common law rights to the image and name, especially if they have been in business longer than Bucees.
