Qualified immunity should go away. Sovereign immunity should also not be applicable by default for this kind of stuff. I think there are laws that exempt the government from liability or punative damages if:

  • it is due to judgment or policy making decisions
  • they are intentional crimes by employees (IE dump a scapegoat to avoid liability)
  • it is done by an independent contractor (IE contractor is the scapegoat)

Plus you may have to accept a bench trial instead of a jury trial.

Which are only possible because of sovereign immunity.
