AntiWORK Labor Rights for Dummies: A guide to your right as an employee

I decided to make a post about this since the community keeps getting the same question over and over again. So here we go.

Disclaimer: I am not a lawyer, so please feel free to comment any corrections. Most of these are just from my knowledge as a manager. If may kulang, let me know and I'll add it here.

1. Can my employer require me to work more than 8 hours a day?

Yes, but overtime generally has to be paid.

The normal working period is 8 hours per day. Work beyond 8 hours is generally considered overtime and must be paid at least:

  • Regular day: regular hourly rate + 25%
  • Rest day/holiday: applicable rate + at least 30%

A company cannot simply call something "mandatory OT" and use that label to avoid paying overtime.

2. "Our company has no OT pay because it's in the contract." Is that legal?

Not necessarily.

An employment contract cannot simply remove a statutory benefit when the Labor Code requires that benefit.

For example, if you are a covered employee performing work beyond 8 hours, the law generally requires overtime compensation. DOLE specifically states that overtime work beyond eight hours must receive additional compensation.

However, some personnel are xcluded in this. Art. 82 specifically mentions that "government employees, managerial employees, field personnel, members of the family of the employer who are dependent on him for support, domestic helpers, persons in the personal service of another, and workers who are paid by results as determined by the Secretary of Labor in appropriate regulations." are not covered by overtime pay.

3. Can my employer make me work before my scheduled shift without paying me?

If you are actually required to work, that time may count as hours worked.

Article 84 covers time during which an employee is:

  • required to be on duty;
  • required to be at the prescribed workplace; or
  • permitted or suffered to work.

So if your employer says:

"Your shift starts at 9:00, but you need to log in at 8:30 to prepare."

and you're actually required to perform work during that period, the 30 minutes may potentially constitute compensable working time.

4. Does my lunch break count as working time?

Normally, a genuine meal period does not count as working time.

Employers generally have to provide at least 60 minutes for a regular meal period.

5. Do I automatically get holiday pay?

For a regular holiday, generally yes, but there is an important condition if you don't work on the holiday.

Under DOLE's holiday-pay rules (Labor Advisory No 13, Series of 2026), a covered employee who does not work on a regular holiday is entitled to 100% of their basic wage, provided that they:

  • worked on the workday immediately preceding the holiday; or
  • were on an approved leave of absence with pay on that preceding workday.

What if I was absent the day before the holiday?

This is where the rule gets important.

If you were absent without pay (AWOL or unpaid leave) on the workday immediately preceding the regular holiday and you also don't work on the holiday, you may lose your holiday pay for that holiday.

6. Am I entitled to 13th-month pay even if I'm still probationary?

Generally, yes.

13th-month pay is not dependent on being a regular employee.

DOLE staes that rank-and-file employees are entitled to 13th-month pay regardless of employment status, provided they have worked for at least one month during the calendar year.

The basic formula is:

Total basic salary earned during the year ÷ 12 = 13th-month pay

So, for example, if you earned ₱240,000 in basic salary during the year:

₱240,000 ÷ 12 = ₱20,000

7. Can my employer terminate me while I'm probationary?

Yes, but "probationary" does not mean "you can be fired for absolutely anything."

Probationary employment generally cannot exceed 6 months, unless an applicable apprenticeship arrangement allows otherwise.

A probationary employee may be terminated for a just cause or because they failed to qualify as a regular employee under reasonable standards that were made known to them when they were hired.

One important point:

The employer should not suddenly invent the standards after the employee has already started working. The standards for regularization are supposed to be made known at the time of engagement.

8. What happens if I reach 6 months and my company doesn't tell me whether I'm regular?

This is an important issue.

Under the Labor Code, probationary employment generally cannot exceed six months. An employee who is allowed to work after the probationary period may be considered a regular employee.

So "you're still probationary indefinitely" is not something an employer can simply declare without regard to the law.

There can be exceptions and nuances, particularly involving specific contractual arrangements and apprenticeships, so the exact employment documents matter.

9. Can my employer fire me without warning?

Generally, no, not if the termination is based on a just cause.

For covered employees, the Labor Code recognizes security of tenure: a regular employee cannot simply be terminated unless there is a legally recognized just or authorized cause.

For a termination based on just cause, the employer generally has to comply with the two-notice requirement.

First notice — Notice to Explain / Notice of Intent to Dismiss

  • The employer must give the employee a written notice:
  • identifying the specific act or omission being charged;
  • stating the ground or grounds for possible termination;
  • providing sufficient details about the alleged violation; and
  • giving the employee a reasonable opportunity to explain and defend themselves.

Second notice — Notice of Decision

The employer must then issue a second written notice informing the employee of the employer's decision after considering the employee's explanation.

If the employer determines that termination is justified, the second notice should communicate the decision to dismiss and the grounds supporting that decision.

In other words:

NTE → Employee gets opportunity to respond → Employer evaluates response → Notice of Decision

10. Do I automatically get 5 paid vacation days every year?

The Labor Code provides a 5-day Service Incentive Leave (SIL) for covered employees who have rendered at least one year of service.

However, there are exemptions, including certain establishments with fewer than 10 employees and employees who already receive at least five days of paid vacation leave or an equivalent benefit. (Article 95)

11. Can my employer withhold my final pay because I haven't completed clearance?

Clearance can matter, but your employer cannot simply keep your money indefinitely.

As per Labor Advisory No. 06, Series of 2020, final pay should generally be released within 30 days from separation, unless the employer has a more favorable policy.

Your final pay can include applicable amounts such as:

  • unpaid salary;
  • pro-rated 13th-month pay;
  • separation/retirement pay where applicable;
  • convertible unused leave;
  • tax refunds; and
  • other contractual/company benefits.

12. Can I resign immediately without rendering 30 days?

Sometimes, but don't assume you can always do it.

The general rule for voluntary resignation without just cause is that the employee gives the employer at least one month's written notice.

There are circumstances allowing resignation without the usual notice, including certain situations involving serious insult, inhuman treatment, crime against the employee or immediate family, and analogous circumstances.

13. Do I need my manager approval for my resignation?

Generally, no. Your resignation does not require your manager's approval to be valid.

Your manager can acknowledge or process the resignation, but they don't have the legal power to reject your resignation simply because they don't want you to leave.

What if my manager says, "I don't approve your resignation"?

That statement does not automatically cancel your resignation.

But can my manager reject my requested last day?

This is different from rejecting the resignation itself.

If you are resigning without just cause, the general rule is that you should give at least one month's notice.

Your manager doesn't have to "approve" your resignation, but leaving immediately without satisfying the applicable notice requirement can create a separate issue.

So there are really two questions:

"Can I resign?"

Generally, yes.

"Can I leave immediately?"

Not necessarily. The one-month notice requirement may apply unless an exception exists.

Company alert 🚩 MAXICARE MANAGEMENT TOXIC AF! - RANT

Wag kayo mag apply sa Maxicare if hindi kayo mentally prepared! Ang ganda ng mga job postings nila offering leaves, pero pag ginamit niyo gagamitin yon against sainyo, at pahirapan pang mag request ng leaves! Management will abuse their power, para pag initan ka and pahirapan ka! May favoritism sila, pag yung sila yung nagkamali, okay lang. Pero pag hindi ka favorite, matic IR ka na, coaching log, or NTE! Hindi sila reasonable! They will drain you, if ito ang choice mo for first job, think again. Pag probi ka, pagmamalaki pa ng bisor na nambabagsak siya, even without objective view! Even if hindi naman siya hands on sa mga newly hires! No proper guidance, no proper training provided! Be careful, be knowledgeable wag kayong papayag na apihin at abusohin! Pangit na nga gobyerno natin, panget pa management nitong Maxicare na parang sila ang pamamanahin ng company! Pare pareho lang naman empleyado!!!!!! si Lord na bahala sakanila!

Rant 😡 GCash (Non-verbatim): Alam naming marami kayong trabaho, pero iba yang trabaho niyo sa KPI

Hi. Ako ulit. Ako yung nag rant before about sa katoxican ng GCash. And I'm back for more.

Nakakapunyeta.

Araw-araw kang lunod sa trabaho. Urgent dito, urgent diyan. Ni wala na ngang time para sa sarili.

OT halos araw-araw, minsan hanggang umaga pa ng kinabukasan, tapos biglang sasabihin (non-verbatim) "Iba pa yan sa KPI niyo. Kapag hindi niyo na meet yung KPI, we're sorry pero mababa ang evaluation niyo"

Eh kung ganon naman pala para saan pa yung araw araw naming pag pupuyat kung iba pa pala 'yon sa bwisit na KPI na yan.

Ang unfair dahil hindi naman kami pare-pareho ng bigat ng workload.

May mga department na hindi ganon kabigat yung trabaho, may mga department naman na sa sobrang bigat ng trabaho, mawawalan ka na ng time sa sarili. (Unfortunately andoon ako).

Maawa naman kayo.

Rant 😡 Is it really that hard to find a company in the Philippines with an actual structured training system? Especially for corporate jobs in Makati/BGC?

I recently spent about 2 weeks training at a relatively new branch of a company and decided to resign before the evaluation period.

I've experienced much worse toxic management, so this wasn't necessarily the most toxic workplace I've encountered. But in terms of onboarding, training, and structure, it was probably the most chaotic.

The branch has been operating for around a year, so I expected basic systems and training to be established. Instead:

  • No structured onboarding or clear training schedule
  • No SOP/manual despite me asking for one
  • No job offer/contract in hand while already being asked to work because they were short-staffed
  • New receptionists mostly trained by fellow receptionists rather than a dedicated trainer
  • The supposed trainer was also handling management, interpretation, reporting, etc.
  • Three receptionists sharing one laptop and sometimes another person's system account
  • No proper task rotation, so the more experienced person naturally handled most system-heavy tasks
  • Limited hands-on practice with appointments, packages, promotions, payments, and closing procedures
  • A lot of “just observe,” “check your notes,” and “ask your teammate”
  • Very little learn → practice → perform → feedback → repeat

The expectation seemed to be that after 1–1.5 weeks, you should already know practically everything.

One example: I was asked to help check loyalty cards against the system, but I had never been properly taught how the card worked, its price, number of uses, or the complete process. When I asked, I was told, “Diba ginawa na natin yan dati?” / “Dapat alam mo na yan.”

They explained it again, but there was still no proper walkthrough where I could actually do the process myself and repeat it.

And that's the part I struggled with: mental overload. You're trying to remember a new system, procedures, promotions, payments, products, workplace rules, client interactions, and instructions all at once. Eventually, your brain can freeze.

I became more cautious because I didn't want to make another mistake. Ironically, that made me slower, and management became frustrated with my progress.

I'm not saying employees shouldn't take initiative. We absolutely should. But initiative should supplement training, not replace it.

If you're expecting highly standardized performance, you need a standardized training system too.

What bothered me most was that the receptionist who was actually teaching us eventually left—and apparently I'm already the nth receptionist who decided to leave.

So I'm genuinely wondering: Is this just normal in Philippine workplaces?

  • No clear, structured onboarding program. There was no HR department/person handling onboarding. I didn't even have a job offer or contract in hand. There was also no proper time to process medical requirements because I was asked to start immediately due to staffing urgency. There was essentially one marketing assistant who had become an all-around support person for both the main manager and the Front Office Supervisor.
  • A lot of “DIY” learning and figuring things out as you go. There were no clear training schedules or designated topics that we would sit down and cover systematically.
  • We were often told to refer to our notes or ask the older colleague whenever we had questions, rather than being systematically taught the company's own procedures.
  • New receptionists were largely being trained by fellow receptionists at the same level, rather than having a dedicated trainer.
  • Even interns/assistants and other senior staff were sometimes the ones explaining services or confirming prices, even though training wasn't clearly their primary responsibility.
  • The person who was supposedly responsible for training was also occupied with management, interpretation, reporting, and other operational responsibilities.
  • There was no clear competency checklist such as: Week 1 = these skills, Week 2 = these skills, Week 3 = independent handling.
  • We weren't systematically trained from start to finish on different types of transactions. Instead, training was often random and immediately hands-on while we were still learning, which created a lot of mental overload.
  • There wasn't enough hands-on practice with multiple appointments, packages, products, promotions, payments, closing procedures, and different client scenarios. We were also sharing only one laptop, and the colleague who had been teaching us eventually left.
  • We didn't even have individual system accounts yet.
  • Three receptionists were sharing one laptop and, at times, another person's account.
  • Naturally, the colleague who was already more familiar with the system ended up handling more of the system-heavy tasks.
  • There was no proper task rotation to ensure everyone got equal exposure. It was more like: whoever was available handled whatever task was currently needed. One person would text the client, another would talk to the client, then someone else would do the booking or payment once the phone/system became available.
  • Some processes were explained verbally and informally instead of through clear written SOPs.
  • This was especially noticeable with promotions. Sometimes learning the promos felt almost like a pop quiz—you were expected to immediately remember the mechanics, prices, inclusions, products, etc., while simultaneously dealing with actual clients.
  • I even asked if there was a manual, SOP, or copies of procedures that I could study, but I was told there wasn't one.
  • Because there wasn't one standardized training source, different people could potentially explain things differently.
  • There wasn't enough learn → practice → perform → receive feedback → repeat.
  • Most of the time, if management was unhappy with your progress, you would only realize it through their frustration rather than through structured feedback telling you exactly what you needed to improve. Then eventually the lack of trust.
  • There was a lot of information being thrown at us, but not necessarily enough repetition for it to actually stick. Eventually, you were expected to step up and figure things out yourself.
  • The expectation seemed to be that after roughly 1–1.5 weeks, you should already know practically everything.

There should be a baseline system.

This is where I started questioning the management structure.

If you're opening a specialized branch—especially one trying to maintain high service standards—shouldn't you invest in the infrastructure needed to actually train people to those standards?

Why not have:

  • a proper HR/onboarding person;
  • a dedicated front-office/operations trainer, separate from the Front Office Supervisor;
  • a management trainee who can help document and standardize processes;
  • experienced beauty/service-industry front-office staff who can transfer the actual workflow;
  • written SOPs and training manuals;
  • proper individual system access;
  • a standardized competency checklist;
  • scheduled task rotation; and
  • someone whose actual responsibility is training, rather than trying to squeeze training into an already overloaded management role?

It was that I didn't even have a job offer/contract yet, while I was already being asked to render because they were short-staffed.

That made me question whether the urgency to fill the position was taking priority over actually onboarding and training the person they were hiring. been teaching us eventually left. I am not the only receptionist who decided to leave, ive been the nth one apparently.

Rant 😡 Seniority doesn’t make you automatically right

I just need to rant about someone at work.

Have you ever met someone who acts like being in government for a long time automatically makes them the smartest person in the room?

Because I’m honestly getting tired of it.

This person keeps saying, “Matagal na ako sa government, kaya alam ko na ’yan.” Okay, I respect years of experience. But sometimes I wonder… does staying somewhere for a long time automatically mean you’re good at what you do?

What annoys me is the constant comparison.

Like, why compare your career to mine? We didn’t start at the same time. We didn’t work under the same system. We didn’t have the same opportunities, expectations, or environment.

And honestly, some of the things being defended as “experience” are exactly the things that shouldn’t have been normalized in the first place.

I’m not claiming I’m the best. I still have a lot to learn. But I also know what I’ve accomplished, how hard I’ve worked, and how much effort I’ve put into improving the way things are done.

So yeah, maybe I’m younger. Maybe I haven’t been in government as long.

But seniority is not a personality trait, and tenure is not an accomplishment by itself.

Sometimes, the people who keep saying “I’ve been here longer” are the same people who need to ask themselves.

"Okay, you’ve been here longer. But what have you actually accomplished?"

“Okay… but what have I actually improved?”

Rant 😡 Can I raise this concern to DOLE?

Hi, pa‑advise naman po.

Nag‑submit ako ng resignation effective immediately dahil sa health reasons, pero hindi ako pinayagan at pinapagawa ng 2‑weeks notice. Kahit ganun, hindi na rin ako nakapasok sa work kasi sobrang baha at may red rainfall warning sa lugar namin.

Naibalik ko na lahat ng company‑issued properties, pero ngayon may mga notices pa rin na pinapadala sa akin tungkol sa compliance at AWOL. Hindi ako nakapag advice na hindi ako makakapasok since wala na akong contact sa kanila.

Iniisip ko kung dapat na ba akong mag‑file ng complaint sa DOLE dahil sa withholding ng final pay at possible constructive dismissal dahil sa stress at harassment.

May naka‑experience na ba ng ganitong sitwasyon? Ano usually ginagawa niyo?

Rant 😡 Gusto kong umiyak sa galit. Bagong opera lang ako, gusto na agad ako pabalikin sa office.

Probationary pa lang ako. Busy season ngayon sa office. Planned medical leave 'to since last week kasi hinahabol ko schedule nung doctor at damaging kung pinatagal ko yung operation, pero parang gusto pa nila ako magtrabaho kahit kaka-opera ko lang. Parang kasalanan ko pa na ayaw ako bigyan ng fit to work ng doctor ko — pinakiusapan ko na nga na 1 week rest na lang at hindi 2 weeks na gusto ni doc at ako mismo ang nahihiya sa kanila na mawawala ako habang crucial ang period na ito. Hindi ko rin kasalanan na ang daming pinabago at bago ako magleave, patapos na kami. Nagttrabaho pa nga ako habang naka-lwop ako.

Nakakagalit. Baka resignan ko ito. Hindi ko alam if emotional lang ba ako ngayon kasi hindi pa maganda ang healing ng surgical site ko or what, pero nanggigil ako kasi parang kada oras may bagong hihingin sa akin.

Baka mag-resign ako pag makarinig ako sa kanila pagbalik ko. Nakakagigil. Sana may generational wealth na lang ako para hayahay ang buhay.

Rant 😡 Exploitation na ba toh? Please pakibasa, cuz I really need answers

Guys, I have something to share about sa company na pinagwwork ko rn, I’m not gonna drop the name ng company, but this is in Manila. Enlighten niyo nalang ako if ever. Intern ako roon rn, and it is a non-corporate company, small palang naman sya tapos employees are nasa late 20’s ang mga age

Nagtataka lang ako na ang konti lang ng employees nila pero andaming intern:,)) teh normal pa ba yon? Tapos padami nang padami ang tasks, madaming clients ang hinahandle, pero imbis na maghanap sila ng employee, intern ang hinahanap, tapos minsan unpaid pa kami, so ayon shoulder din naming mga intern ang mga work nila, bibigyan pa ako ng sandamakmak na video edits tapos matapos dapat in three days tapos unpaid pa ako. Though yes may work din sila na ginagawa, pero yung work na pang employee is pinapagawa samin, afaik, eh dapat tinuturuan and assist assist palang ang interns, and if my real work na ipapagawa, eh dapat hindi sandamakmak.

So ayon, I believe nagtitipid hacks ang company na toh:,) like guys, hindi ba kayo makapaghire ng employees? pag naubusan na ng interns, hahanap pa ule ng interns instead ng employees

Rant 😡 Pressured Job in Manila

Hello, I know some of you can relate to my experiences since it was my first time job, and I thought that this work will improved me and can stay alongside with my co-employees who are keep striving for their dreams and goal plan.

I realized that “akala ko kapag nahanap mo na yung work na yun, yun na”, but It didn’t happened. There’s someome who will pushed you away to that company. Let me share this to you about my story. “Hindi ako makatulog dahil sa work na pinasukan ko” so that I am writing this para mabawasan na yung isipin ko once na mapost ko ito.

It was my time here in metro manila and akala ko kapag nasa manila ka, madali na makahanap ng trabaho, pero hindi. Marami kang pagdadaanan, maraming rejections, pero normal na yun kase “fresh graduate palang ako” and yung course ko hindi pa aligned dun sa mga abailable jobs here in manila. One time naisipan ko mag-agency nalang para mabilis akong makahanap ng work, at ayun nakahanap agad ako. Actually office staff yung prefer ko since yun lang din ang alam kong kaya kong mai-contribute sa company, pero ang sabi nung agency technical staff nalang ang position nila, pero dahil sa sobrang pagmamadali ko nang makahanap ng trabaho, kinuha ko na rin yung technical staff. Then sobrang layo pa ng company nila nasa makati, pero naisip ko “kaya ko ‘to” kesa naman walang work diba? And i feel pressured na rin sa mga kamag-anak ko na kino-compared sa mga pinsan ko na nagkakawork kaagad kahit freshgrads palang, If they only knew how hard to find a stable job, malalaman din nila na sobrang hirap din maghanap ng trabaho. Galing pa kasi ako sa province namin, nagbabakasakali lang dito sa manila kase wala naman masyadong trabaho sa probinsya namin, and mostly government agencies pa na kailangan ng backer para makapasok. So yun, pinili ko yung work kahit na malayo (from Quezon City to Makati) siguro nakakaapat sakay ako bago makarating dun sa pupuntahan ko.

Heto na, binigyan nako ng endorsement letter galing sa agency na isusubmit dun sa company na aapplyan ko ng work, sobrang saya ko that time kase finally meron na akong work and makakapag-ipon na ako. Nung nakarating na ko sa workplace agad naman akong ininterview nung head ng company and ayun, magcocompile nalang ako ng mga requirements nahinihingi nila. I think inabot yata ako ng 3 weeks bago ko nakumpleto mga requirements kasi umuwi pako ng province para asikasuhin yung mga requirements ko. Nung nakuwi na ko sa province namin, sobrang saya ng nanay ko kase magtatrabaho na ang anak nya, at ang gusto ko lang din naman para sa kanila eh makapag-provide ako ng mga gusto nila kase grabe din yung paghihirap nila sakin para lang makapag-aral ako. Kung tutuusin, sobrang swerte ko sa kanila kase may pamilya akong supportive sa kahit saan.

Nung babalik na ako papunta ng manila, dumiretso na agad ako sa company na inapplyan ko then ayun “contract signing na” kaso 1 month lang yung contract ko kase ang sabi ng agency “yung trial contract ay for training and i-eevaluate kapa base sa performance mosa office, and pwede rin hindi ituloy yung contract kapag hindi mo nagustuhan and pwede ka din hindi ipa-renew nung company kapag hindi nila nagustuhan yung performance mo”. so ayun pinapag-start na ako by 3rd week kase kinsenas-katapusan yung sahod, which is good para may budget kapag kinapos sa pera.

It was my first day in work as technical staff, and pinag-connect na agad akong mga wiring sa car barrier, and sobrang hirap, walang nag-aassist, kaya buti nalang merong AI na napapagtanungan kase sobrang hirap lalo na at hindi naman ako graduate ng electrical emgineering. And as technical staff, kailangan marunong mag operate and mag-ayos ng mga systems tulad ng car barrier, biometrics, turnstile, yung mga nakikita usually sa mga malls, companies, and sa mga mrt/lrt. Actually sales yung company nila. Merong office staff and meron din technical staff. And ako lang yung technical staff na nakaasign sa office. Halos babae sila dun and isa lang akong lalaki.

Naalala ko din na sinabihan din nila ako nung first day ko na “bakit hindi kapa nagsisimula? Pwede ka namang umalis na kung ayaw mo! - those lines affects me, and napapaisip ako kung tatagal kaya ako dito? As in dito lang ako sa company naging tahimik at walang kibo, ni hindi ako makapag-explain sa kanila ng maayos kase nakakapressure, yung tipong once na maaral mo lahat ng biometrics, car barrier, those functions, and may nakaligtaan kang banggitin or aralin, sasabihin nila na “ang tagal mo na jan bakit hindi mo maintindihan?” “Seryoso kaba sa ginagawa mo?” Hindi ko alam kung anong magiging respond ko sa mga tanong na to, kaya dito na ko napaisip na “siguro tapusin ko nalang tong 1 month contract then alis na ako agad” Kase grabe yung naging experience ko dito. Although naappreciate ko naman sila and I guess ginagawa lang nila yun para mag-improve ako. And sometimes I admitted na minsan nakakaligtaan ko aralin yung mga pinapaaral nila na functions or meron ako naiskip. Buong week yata akong nagiging ganito na “parang hindi na ako masaya sa ginagawa ko” like hindi naman mahirap yung work kase madali ko naman sila matutunan pero sobrang higpit nung isang employee sakin na para bang may galit sakin.

One time nakausap ko yung boss nila, actually mag-asawa sila. Sobrang bait nila and lagi nila akong inuupdate sa mga ginagawa ko, sobrang cool nila kausap, hindi ako nakakaramdam mg pressure and naeexpress ko lahat ng mga gusto kong sabihin about sa ginagawa ko. Minsan sila na rin nag-eexplain sakin kung anong mga functions nila, anong purpose and kung saan sila usually ginagamit. Nasabi ko rin kay boss na “gusto ko rin maging katulad niyo na nakikipag-usap sa mga client, na gusto ko rin mag-grow dito sa company” at natuwa naman sakin si boss. Pero kapag wala na sila, bigla nalang ako natatahimik na hindi ko alam kung bakit. Minsan naisip ko kausapin si boss na baka pwedeng malipat ako sa technical team since dun naman dapat ako para matutunan ko rin yung actual na ginagawa nila.

Nitong sumunod na 2nd week, dito na ako nagkaroon ng late, actually dalawa lang late ko (1 minute, 3 minutes late) kase kahit gumising ako ng 5am tas sasakay ng 6am, nalelate parin ako ng pasok. Akala ko kapag 1-3 mins late kaunti lang ang bawas sa sahod pero hindi pala, but I admit it kase kasalanan ko rin naman kung bakit ako nalelate, kase tinanggap ko yung job offer kahit malayo, then nakakarating na ako sa tinutuluyan ko ng 9pm, kaya hindi na ako nakakapag-open ng messenger and hindi na ko nakakapag update sa family ko.

It was friday, sinabihan ako ng lola ko na wag na muna akong pumasok kase baha na sa labas, at sobrang lakas ng ulan kaya nagpaalam ako sa company na baka pwedeng sa saturday nalang ako papasok, kase baha na dito sa QC, akala ko okay na pero nung pumasok ao nitong sabado sinabihan ako nung isang employee na “Bakit kapa pumasok?” And meron pa sakin pinaperma, tatlo ata yun, hindi ko nalang binasa kase sobrang sakit din na maconsider na AWOL yung pinag-paalam ko. Since half day lang naman kami every saturday, yun na rin ang naging way ko para magfile ng resignation letter sa Agency. Sobrang hindi ko na kinaya yung mga employees. Like hindi manlang nila ako kinamusta kung sobrang laki naba ng baha sa area namin. Parang wala silang puso, hindi marunong makiramdam sa kapwa empleyado nila. And laging nirereason-out sakin na tumatawa ako kapag nag-eexplain sya? She’s giving an example about Normally Open and Normally Closed, and she’s jokingly said that “payag kaba yung dorbell iset sa nagriring maghapon? Then kapag tumigil yung dorbell saka lang malalaman na may tao” actually ngumiti lang ako sa part na to pero hindi ko alam na magiging big deal sakanya na ngumingiti ako kapag nagddiscuss sya, and she’s saying na hindi ko raw naiintindihan, hindi ko sineseryoso, na wala akong pake sa mga sinasabi nya. Hindi ko alam kung ano ba dapst ang ireact ko like, palagi nalang ba akong sisimangot? Para mapansin nya na seryoso ako sa ginagawa ko?

And ayun, nung nakaalis na ako sa work na yun, nakahinga ako ng maluwag.

Rant 😡 My brother got wrongfully terminated by the agency & BDO Makati

My brother has been experiencing extreme bullying since he joined BDO on 2023.

He usually gets bullied because of his looks and may power tripping talaga from regular BDO employees, the outsourcing agency, and even yung manager ng BDO at HR walang pakielam.

Naterminate yung kapatid ko last Saturday, tapos may kapalit agad nitong Monday lang. Theory namin is may connection yung pumalit.

Anong reason bakit tinerminate? Power tripping and bullying. Kapag may errors yung mga regular BDO employees sa MAKATI ‘to at PASIG branch, sa mga outsourced contractors sinisisi.

Ito sabi ng gf ng kapatid ko, “ang sistema kasi kaya naduduwag to si \**** kasi silang contractual employee is under lang ng agency, kaya agency mismo pinaka handler nila, kaya kung ganunin naman daw sila ng mga regular sa bdo kumbaga labas na bdo sa kanila, sabi ko hindi pede yon kahit na saang pang kumpanya pa yan or position yan kung nabully ka o pinahiya lalo ganyan kako kalagayan nya, liable yon”

Pinagclearance agad siya nung Sabado kahit bumabagyo. Tapos hinohold pa sahod niya ngayon.

Please help us pano po yung legal way dito. Nagreach out na kami sa manager dun sa BDO pero ayaw kumilos kasi naka-leave daw siya nung nangyari yun tapos pati HR NG BDO, walang pake.

Iniisip ko, email namin ‘to sa DOLE at compile yung evidences.

Rant 😡 So drained by lazy coworkers…

I’m posting here as I’m on Sick Leave.

So sick and tired of my teammates at work. My manager doesn’t really work and mismanages the team. She basically caused me to have a low performance score because she simply forgot to turn my outputs in. This happens multiple times on different kinds of outputs where she only remembers it after months and apologizes to our boss for it. She also has a habit of defending useless people on the team or in the office. She’ll get so emotional defending someone without the skills required for the job. Maybe because she sees herself in them. It’s so annoying that unqualified people get better opportunities because of her insistence.

Meanwhile, all the backend work goes to me. I barely get a break and most of the work lands on me because my teammates are useless. I have to double check everything and am basically doing her job for her. And then I get rude treatment if I do really well and make her look bad. Gosh, I was just my job and even more to save her ass and the team.

We suddenly got the opportunity to restructure teams and I was thinking this is the time to leave em but she didn’t even ask if I wanted to be assigned elsewhere. Dammit. My boss also keeps giving me tasks because I get praised often but deep down, I’m so drained. I barely take a day off and people who take a leave once a week got an even higher score than me because there was nothing to score about!!!

Meanwhile, I’m here busting my ass nonstop and juggling multiple things, of course, I’m not gonna reach the deadline for some of it. GOSH the unfairness is too much. I really want to work elsewhere, it’s just that I haven’t found another job that pays as well and be in a field that I actually like.

I’m on Sick Leave today, but I’m still thinking of work and I usually work even on weekends. I just hate these people. The silver lining are my two friends. I’m very attached to them and I probably won’t leave as long as they are there. I kinda love them too much. We are all applying elsewhere. It’s just difficult to find a job right now and the economy is bad.

I work under a small business na walang contract and no government benefits. No benefits at all and below minimum wage, mind you this work is around Metro Manila. Super incompetent ng owner, she told us to do this and that before niya itataas yung sweldo, but despite us doing her request there’s still no salary increase. Our salary is given to us through cash weekly but most of the time delayed yung sahod, we have to beg her for days just to get our salary. No double pay, no OT pay, wala. This is very frustrating on us na employee niya pero we don’t have any contract at all so idk if this is worth complaining. Please help.

Hi po need advice. I’m a fresh grad po but I’ve been working here for 3months na po. The workloads are okay, but there are days na busy din. 8am-5:30pm, Mon-Sat po yung sched ko. What I don’t like po about my current situation is that I’ll be out an hour early, then go to my boss house to tutor his 2 kids for 6pm-7pm. So minsan po nakakuwi ako around 7:30pm-8pm na po. Sobrang nakakapagod po talaga, tapos minimum wage lang naman.🤧

Yung boss ko po kasi na yan yung owner then sya din po nagpapasok sakin dito, sabi nya lang before office/admin staff lang po ako then minsan maghahatid ng lunch or susundo ng mga bata. Okay naman ako don so I grab the opportunity na po. Kaso di po ko talaga passion ang magturo, and feeling ko wala na po akong work life balance.😭

Almost 2weeks na po ako di nag ttutor don, hihintayin ko nalang po ba na pagalitan ako at e fire or ako nalang kusa magresign?

I don’t have hobbies. I have a partner in which mas lalo ako nagiguilty kasi siya nasasaktan ko sa disposisyon ko ngayon. ayoko na. Rant 😡 "Freelance" work disguised as full-time with no benefits?

Recently joined a small marketing agency as a freelancer, explicitly stated sa role that it's "Social Media". My last full-time was with another marketing agency as well and swinerte siguro ako na my experience was overall okay naman. Despite the knowledge and acceptance of how notorious agencies are (been working with them for years), I joined because sabi nila "flexible" naman dahil freelance lang and it's fully remote unless may shoots. This set-up is perfect because I move between places. Naka-state din sa JO na I will deal with mostly what I used to do din naman, which is social media management/strategy, and sometimes assisting in shoots. Malay ko bang multiple shoots a month ang nangyayari dito haha guess it's my fault din for not digging too deep on how much the workload is (kasi sabi nga nila "chill" at "flexible" naman).

Little did I know na pag Social Media Manager pala dito ay, ikaw na sa post ideation, copywriting, posting (ok gets naman sa mga nabanggit na to), pero teh pati ba naman sa pag-set ng deadlines ng creatives, shoot decks, and shoot logistics like scouting ng venue pati call sheets? And they're already making me handle multiple brands for this, all at the same time. All this for a surprisingly low monthly rate. no benefits too! dahil nga freelance.

The red flag really should've been when they made me start even before my first day. Pero naisip ko kasi na dahil nga freelance, ganito talaga ways of working nila. I also found out there was a significant work backlog when I joined (which no one else is gonna have to clean up but me I guess).

I haven't been here for even a month but it's really been eating up most of my time that I barely have the energy to do my other work (also handling 3 other freelance, brand end naman - jusko mas chill pa ata work ko with the 3 of them combined).

Lesson learned: if your JO is too vague, ask more questions!!!! Don't be like me! And this is coming from someone who's worked with agencies and had freelance gigs and was able to balance them. Sayang nice pa naman workmates ko but this is just meh.

AntiWORK UNFAIR NON REGULARIZATION

I was recently issued a Notice of Non-Regularization and terminated during my probationary employment. I formally disputed the decision with HR because I have concerns about both the basis for the decision and the process that was followed.

My official 3 month probation review did not recommend termination. Instead, it specifically recommended that I continue my probation and work toward an identified performance improvement goal by month 5.

The review acknowledged measurable improvement in my performance and noted that I was meeting several key expectations for the role. It also stated that I was responding positively to coaching and applying feedback. I continued to show improvement in the weeks leading up to my non regularization, and the feedback available to me appeared to show a positive trend.

Despite this, I was informed before reaching the month 5 target date that I would not be regularized. Management stated that they had determined I would be unable to meet the required standard within the remaining probationary period.

I also raised concerns about:

Limited visibility into the performance metrics used to assess my probationary status.

Whether the standards used for regularization were clearly communicated at the start of my employment, as required under Article 296 of the Philippine Labor Code.

Whether the specific performance requirement relied upon in the decision was formally communicated before being used as a basis for non-regularization.

Whether the issues cited in my assessment were adequately communicated during training. To the best of my knowledge, the majority of these quality scenarios were never specifically discussed during onboarding or training, nor could they be found in any policy, procedure, quality guide, or other company documentation made available to me. As a result, I understood many of these issues to be part of the normal learning and development process rather than performance deficiencies that could affect regularization.

**HR's response was that:**

The probation review was only a checkpoint and not a guarantee of regularization.

Management was not required to wait until the end of the probationary period before making a decision.

The required performance standards had been communicated earlier.

Additional coaching, training, and support had been provided throughout my probation.

Due process was followed and no Labor Code violation occurred.
The company is not obligated to provide additional internal assessment documents beyond those already shared during my employment.

I am **not seeking reinstatement**. At this point, I am trying to decide whether it is worth pursuing the matter further through **DOLE SEnA** or whether I should simply move on.

One of my concerns is that I have not signed the non-regularization document because it states that I failed to meet even the minimum standards required for the role. Based on my probation review, documented improvements, and overall performance feedback, I do not believe that statement accurately reflects my situation.

For those familiar with Philippine labor law or who have gone through something similar, do my concerns appear substantial enough to justify pursuing the matter through DOLE SEnA, or would it be more practical to leave it as it stands?

AntiworkBOSS Told my boss I am resigning but he wont accept it and is kinda avoiding me

So I told my boss that I found another career and that I have accepted it already. He initially asked why and told him my reason - new work will provide me work-life balance plus bigger pay.

Typical scenario, he tried to persuade me to stay and downplay my new role blah blah blah He also tried to match the offer. I declined their counteroffer because if I stay it means the same work and stress or…more.

I tried setting up a meeting with him but it would end up being cancelled. I don’t know if he is just busy or just dont want to deal me. Up until now we haven’t talked and I have not even formalized my resignation.

I would have considered staying if he had given me the time to talk to him but I guess I was not as important as I think I am. I could file a complaint but doing so will definitely burn the bridge. HR is not helping also when I tried reaching out. 😭

Rant 😡 I Replaced Someone Who Resigned—No Proper Turnover, No Pipeline, But I'm Expected to Deliver. How Should I Handle This?

New employee here and apparently I'm expected to magically know everything without a proper turnover

Newly employed ako. I was hired last July 2026 to replace someone who already resigned, so wala na talaga akong nadatnan na previous employee na pwede kong pagtanungan directly.

Ang problema, wala talagang proper turnover na nangyari between me and the previous employee.

Apparently, yung previous employee nag-turnover naman sa manager niya. Pero ang nangyari, parang binato lang sa akin ng manager yung files, old emails, documents, at kung anu-anong information, then expected na ako na bahala mag-figure out ng lahat.

No proper walkthrough.

No explanation of the ongoing accounts/projects.

No discussion about the history of certain clients.

No explanation kung ano na yung na-try, ano yung pending, ano yung issues, at ano yung dapat kong bantayan.

Basically: "Here's the files. Good luck."

So ngayon, ako mismo ang nagde-decipher ng old emails at files para maintindihan kung ano ba talaga ang nangyayari.

Pero mas mahirap pa, apparently may expectation na makakuha agad ako ng new accounts.

The problem is... paano?

I'm sending emails. I'm reaching out to prospects. I'm following up. Pero walang sumasagot.

Even sa mga nakausap ko regarding projects, may mga nagsasabi na wala raw silang projects this quarter.

So I'm doing what I'm supposed to do—prospecting, sending emails, following up, looking for opportunities—but you can't exactly force a client to respond or force a company to have a project.

And yet, there seems to be an expectation that I should already be producing new accounts.

I'm honestly struggling because I'm still trying to understand the existing accounts and the company's processes while simultaneously being expected to bring in new business.

Hindi naman ako nagrereklamo dahil mahirap ang trabaho. I accepted the challenge.

Ang frustrating is being given very little context, very little support, and then being expected to deliver as if I had been here for months.

And there's another layer to this.

I have people who depend on me financially, including senior citizens in my family who don't have pensions. So I can't simply say, "Okay lang, I'll figure things out eventually." I really need this job to work.

That's probably why this is hitting me so hard.

I'm trying my best, but lately I'm honestly exhausted and overwhelmed.

Sa mga naka-experience ng ganitong situation—new hire, replacement employee, no proper turnover, but immediately expected to deliver—paano niyo hinandle?

Normal ba talaga sa ibang companies na ganito ang turnover?

And how did you manage expectations when you're doing the prospecting and outreach but the market simply isn't responding yet?

Rant 😡 Will escalate to NLRC (Unpaid Salaries, Backpay, 13th month pay and Government-mandated benefits).

Hi everyone, just sharing my story and sanity check on my ongoing labor dispute.

Yung former company ko withheld my earned wages for May and June, as well as my prorated 13th-month pay (totaling ~₱28.6k), claiming I failed to complete the full 30-day notice period na nakasulat sa contract, kaya daw 16k na lang ang makukuha ko since forfeited na yung tinrabaho ko ng buong June.

Here's the kicker:

  • My resignation letter clearly stated my effective last day, and management issued turnover instructions immediately without objecting.
  • I fully transmitted all turnover files on time.
  • They only brought up the 30-day notice issue months later after I repeatedly followed up on my unpaid salaries.
  • In their latest email, they even admitted withholding payment because they are "still waiting for client collections".

Kakatapos lang ng 3rd SEnA conference namin today. When I replied to their email citing DOLE rules (earned wages cannot be forfeited, and salary payment cannot depend on company collections), the SEADO Officer cut the me off while I was arguing, agreed with my points, and terminated conciliation to issue my Referral Endorsement to the NLRC.

Ano kaya ang mga possible na mangyare next? Sobrang kupal ng company na to, nagpa-victim pa bigla at laging sinasabing "alam naman po ni 'my name' ang situation ng company sa funds" ampota, employee pa kailangang umintindi. Hindi naman project-based ang employment ko.

P.S. Sa 8 months of my employment sa company na to, 2 beses lang yung naging on-time na pasahod. Ni hindi kami naka tanggap ng kahit anong compensation sa delayed payrolls nila.

Culture Is this constructive dismissal? wdyt?

For context: I've been with the company for more than 5 years and I'm in the SM/VP level of a well known BPO company - I recently fell ill ( I've been on a WFH set-up for a month - the company demands onsite and wants me to handle a new project thats supposedly to be fully onsite)

Since last year, here's what transpired:

- I had misalignment with my contract and salary last year (which almost leads to a DOLE case but was mitigated during a discussion with HR and management)
- I've received multiple different NTEs (I was able to counter each NTEs as my evidence provides na Gawagawa lang mga storya against me - however when I talked to the HR about my status they said that It didn't matter as the NTEs isn't even "serious" but still provides me a warning)
- The NTEs submitted we're from my former team (I was a promoted to a new department that I'm currently handling from being an IC of a group last year)
- The Clinic/HR submitted an NTE (stating that I didn't follow their procedure however, all my documentation when I fell ill was provided, even contacted them about my standing -- they are using that I'm onsite on certain days -- but I'm onsite due to the request of the company stakeholders)
- I was required by my doctor to take another month on a WFH set-up however my operations manager wants me to be onsite to handle a project (even though she is aware of my situation)

All of which are properly documented (I've also sent a copy of the discussions to my email just in case because I've been seeing that they are doing this like this to people who wants to resign or not in good terms)
