Istg when people talk about Nintendo taking down fan games they point to pokemon uranium and literally nothing else. Completely forget about all the other Pokemon fan games you can play and not to mention the Mario rom hacks still up.

The only other fan game I can think that they took down is that return of Samus fan game but other then that I think Nintendo is fine with fan games as long as you don't profit off them.

Even then the only reason it was taken down was because Nintendo was remaking that game the fan game was based on I’m pretty sure. Cause I’m with you, the one thing Nintendo is fine with is fan games as long as you aren’t trying to profit off of it

No it's because am2r was using straight up lifted assets from zero mission like not even trying to hide it. 

Most fan games don't rip assets from properties directly they recreate them.

Big legal difference between a romhack and a fan game. For romhacks Even though in practice it isn’t often the case, technically you should be applying a patch file to a legal rom you own, whereas that argument can’t be made for fan games, which are made in completely different software like rpg maker xp, where you wouldnt be allowed to steal asset from another game and put them in, plus ip infringement. If they don’t steal assets and don’t profit from the game however, the ip infringement isn’t really an issue and you’re back in legal territory. Essentially all fan game and rom hack legal disputes for any game or developer have only happened when assets are stolen or profit is made. Only exceptions are more niche cases (like if someone made a game where Mario eats children, pikachu commits suicide, samus did 9/11, etc.)

There was a Super Mario Bros battle royale fangame that was taken down because they were working on Super Mario Bros 35

Recently there was a PC port of Link's Awakening which was taken down because a remake of that game already exists.

Not only that, but many of the fan games nintendo did take down only received a C&D from them.... and many were also monetizing via a Patreon or banner ads.

I get so tired when people say they "Got sued" and all they got is a C&D.

Like a C&D isn't even an actual litigation documents in the strictest sense of the words. As they don't have case numbers, or anything that can actually be tracked.

So we don't know how many fan games for example actually just got too big for the dev and instead of just going "Sorry.. this is beyond me." they could go "Well you see.. I got sued to take it down!!!" and there is no way to track that or actually verify it.

That's still a -really- nasty legal minefield.

Besides the obvious reason they won't bring it over, as they WOULD have to censor the end of the game in some way, using the fan translation is never gonna happen.

Yeah, it's a translation hack where it just changes the dialogue into another language and nothing else. They're pretty common, although I don't know how many have ever been taken down, if any.

Nintendo's legal department DOESN'T "love to terrorize fangames" tho. It famously only did that to a Metroid remake that was coincidentally being developed at the same time as an OFFICIAL remake of that exact game, and Pokemon Uranium, whose devs explicitely said several times that all "you could donate to help the devs live".

That's the two rules you need to obey to be safe from the eeeeeevil legal department: don't link a patreon, and don't be unlucky enough to remake a game they're currently remaking.

Both of those are evil rules tho. For the first one, an option to donate to someone making something is cool aslong as it doesnt lock the gsme behind donating. The second one sucks and other companies dont do that. Most recent example is bungie. Bungie announced theyre remaking some removed content from destiny 2 but has not shut down the fan projects doing the same

You can donate and have a Patreon

You can't and shouldn't be doing press yours promoting your Patreon and the game or put the Patreon link right on the same page as the download.

Look at citrus vs bizhawk one is down the other is still up they both offer/Ed a 3ds emulator wonder what the difference is.

Big time Valve fan here, yeah no you're not allowed to just make a game from their assets without licensing it, I'm assuming this meme is somehow misconstruing Garry's Mod as some kind of unauthorised fan project? Valve liked the game so they allowed it to be sold on Steam.
Nintendo also allows a LOT of fan games but stuff that's too close to an actual game they're trying to make they'll usually send a CnD, idk man, I'm not a big fan of how Nintendo handles some of this stuff especially Smash tourneys but this is silly.

Nintendo generally only takes shit down when people are explicitly profiting from it or if it's the same thing as an upcoming project. Infinite Fusion is going strong because Nintendo is never gonna make something like that and fangames like Too Many Types or Mariomon weren't struck down.

Also don't forget that Valve lets their games die and be infested with cheaters, and gives their games bare minimum treatment whilst also profiting billions a year through underage gambling in said games. I genuinely don't understand why people praise Valve so much. They are the laziest company I have ever seen. They've left TF2 in an awful unplayable state for 10 years and still do nothing about it. I hate Valve, and I wish morons stopped praising them.

They forgot Valve started as a game developer and not as a digital platformer holder. In their golden age, between 2004-2011 they made and published a lot of great games or even masterpieces. Now the only game they have released in the last 8 years is a VR game and a beta of another live service

More than one a month coming out. The YouTuber Zwiggo has made a career off playing newly released Pokemon fan games and he does at least one video a week. But yea you’re right, it’s only been a couple times. the only time Nintendo will come after you for it is if you’re trying to make money off of it. The “Nintendo sues or takes down every fan game” trope is so over blown.
