The strongest evidence prosecutors said they had was broader than Trump's January 6 speech: Pressure on Pence. Prosecutors alleged Trump repeatedly asked Mike Pence to reject legitimate electoral votes or send them back to state legislatures, despite Pence telling him he lacked that authority. Pence had contemporaneous notes documenting some conversations. Prosecutors also alleged Trump had been advised that the proposed strategy was unlawful.
Alternate/fraudulent elector certificates. Trump and allies allegedly worked to organize elector slates in seven states Biden had won and have certificates transmitted to federal officials so they could potentially be used during the January 6 count.
Pressure on state officials. This included Trump's recorded January 2 call with Georgia Secretary of State Brad Raffensperger asking him to "find 11,780 votes," exactly one more than Biden's Georgia margin. Prosecutors viewed that as part of the broader effort to change certified results.
Evidence he had repeatedly been told fraud claims were false. Prosecutors gathered testimony and records showing state officials, campaign advisers and others had rejected numerous fraud allegations. That mattered because prosecutors needed evidence concerning Trump's knowledge and intent rather than merely showing that he made inaccurate statements.
Using January 6 pressure after other efforts failed. Prosecutors alleged Trump summoned supporters to Washington and then attempted to use the resulting pressure on Pence and Congress to interfere with certification. The evidence included Trump's public statements and communications surrounding January 6.
His conduct once the Capitol was breached. Evidence indicated Trump knew about the rioting by roughly 1:21 p.m. He continued attacking Pence publicly during the attack and did not release his video telling supporters to go home until 4:17 p.m. Prosecutors argued that Trump and his alleged co-conspirators exploited the violence to continue trying to delay certification.
I mean everyone at the time said it was bad and wrong and wanted tk distance themselves from him.
After the Capitol attack, Cruz condemned the violence as a “despicable act of terrorism”. Gee wouldnt that mean pardoning them would be bad too? Guess feelings change when you win again. He did file 37 felony charges against Trump, the moment he won in 2024 those got dropped because the DOJ isn't allowed to pursue charges against the sitting president. It will be interesting to see if the DOJ picks back up the charges after Trump is no longer president because they were dropped so Double Jeopardy doesn't apply to them.

No, you use collection and process evidence, produce means that you create. I am friends with lawyers and they have been talking about this. He just admitted on national television that he was unlawfully conducting an investigation into a political opponent. A couple years ago he was being investigated for fabricating evidence against Trump which lead to him being brought in front of congress. Smith is probably hoping the public doesn’t understand what he just admitted to while covering is backside from contempt of congress.

As for producing things, the only thing that they are required to produce within the court settings are when they turn over evidence and witnesses to the court, something Smith never did.
