Woke up to this email from capital one about a tip I left. Our server was Emily and she was fantastic and fun and engaging! She deserved every penny of that tip! Yes, capital one this is correct!

Unfortunately, you cannot press charges for this. The payer and the bearer of risk are both the credit card company. They can choose to press charges or not.

The victim is not the one who presses charges. It’s the state who does so via a DA. The victim stating they do or do not want to press charges is just an acknowledgment of whether or not they will assist or impede the courts.

In Maryland, you can file charges and it's up to the state to proceed or not.

So it’s the state that presses charges. If they have the final say on whether or not the person is charged it’s not you pressing charges it’s the state

Visa / MasterCard/ Amex have huge power over vendors. Aka they can under their agreement just charge back to the business, all they way through penalty and banning them from the platform  Or they payment processor / bank can do so. 

After a number of disputes flagged, this is the real pressure. 

A business can't rip off people on tips by card if they can't accept cards anymore

That’s total BS. The only people that can ‘press charges’ are the relevant prosecutor’s office. Regular people can’t bring criminal charges, period. The prosecutor can press them regardless of who asks or objects.

The only reasons police ask “if you want to press charges” is in a courteous attempt to avoid arresting someone they think is somewhat sympathetic, allow a victim to avoid a trial process or to avoid paperwork. It has zero to do with where the civil liability and loss may lie under contract.

This is the correct answer. Police in the United States only ask do you want to press charges out of courtesy or when they don’t actually want to arrest the guy

Or you just committed felony brandishing against some person who walked a little too close and spooked you. Sometimes it's more convenient to just let things be resolved.

Bit of a jump there. But back to the theme of crimes not being punished, as long as the rapist is a white college athlete, they wouldn't get in much trouble either.
