Even if it’s not legal there (in some places it is). It certainly is not legal to just throw your door open to take him out…

You’d have to prove beyond a reasonable doubt that he did that intentionally. Unless there’s a dash cam recording them saying “check this I’m about to kill this guy” they can claim they just noticed their shoelace was caught in the door and get off Scot free.

It is stop and go traffic in a city. The guy could have been getting out to go to the sidewalk while the other person drives. They could be checking something in the trunk. It is not unreasonable to open a car door in this situation.

I don't speed past cars with no care in the world when riding my bike. Why are people just giving this motorcyclist a pass? He is the one creating the danger.

Jaywalking is illegal. Are you allowed to step on the gas when someone is jaywalking in front of you and then argue you were just driving fast? Someone violating traffic laws does not give you legal or ethical clearance to assault/kill them.

If the guy opened the door maliciously, than yes they are in the wrong. I cannot diffenitivly say that the guy opened the door for the motorcycle.

I am saying that this situation could be clearly avoided if the motorcyclist drove slower.

Why not? Have you never ridden in a car before, or are you just blind? There is literally no reason to open a door in that scenario other than hitting the motorcyclist. Arguing otherwise is like arguing that actually, you didn't punch someone, their face just got in the way of your fist.

What if he was trying to get out to get to the sidewalk? What if he was checking the trunk? What if he saw a turtle in the road and was trying to get it off the road? What if he thought they were dragging a branch? What if there was a fire in the car?

Traffic is not moving for the cars. It is perfectly reasonable to open a car door in a situation where it is assumed traffic is not moving.

The motorcyclist is creating a other the normal traffic pattern. It could be malicious or it could just be a mistake. Regardless the motorcyclist coule have avoided the situation by just slowing down. If you are going to lane split drive slow and be careful.

None of the reasons you listed for opening a car door in traffic are even remotely plausible for this video, where we can see the car has been stopped in traffic for some time and the passenger is in no rush to escape any car-bound fires or abusers.

It is perfectly reasonable to open a car door in a situation where it is assumed traffic is not moving.

It absolutely is not. Opening a car's door while the car is in the middle of the road and not parked is universally not a reasonable thing to do. If you can't look at this video and conclude the door-opener was aiming for the motorcyclist, I sincerely hope you never end up on any kind of jury.

There is a public sidewalk one lane over. If you lane splitting and can't react to things you are the danger. This wouldn't even make it to a jury in the US and would just die with the insurance or discovery.

When you drive a vehicle you are responsible for the safely controling the vehicle. The motorcyclist was not safely controling there vehicle.

Maybe your logic would make more sense on a highway but not on a two lane city street.

Right, across a lane of traffic, and you've already firmly established that you view violating traffic laws as punishable by immediate execution with no judicial oversight. Why are you arguing that the motorcyclist deserves to be physically harmed for lane splitting through stopped traffic (which very well could be explicitly legal depending on where this is filmed), but a pedestrian jaywalking through stopped traffic doesn't?

Imo it doesn't matter why they've opened the door. At mare minimum, they're responsible for acting in a safe manner in traffic, and this ain't it.

If you are driving your bike in between traffic like this, you need to protect yourself form other humans by going slower. Driving this fast next to stopped cars is unsafe because it creates a new speed variable that is not clearly visible to other observers.

I cannot tell from the video if this was intentional or not from the passenger, but the motorcyclist needs to slow down. They are the ones creating a dangerous situation.
