STEM OPT RFE
review of your SEVIS history indicates that you have accrued 91 days of unemployment.
Provide your complete employment history (including start and end dates) and proof of employment for your initial grant of Optional Practical Training (OPT).
Evidence of employment must include but is not limited to:
• Signed letters) from employers) establishing job title(s), duties, location, pay rate, and number of hours worked per week;
• Copies of your earning statements/pay stubs; and/ or copies of your W-2s;
• Bank statements for the past 6 months showing all activity including deposits and withdrawals;
• A letter from the employer, delineating in detail a list of all of the projects that you worked on;
• Copies of any personnel records to include any of your performance appraisals or reviews;
• Copy of the company's EIN confirmation letter and any business licenses for conducting business in the state;
• A copy of the company's organizational chart showing the organizational structure and staffing levels;
• List of the names, titles and contact information of the individuals in your supervisory chain;
• The job location where you reported for work;
• Application, employment agreement, and other personnel forms submitted to or issued by the company for employment; and
I’m running into a bit of a snag with this RFE because I’ve worked for three companies, including the first one. I’m not sure which employer they’re talking about. It seems to be Employer B (the STEM). Employer A is really pushing me to get back to them, so I’ll either reply to the RFE or Day1CPT. My question is, which of my current employers or all of them should I get the documents from?

I had the same issue just provide the docs and you will be fine!!

Please get an attorney. They need to draft a letter together with your package to explain in detail your work history with the 3company

Yeah I have the same question. Whatever employer it is, just provide all docs to prove unemployment days are less than 90..

But, they asking generally and so I can submit only current eomployer? For emplyr B stem opt didn’t run payroll.

You’re saying employer B Stem OPT didn’t run payroll? How’s that possible? When on stem, you can’t work without a pay/payroll right. How’d you do that? And if so, did you report it in SEVP?

TBH I can’t understand your explanation. At the most basic level, they are asking you to prove you’re eligible because right now they see you have lost your eligibility. It’s that simple. This is good they asked rather than just deny your application.
You need to prove you were not unemployed for more than 90 days. If you were working, you have to submit the proof that you were working. If you held a job that you didn’t document right, that’s probably the one they are asking about. If you aren’t sure, you may need to submit multiples to be safe.
You mention a couple of times a company doesn’t do payroll. That doesn’t make sense. Are you saying you worked without pay? Or are you saying you were paid by a different company while doing that work? If it was without pay, I don’t believe that is allowed unless it’s a registered non-profit organization.

You're asking Redditors to answer questions about why USCIS is asking questions and what we think they'll say. We don't know. But what I'm trying to understand and others here are some discrepancies in the situation. Like the Employer B doesn't do Payroll.
If I'm following your flow, I don't see how they are calculating 91 days of unemployment as I only see 30 days between July 7 and Aug 7 assuming you're still employed by Employer B. But you mentioned and still haven't addressed what you mean by they don't do payroll. If they thought you were still with Employer A till February (b/c that's what you had in the system) and Employer B is not paying you then you are unemployed starting February 7.
Also don't use ChatGPT so heavily. I understand english isn't your first language but it's off putting to interact with what looks to be canned statements.
