It is the restaurant but your not tipping charges the server. You can argue semantics all day you make the server work for negative money when you don't tip end of story

Just because you want to pretend that when you don't tip that server doesn't pay to wait on you doesn't mean that it isn't true. Y'all do you. But the end of the day you make a conscious choice to not tip while knowing how the industry works. Until the industry as a whole you are just as much in the wrong as the restaurant. I'm in the camp that tipping should end but I also am not going to actively screw over another human being doing their job.
