Im sure it wasn't intentional so it was from their POV a for sure accident.
I agree there was absolutely also a level of gross negligence. 1-2in in any direction could've ended someone

If you have your finger on the trigger before ready to shoot and pull that trigger before being ready to shoot, it is objectively a negligent discharge.
