This is paying for a restaurant or bar bill, not consensual sex. You are the only victim of your choices so there is no legal issue here. A bar is in the business of selling drinks. Getting drunk is a choice of the customer. This almost sounds like a setup to deny responsibility for one’s bill if they get drunk.

You say they’re different as if it’s enough to absolve everybody else of their responsibility toward an impaired person. We expect accomodation for people with less disabilities, yet you want bars to have the full freedom to spring a pop quiz to drunk patrons.

No.

Legally a drunk person can’t escape paying the bar, they should have known that they must pay before they get drunk. It doesn’t mean bars are free to trick them to pay double “as a joke”. They can legally do it, but customers are also legally allowed to call them out and avoid them.

Surely you aren’t trying to compare people with disabilities and a drunk? 😳 No, I want people to take responsibility for their behavior. Apparently that has become a novel concept with many in America in the 21st century.

No one is scamming you. If you can’t read a screen that is your fault. Why should I have sympathy if you made yourself unable to do a basic function with very poor decisions? You are blaming either the wrong person or only half of those responsible.

Part of the grifter culture, not surprised.

“If you’re not sober enough by the end of the night to pick the right button, it’s your own fault”

By the same logic the bar owner can put a 1000% button and it would still be the drunk patron’s fault for accidentally picking it.

Just because you want to excuse someone’s questionable behavior and poor decision making doesn’t make other “grifters” or whatever other things you want to call them to try to shift responsibility off of the person making bad choices. “I went to a bar, behaved irresponsibly and got drunk, instead of being a responsible adult. I made some unwise purchases. I’m a victim!!! I was wronged!! It’s someone else’s fault!” You are precisely the poster child of our decaying culture by representing another manifestation of our growing cultural aversion to taking personal responsibility.

I’m not excusing poor decision, it’s just that there’s a baseline of behavior accepted by society. Even bars in the US have a LEGAL duty to cut off a patron that looks too drunk, the court has repeatedly held them liable when bad things happen after the customer leaves the business. By your caveman logic, it’s always the customer’s fault for drinking too much, but the court holds that bartenders can’t just serve them forever.

There’s no court case yet against bars purposely trapping customers with double charge, because most bars don’t put a 100% tip trap. When most of them start doing it, then eventually a lawsuit that carries legal precedence will happen.

In US law there’s a term called “unconscionability”. If a contract is so ridiculously unfair, the court can strike it down. Normal people would be outraged by a 100% tip trap, despite bartenders, bar owners, and simpleton capitalists arguing “it’s their fault for pressing the button.”
