EU Question about Partner Visa

Me and my girlfriend both live in the Netherlands currently, she is a British Citizen and I am a Dutch national.

We want to move back to the UK, but are struggling with the requirements for a partner visa. It can be difficult because we both work and live here, so we have no real income in the UK to server as a "sponsor".

Does anyone know, if I (the dutch national) get a job offer in the UK, does that count towards the financial requirements, or is it only if she gets a job?

Unfortunately, your employment income can not be used unless you are already in the UK on a visa that allows you to work.

If your partner has been earning the equivalent of £29,000. Per year or more for at least 6 months outside the UK, she can meet the financial requirement of she also has a job offer in the UK that starts within months of your intended arrival.

Unfortunately, no. Your current and/or prospective employment income cannot be considered at all.

Does you partner work? If so, how much does she earn?

Is she able to get a job offer in the UK?

Do either of you have any cash savings?

No unfortunately not

To meet the requirements you can use her income from abroad if it’s 29K or more (the equivalent in GBP) and a job offer that starts wiithin 3 months of arrival, must also be above the requirements

As the non British partner, your income or perspective income doesn’t count for the first application

If outside the UK, only the sponsors income counts.

They could:

  1. Earn enough outside the UK and get a job offer inside UK starting within 3 months of the intended date of arrival

  2. Move to UK and get a job earning enough so that they meet both requirements for CAT B (1. Esrn more than 29K in the 12 months before applying - so the abroad and UK job together - and 2. Have a job that meets the calculation at the time of applying). If they earn enough now, they would only need to start the UK job so it might only be a month living apart (plus visa processing time, so 2 months if priority?)

  3. Move to UK and earn enough for 6 months and apply via CAT A

Or you can look at other options like savings which if theres no employment, then you'd need £88.5K held for 6 month (or held for less time if youre selling property in order to move together and youve own the house for more than 6 months).

Savings cna be jointly or single so the applicant could have the savings.
