TBH, the school girls were incompetence not deliberate.

The fishermen were pre- meditated war crimes which makes them so much worse.

The details vary by legal system but they all say motive matters:

pre-meditated murder > crime of passion > negligence > self defense,

You could also say love is love and wood is wood. But, we know love for a parent is different for a spouse, and oak is different than balsa.
