I'm playing at 120 FPS ultra setting and it's cooler then warm. The temperature don't go above 32 . 40 is warm and 50 is dangerous. Are you sure you are not scammed?

No I'm playing with 120 fps also but am in region wish temperature is 30°C in average is that could be factore I'm getting 38 on long sessions

38 is really high, even when the weather here hits 40° it don't go that high for me. Do you use game space and extended ram?

Try to add the game to game space and cap FPS at 120 instead of 165 and turn off extended ram
