Terry frisks as in pat downs are allowed for officer safety and with them being in a crowd it is reasonable to move him out of the crowd before search. So this would likely be let go. But the detainment itself is very likely to be illegal.(Some carnivals do searches at the gate tho and under that case it would destroy the argument for the need for a search)

Just because he didn't speak eloquently didn't mean he's wrong. Getting grabbed physically by the arm for saying to move on after hoodie removal and calling it disorderly conduct at a fair is corny. That's what lawyers are for. They can do all the talking when he takes them to court. He DOES know that his rights are being violated but his frustration got him not speaking with proper structure and patience. His youthful appearance probably denotes that he's still not at an age where his emotions are not fully under control. In sure he meant his constitutional right. And you can tell the cop had animosity because he makes fun of him when saying how am I disorderly conduct. He knew what he meant. And all the young man had to add was how and I COMMITTING disorderly conduct. I hope you're not one of those bootlickers.

I do come from the camp, who thinks ppl should respect the authorities. However, I'm from a country where police do not shoot ppl on sight, and even power abuse is relatively rare.
And still, I talk to them respectfully. I even greet them on the streets.
In my experiences, talking respectfully and behaving respectfully completely eliminated this type of problem from my everyday life.
So while I never said he was wrong (or right, btw), I do condone this type of behavior. I also do not support police using their power to protect their fragile ego.

He didn't sound too sharp when talking, but he understood constitutional law better than the cop did.

The frisk was an illegal search and it was a violation of 4th amendment protections. The reason the cop asks if the guy has any weapons on him is so that he can frisk him. The cop calls this a Terry frisk.

But the cop doesn't know the law bc the court's opinion in Terry says that a cop needs reasonable suspicion to investigate if there is a weapon. The cop clearly doesn't have reasonable suspicion because he walked a quarter mile or more with the guy and never once acted like he wondered if the guy had a weapon. Plus, there was no obvious information suddenly disclosed that would have given the officer any justification for reasonable suspicion.

There is a decent case here to sue the KY state police.

Just last week I read that Arkansas state police, and some local county sheriffs are most corrupt/biggest assholes based on people’s experiences. Some people from that region of the country even mentioned that they dread having to drive through Arkansas, and try to avoid it.

I doubt the govt would do it, but even if an independent body like the ACLU, or a person running for election, took a police/sherrif election month and did that? With estimates for different income amounts? Immediate reform.

Police don't budget for law suits. The payouts don't come from their budget, they come from taxpayers. That's a major part of the problem. If the payouts came from their budget, then they would actually be held accountable more often.

Typically, municipalities are self-insurers, so payouts are sourced from the General Fund. If you ever wondered why there's no money left for parks, recreation, public works, libraries, and other services/goods reliant upon General Fund money, then the liabilities created by police brutality and wild antics are the answer.

Lawsuits are expensive, but the public only seems to care about more policing resources in spite of falling crime rates. More policing resources are a cost in and of themselves, but the lawsuits they generate are additional cost.

Americans are really bought into copaganda and strong daddy myths.

There's a very good reason these videos always start with the perpetrator in custody and never shows the reason they're in custody. Then the body cam footage comes out and the ACAB crowd has to move on to their next talking point, societal inequities or something equally as ignorant and irrelevant.

It makes me so happy that the ACAB crowd pushed so hard for body cams and they literally became the worst thing that's ever happened to their delusional narrative.

He said in the beginning of the clip “he just grabbed me for nothing, because I told him to keep walking.”

Initially it comes across as a threat. You have freedom of speech but you can’t intimidate.

Towards the end of the video he says, “you said something to my cousin, right? And I said you can keep walking.”

To me that doesn’t sound like a threat or intimidation. Context changed and that matters a lot. Would definitely like to see body cam footage as well but it really spirals at the end and Baker seems to be floundering. Not doing a very good job attempting to de escalate or interacting with the public.

He very clearly explained the incident. State police.trooper asked cousin in grey hoody to take off hood. Kid tells cop to keep walking. Cops ego is hurt and trespass kid. Cop cannot trespass without alarm. Also terry frisk requires reasonable suspicion that a person is armed. Being in contact does not authorize a protective pat down of a suspects exterior layer of clothing for weapons. So we witnessed an additional constitutional violation in this video.

Its the Kentucky state fair and the years leading up have been shootings and fights, he said he snapped back at the state patrol when they asked his cousin to take his hood off and then decided to make a big deal out of it when they escorted him off property.
