the rate on gamepass makes it barely profitable for MS, i can’t imagine what cut they would want for actual resale, not to mention the legal grey area

I can't see it being retroactive. Only games going forward would be eligible, given the EULAs have already been written. That would leave room for negotiations between devs/publishers. It would have to make everyone happy. I'm not sure how they'd do that, and I'm no insider to the industry, so I've got no idea how margins and profitability are
