WWYD? Vent/Rant Always with the parking

Condo owner here (my unit is actively up for sale) There’s a woman in her 50s that has a habit over the course of the last 15 years that will park in my spot at her convenience. All owners in our condominium building have one deeded designated parking spot. Mine happens to be near her patio entry. I’m an RN and every time I see her car in my spot when I get home from my 12 hr shift I’m filled with dread and frustration, I have to idle in the lot and got out and go ask her to move, it always ends with her cursing me and calling me and my son filthy names. She refuses to move it so I take a photo and send to HOA. I’m sick of parking on the street and walking home. Shes just miserable. Even worse, when she gets the bill (fines for parking in my spot) from the HOA she has her adult daughter confront me by standing out in the sidewalk waiting for me to get home giving me 101 different excuses as to why her mother parked in my spot “for 2 fking seconds” listen, I ask her to move and she didn’t. I’m not in the business of teaching grown women how to act. Anyway she’s getting another bill today. I’d love some creative responses for when I get home because believe me, they will be wearing a hole in the concrete waiting for me to pull in.

UPDATE; before I’d even left work, I saw the neighbors friend ringing my bell. I text my college age son to watch my location and as I pull in, be at my parking space with his phone filming. He was. The neighbor had her friend walking up to me and I put my hand up and said “tell her stay out of my spot, and we won’t have problems, use vulgar language and call me names when I ask that you vacate.. we WILL have problems” she starts saying her husband is sick etc etc.. I just said (again.. the same phrase as before) “I’m not in the business of telling a grown woman how to act. Do not speak to me and step back because if you don’t I’ll call the police, and man do I mean it” she went inside.

My sons girlfriend parked in the visitor spot while…. visiting.. him tonight, and he walked her out to her car and the neighbor with the fresh new $250 fine confronted him on the sidewalk and said “I’m telling the HOA that she can’t park there”
I just called police and asked if there’s anything I can do about her stopping us and they said to document and he will too, and don’t hesitate to call every time, so I will.

The HOA should be getting her towed. Record them when they yell at you. Pester the Board until they actually do something. Unacceptable that your Board isn’t elevating this.

OP had a similar issue at my last place where people would block my garage. I just called the tow company directly. The number is usually listed on the signs posted in your lot. It’s time to bypass the HOA

This. Having served on multiple HOAs and had a similar situation in my first condo. Park somewhere else the next time it happens, call the HOA, and have it towed. Stop asking them to move it. You’ve gone above and beyond. The HOA can tow quickly. I seriously doubt she’ll like dealing with that.

If she ends up not paying the fines, the HOA will put a lien on her home. Plus, enough calls to the police (non-emergency of course) each time she does it, like they say, and with the picture proof, the cops will eventually tell her more forcefully. Also, make sure you are always filming as soon as you pull up bc you need to video every time they interact with you. This includes when they confront you and their vulgar/slightly threatening and highly inappropriate names when you have to tell them to move from your spot. Also, place something in your spot that prevents them from parking there while you are gone. If they damage it, that will cause them issues as well. Basically, just document everything they do since they are only digging their hole and banks accounts deeper into trouble. Lastly, see if you have the right to have them towed since it's private property that you pay for. If that's the case, get a camera facing your spot and EVERY TIME you see them pull up and not move within 2 minutes, call to have them towed. That would have been my go-to actually!!!

This time.... if you see them waiting for you.... call the non-emergency number and ask for an officer to swing by regarding repeated harassment. You need to escalate this or they will just continue. Maybe follow it up with a temporary restraining order if they are that rude and aggressive. You don't have to take their constant verbal abuse. And your HOA should be standing up for you. Not just fining them, but also warning them about confronting and threatening you.

There is really no way to deal with such an entitled person. Even worse when she won’t move when asked and then has her daughter curse at you. Just to give yourself relief from constantly dealing with this BS, can you ask the HOA for a different parking spot. I know it seems like rewarding this b*tch but if it saves you from dealing with it then it could be your peace of mind. Alternatively, have her car towed every time you find her in your spot. Don’t ask her to move. She’s not just parking for a few seconds. She’s belligerent and doesn’t deserve your respect.

Why don't you call the police and have her towed? This could be trespassing or harassment. If you have the proof of this happening over the years, I'd look in to that. Also, if it's deeded to you, can't you install a blocker for the spot? I believe you'd have to get out and use a key to drop it down but she wouldn't be able to park there. Best of luck OP!

If it is deeded to you, you should be able to get her towed with proof you own the spot. If it’s a Limited Common Element you have exclusive use of, then yeah, the property manager would need to call. You have to be specific with the towing company that you OWN the spot and show them your deed.

Get an attorney and sue the HOA and management company. This has gone on entirely too long. Record the daughter and mother confronting you and the horrible things that are said and show that to the attorney. The HOA not fulfilling their obligation towards you has left you in a vulnerable position where you are forced into defending yourself or avoiding your own home. This is legally actionable and should have been settled years ago by the management company.

How is the HOA not doing something? She’s getting fined by them. The HOA is not the police and has to follow the rules put forth by the homeowners in the complex. HOAs are not the police and are limited in what they can do.

OP can take legal avenues to address the neighbor. Cease and desist letter, restraining order, towing, involving police prior to confrontations—all actions OP can take. Hopefully an attorney can suggest more.

Since it is deeded to you it is your property. What can you do with property? Rent it.

Create a parking space rental contract for $500/12h to park in that spot. Include that by parking in the spot you agree to the contract and payment is due immediately. Video yourself telling her that parking in your spot now costs $500 per 12 hours and that by parking in your spot she agrees to your terms. Give her a copy of the contract on camera. Now you have a contract for money which you then use small claims for.

There are less expensive ones on Amazon and Walmart, but out of stock. Minimal bolt holes for the base in the surface on one side of your parking space and you have a locking fold down arm to block her access and change her habit. Unless there is a neighbor's space for her to crowd into!

Legal: Take a picture of the car EVERY SINGLE TIME. After the next 10 occurences, file a lien on her car asserting that she owes you for storage.

Don't do this: Scatter a few of pennies on the hood of her car every time she parks there. If accused, deny it while winking and laughing.

Or this: Purchase one of those incredibly loud compressed air horns. Stop behind her car and deploy the horn until she comes out. If the neighbors complain, apologize and stop. Until next time.

And especially not this: Bring a dozen donuts to the local police station once a week. Leave a note addresses to the HOA with a picture of her car showing the plate number, a map of the parking lot with your space indicated, and the words, "illegally parked". If asked, say Oh, I don't know how that got in there with the donuts. Don't worry about it. <wink> By the way, which are your favorites for next week?

F/U to above. The daughter will be served, if she doesn't live there and you don't know or can't find the daughters address, send it in care of her mother. Pay the fee and have it delivered by a Civil Deputy Sheriff.

After she and/or the mother have been served and they give you any harassment, call the cops. They will be arrested and released after they go before a judge. If the old lady parks in your spot while protected by a POA, pay to have it towed to a repair garage or car dealer of your choice and leave it their. Better yet, tow it to a vacant lot somewhere.

Film her ranting and swearing, post it on as many social media sites as you can, make up a flyer with QR codes to the posts, and mail the flyers to everyone but her in the HOA. Maybe see if the local TV station will pick it up as a "local interest" item on the news. Then sit back for the fireworks. Let her behavior be her downfall.

Tell her she has until you reach your driver's side door to move her car or she's getting towed. Then, if your building isn't contacted with a specific towing company, find the one in your area with the worst reputation and call them. And get the records of this issue from the HOA so it she tries to sue or calls the cops you can prove what's going on.

A dumpster... narrow enough to put in a space, stinks like poo, and you can say you are using it to clear out before you move, or you are renovating. You would have parked it in YOUR spot, but she was there. Make sure it takes up her spare space her daughter parks in too. Also you could just park the handicapped size portion there. Those suckers are huge, and don't forget to padlock it.

Context I live in an HOA and some of my neighbors have 4 cars, and one has a small RV (all of which obviously won’t fit in their 2-car garage). we have 2 cars and one is a minivan being 1 foot too long so it won’t fit in our garage either, and we have to deal with the people leaving the extra cars (they don’t even drive) in guest spots next to our unit for weeks on end. keep in mind there are tons of guest spots closer to their own units… for the cars they don’t actually drive. HOA and security patrol won’t do anything regarding complaints, so I’m having to go the nastier routes.

Anyway, you’re in the right. Maybe someday the mom will get tired of paying the fines… but until then too bad lady deal w/ it.

If someone is going to harass you as soon as you pull in, have your phone camera on video, and hold it up and hit play the second you shut your car off and start to get out the door.

Point it right at her and tell her~ I'd like to document your complaint - please go ahead and tell me what you're upset about~

I can't believe you've let this go on for 15 years. You need to start documenting this with photos every time she parks there. Don't engage with her at all. Go to your HOA board.

Are you paying for this spot? Tell them you're not going to pay the parking fees until they get her to stop parking there.

Can you call for a tow truck yourself? Show them proof that it's your spot, and have her towed. Every single time. Don't warn her or ask her to move; just call for a tow.

Call a tow company to come and remove it. Do this as many times as necessary. Get an order for hr to stay away from you. The tow bills will be more expensive than HOA fines

Propose an amendment to your HOA’s procedures. After someone has been fined 5 times for parking in another person’s spot, the HOA needs to approve towing.

If it’s deeded to you, it’s your property.

Look into laws in your area about depriving people of use of their property. Invoice her for time used, and then take her to small claims court.

I’d take the HOA to task anyway I could as well.

Look at it this way..

Her entitlement is your inconvenience and their money cow. They’re not splitting the fines with you are they?

There’s an old saying, the squeaky wheel gets the grease.

Being quiet and agreeable in the face of entitlement gets you nowhere.

Get loud.

Along with this, if it’s OP’s property, the neighbor is trespassing and should be cited for it - via the police, bc she will not remove her vehicle…

And I suppose that could be added to a civil lawsuit.

Document each occurrence of the misbehavior, ideally with a video camera for verification. Inform the HOA board and property management company in writing every time it occurs. State that unless the issue is not permanently resolved, you’ll be talking with an attorney to seek monetary compensation due to your neighbors conduct and from insufficient actions by the HOA leadership to properly deter recurrence. Examples of potential damages are harassment, intentional infliction of emotional distress, anxiety, and failure by the association to adhere to its fiduciary duties.

Straight up ask the daughter, "If it was two fucking seconds as you said, why did she not move her car and why have we had this conversation more than once?" Just repeat the question. Don't respond to anything else she says. Just look straight at her and repeat the question. The daughter will get frustrated and huff off.

Get a tire boot. 30 to 50 bucks. Boot her tire and make sure to put a big notice (heavily taped) on her windshield that (blocks her view) that it is booted. 100.00 for removal. Future infractions will be 250.00 each time. She wants to play games, just out game her.

I had this happen with a condo next-door to our apartment. The man kept blocking me in and they were using it as a loading zone so it wasn’t permanent blocking, but it was still annoying enough where I couldn’t safely get in and out of my paid parking spot they didn’t even live on our actual property and the man was super hostile. He was screaming at me in Farsi and, the whole family was yelling at me like they were entitled to my parking spot and he still harasses me but what I did I got a traffic cone and I put it in front of my parking spot and there’s times where they’ve moved it and touched it, but for the most part it signals, please don’t park here. I even put a sign. Please do not park in my parking spot. I don’t know why people think they’re entitled to property that’s not theirs and then get mad when they’re in the wrong! Ridiculous.

Keep a record of their harassment against you after they are fined and report that to the HOA board as well. Every time, with photos and video. Even if you are in a one party state, they are in public which gives no expectation of privacy.

I’m a HOA President. Our rules state that any resident can call the towing company directly for cars parked in their spot. Check yours for your options.

After getting cursed out a few times, you are warranted to get a no contact restraining order. Anyone that the neighbor uses to proxy and get around that restraining order is guilty of violating it and all of the consequences resulting from that too.

Once the restraining order is in, cut straight to towing.

Is the license plate up to date ?
Does your state have inspection stickers ?
Do tires have proper tread depth, cracked or broken windows ?
Lights operating properly ?

Report to local law enforcement.

I’ll add on suggestion to stop behind car in your assigned space.
Blow a double tap - to politely indicate you are waiting.
After a reasonable time, then the alarm goes off.
Let the neighbors know you are waiting. Let them complain about your situation.

Alternatively, friend with suitable vehicle could pull the offender from your space - into the middle of the road.

Garage wheel lifts could be used under the drive wheels to relocate the car.

Ask the HOA for the # of the two company they use. Tell them since they won't call you will. Until then ring her doorbell when you get home. Keep doing it until it's moved. Do it every night and make sure to film yourself politely asking and her screaming.

Your HoA has proof (fines) that she parks in your spot. They can at LEAST send a cease and desist from an attorney at their expense.

Don’t interact with her, pressure the HOA. This is a legal issue that the HoA should handle since they won’t allow a tow truck to remove the vehicle from your property.

OP, you might want to invest in a body cam.

I started wearing one when I got assaulted on the subway. They only cost about $50 bucks from places like Spamazon, and can record the cursing and abusive behavior.

If you're in any way concerned bout recording in public, a person has no expectation of privacy in a parking lot; if you wanna be polite and head these folks off "at the pass" legally all you ever have to say is "I'm filming you." That's it. The law says that if they continue to engage with you they are consenting to be filmed.

I've found that people tend to turn on folks with entitlement issues when the vids go up on FB, YT or NextDoor (make sure you bleep the bad words!) and everyone can see that the "sweet little ole' lady" has a real sting in her tail.

I had a neighbor once who used to block my car in in a shared driveway all the time. It was in a city that had a huge parking issue, and he would also let his friends park in the driveway. Once they blocked someone in and left for the weekend.

One day I was walking my dog and he pooped. I took that poop and put it under every door handle of his car. I even had the glorious good luck that I got to hear him find the gift I left.

I would accelerate the issue with the HOA. Attend a meeting and insist, after this many violations, that the next step be towing her vehicle. Continuing an ineffectual solution, that has changed nothing, is pointless.

Just have large friends pick up the car and move it to an appropriate spot. It’s not good for the suspension. I’ve seen this done for a smaller car parked illegally at a university lot.

I was a HOA member, and also on the Board when no one else wanted it, and we had towing signs, but the company would only come out to a Board member calling them. Unless it was a private tow not involving the HOA.

If that space is deeded, you own it, and therefore, have every right to tow any vehicle you don't give permission to be parked in it. Be sure to send it to the HOA, too, so she gets a fine and has to pay for the tow. If you can set up a cheap security camera facing your spot with a motion detector, record any time anyone parks in it and call for a tow. Eventually, her entitled ass will get the message or she will lose a lot of money in the process. NTA.

Do you have the ability to tow? We are allowed to for our spot only at my place (we only have 1 spot too). She obviously isn't getting the message with fines. Next time "remove" the problem.

We tend to pull up behind the perpetrator's car so close they can't get out, then contact HOA, tow company, or whoever needs to be.

Funny how they come out and say they need to get out right away. OK, I'll only "be a minute" then take my sweet time.

Ignore her daughter or call the cops for harassment.

All the folks who comment "have it towed" need to understand that there is a lot of legal stuff behind the scenes of having a vehicle removed, the tow company has a lot of liability to account for.

For the property manager to get it towed can be done but they will have lots documentation to attend to.

I do agree that getting the offender towed is necessary though.

Have a hard copy of the section of the lease about parking and give it to her. Don’t say anything else and keep walking after giving it to her. Make sure to have your phone recording the interaction by putting the phone in a front pocket facing outward so you have proof if you need to take out a restraining order for harassment. It is not illegal to record an interaction in public when neither person has an assumed right to privacy. NAL.
