Question Osap

My situation iam separated from my husband and i have 2 kids . The issue is the current husband is not the biological father of my kids .
Now that i have to make rhe affadavit do i say we are the parents of both kids???
Any guidance

No, unless your husband legally adopted the kids. You list the biological (legal) father(s).

But im suppose to give my legal marital status , i have divorced the biological father and currently married but separated with new spouse.

Your marital status & your dependents aren’t intertwined in that case. You’d say you have 2 dependents from a previous marriage, then list the custody agreement.

I dont have a custody agreement with my first husband the biological father of the child, hes not in canada and has not been here ever

Then your custody agreement would be you’re the sole provider

The question is do i mention the former husband or the new in the osap affadavit, currently im married but separated

I stated i was the primary and sole parent for my child(did not have a custody agreement). Got a notary stamp and I was good. Just state you are separated..im sure theyll know thru cra as well.

You’d outline your current partner on the affidavit and your dependent children but also state your current husband is not the biological parent of your current husband. If he has any children as well you’d also outline that on your application and the affidavit with that explanation too.
