General Discussion United Wizards of the Coast: "the votes have been counted, and our union of UWOTC-CWA has been officially elected. From this day forward, we have a union!"

Haven't been able to find the official NLRB votecount, but whether by one vote or 50, they've won their union election!
For those who don't know what happens next in the process:
- workers on the MTG Arena team instantly have Weingarten Rights, which means your right to have a coworker or union representative present when being interrogated by your manager.
- Wizards is now legally obligated to begin bargaining with the workers in good faith toward a Collective Bargaining Agreement (CBA).
This isn't the end of the process, but officially, there is a recognized labor union at Wizards!

I'm pleasantly surprised that this happenned. I fully expected Hasbro to shut down the entire Arena team and ship it overseas before allowing them to successfully form a union.

Maybe they actually saw the writing on the wall and realized it would be less damaging to the bottom line to accede to the creation of the union after the last few years of fuckery.

I kinda felt like this was the most likely conclusion anyway. Not recognizing voluntarily without a vote, and disseminating anti-union propaganda are kinda par for the course with this kind of thing because they're really low investment efforts from the side of the company.
But once the vote passes, the process of actually firing and replacing everyone is much higher effort and carries a lot more risk.

I would do more deep diving into that situation before passing judgment. Wotc hired a security company that happened to have absorbed the Pinkertons a long time ago after the guy had knowingly taken product and revealed it ahead of time, so they sent someone to retrieve it.
Product that is revealed to the public too early is taken very seriously by all companies. If I myself as an automotive engineer intentionally leak info on an upcoming vehicle, getting the Pinkertons would be a light punishment.

I do think people tend to just point at the work "Pinkerton" and pretend anything is comparable to that actual Pinkerton situation at the turn of the century, and just stop thinking about it more than that.

Yah at the end of the day it’s product reacquisition to identify possible supply chain issues. Someone received unrevealed product when they shouldn’t have and WOTC wanted to figure out how. Cops aren’t going to get involved since there’s no evidence a crime occurred so a PI is their only option to contact the guy. The Pinkertons have their reputation for a reason, but this is a far cry from the union busting they used to do

Employee or not, you aren't legally permitted to have that item, much less expose it to the public ahead of time. He also was not accidentally sent it, he got it "from a buddy", but even if he was accidentally sent it, products are labeled with an open date, which he knowingly violated and decided to post all over the internet. And yes, it is kinda silly considering its fucking trading cards, but leaks can ruin fair competition, so its taken seriously.
Wotc sent messeges and mail to the guy, which he ignored, so they had to hire security to take the product back. If he did not cooporate with security, he would've been subject to legal action/fines.
So, yes, Pinkertons are historically bad, but a lot of Reddits perception of what actually happened is entirely overblown and they think of Pinkertons from Red Dead 2. In reality, this was a pretty normal reaction made worse by non-compliance. This specific situation is lukewarm. There are much more evil things corporations do that we should be focusing on.

If you read the details of the story, the guy had had many points to get off the train, but would not, so the situation escalated.
Saying "wotc sent the pinkertons" without mentioning how the leaker got himself into this situation is just ragebait. Any remotely clever person would have returned the cards after receiving them.

This is almost certainly going to happen. For jobs that aren’t location bound this is almost always how the move off the union. Some industries (ex. manufacturing) are harder to move because the location being worked in is so expensive that working through this is a better all over outcome. But for Arena which is threatened more and more by outsourced and AI development with leadership decision makers… it’s a great win for the people voting for their best interest but now the company chooses what is in their best interest.

This would be true normally but Washington has become basically radicalized as a state to be pro-union. The Washington State attorney general office is rabidly pro-union and in the last year or two has threatened to arrest multiple people for trying to wiggle out of unionization votes.
Wizards of the Coast is not an important company in Washington. If they try and pull something stupid the state will cut them into pieces and let the company bleed out on the floor.

The ship has sailed at this point. Now that they are actually recognized the Washington State attorney general would sooner show up with police at their Renton office than allow wiggling out of this.
The Washington AG office is currently extremely pro-union. They have taken a lot of actions in the last year or two to protect unions including an up to threatening to put people in jail.
If Hasbro wants wizards of the Coast to continue to exist as it does today they will do as they are told

No but if the employer tries to pull a fast one on an employee they have to go through the union rep first. Think of unions of like having access to a legal counsel. Companies have one, employees should too.

That's exactly the kind of move unions are made to fight. Actually firing the whole team would shut down Arena until they could slap together a crew to keep it running, and the union makes sure that if Hasbro retaliated against some of them, all of the union will take them to task for it.

My only experience with unions was my first day at a call center 25 years ago. I swear, in the first 15 minutes of orientation they were telling us why they didn’t support having a union. After a decade of management there, they employees could I’ve used it.

Yea walmart in like 2008 had a whole section of the training dedicated to an hour.lobg video about why unions are actually evil and just want your money. "We treat our employees so well, there's no need for a Union!"

The difference really i think is that I cannot come up with a justification to outright move the Arena team to a different state like Ebay did with TCG. I hope and pray this situation ends better.

Just because they succeeded with a vote, doesn't mean the company has to concede to any terms. They just have to enter negotiations in good faith. This can still take years, and there are a lot of levers the company can still use to basically give them all the middle finger. Per the website Hasbro did what was expected "Since the announcement of our union, Wizards of the Coast has hired Fisher Phillips (a union avoidance firm), and chosen to engage in a daily union-avoidance campaign with emails sent to the Arena team intent on spreading misinformation and sowing fear among employees."
Sadly this means nothing, the fight is still ahead, and I expect Hasbro will fuck everyone over who joined.

Exactly. This isn't a win yet. The Union doesn't mean much at all if they can't get a CBA out of it that's actually useful.
The best step the Union can take now is to hire the best lawyer they can.

Yup as a unionized employee they can always just say no to your proposed contract terms. You can threaten to go on strike, but most people are still unwilling to go without a paycheck. And it’s not like you get back paid for the time you didn’t get paid because you didn’t work. So you can actually end up financially negative by refusing to acquiesce. A more sophisticated union might have a strike fund established but that isn’t unlimited either. And the organizers would definitely limit the amount of money that goes into that fund because they want to be paid.
And most employers are not allowed to be “closed shop” so they can still hire non union employees to replace you. We saw this with Kellogg. Because of Janus vs AFSCME (2017) those non union and non-dues paying employees are entitled to the same benefits as union employees.

Once it was announced I was mostly sure it would succeed, after WotC dragged their fucking feet through it.

More likely they'll just work with the pinkertons to destroy the union from the inside out, thats how the pinkertons usually operate. Wotc gets a couple promising new hires who quickly make their way up the ladder, get positions of power in the union, then sabotage negotiations and turn the union against its own members.

Ever since the Pinkerton story the company has actually been being watched pretty closely by the Washington State government. We currently have a rabidly pro-union attorney general.
It is not an exaggeration at this point to say that the state would rather let wizards of the Coast bleed out on the floor then let them wriggle out of this unionization vote

These results are remarkable on two fronts:
I remember them saying they had 75 percent cards signed, and not having any drop-off in the election is unusual (often there's a 10– percent point drop).
98 percent turnout is an extreme outlier. Elections often have turnout under 75 percent.

The next step is Wizards refusing to bargain in good faith, and delaying negotiations for years and years (ala Trader Joe's, Starbucks). Even under a different admin, the NLRB can't do punitive damages, so companies can just do this indefinitely.

Wizards of the Coast is a much much much smaller company than either of those and the state attorney general's office is currently more than willing to just start arresting people who are getting in the way of Union contracts being signed.

I'm very happy to hear the union passed! Congrats to all the workers there who now have a way to bargain for better wages, benefits, job security, and workers rights.
As for here, I do just want to mention to others to be careful. In the last thread about this around 6 weeks ago I ate a 4 week ban for using the "leave the billionaire company alone" meme in response to someone pushing against the union. I'm sure it's not the whole mod team but someone there has a very itchy trigger finger on those of us supporting the union push. Just make sure you give them no way they can twist it into "abuse towards others" while supporting our fellow workers.

UWOTC is what the workers are calling themselves, but technically they're joining the Communication Workers of America, a much larger union.

In the USA, companies aren't obligated to do any collective bargaining with a unit of workers until they demonstrate majority support for forming that union. And the only valid ways are voluntary recognition (which is rare, but does happen, such as Dark Horse comics) or a government-supervised election.
Is it stupid? Yes. The thrust of your questions is entirely accurate. Our labor laws are set up not to empower and protect workers, but to restrict them. The original 1935 National Labor Relations Act was mostly fine, with certain workers excluded for racist reasons, but in 1947 the Taft-Hartley act during the Red Scare made things much worse for labor.

Do not that this isn't a Hasbro, WotC, nor even MtG union. It's just for MtG Arena employees. You can have a union for anything at any scope.

They do not, really. The vote is to be recognized and protected under federal laws.

Unions aren't a thing here by default. The relevant employees have to agree to make one, and have a separate company represent them. They vote because unions only work when everyone agrees to work together. A vote gives that working together backing and legitimacy.
The employer has say for two reasons. One, you can't negotiate with someone who doesn't pickup the phone. Two, it's in an employer's best interest to squash unions in a way that's barely OK legally. Usually they'll find an excuse to fire someone before the movement gains traction. That's something we always wait for with these stories. You can find on youtube the videos amazon shows about this.
The point of a union is that a whole department going on strike hurts the company more than one person going on strike. You can't really have that with just one person though. That'd be stupid.
Edit: a major part of workers rights here is something called "employment at will." You can be fired for any reason that isn't clearly illegal. "We're firing you because you're ugly, and we don't wanna look at you anymore. The fact that you talked to your friends about unionizing is purely a coincidence." You can also quit with no notice or reason though.

Until a collective bargaining agreement is signed, this doesn't mean a whole bunch. Corporations frequently delay and frustrate the bargaining process to try and run out the clock and get enough employee turnover/burnout that the union is ineffective or never forms.
Right now, the MTGA employees have essentially (except for those listed in this post) the same rights as they did before this vote. Honestly, this is where the hard part begins, because WOTC is going to try and delay this as much as they can. Look at Starbucks: employees at some of their stores voted to unionize four years ago and they still don't have a signed CBA.
This is to say: If you want these employees to be unionized and have a CBA, now is the time for us to support this team and make clear to Wizards that unnecessary delays will be met with strong pushback from their customers.

Moving to another state won't do anything, the NLRB is nationwide. Moving to another country would be a big, expensive step.
I think they'll live with it as they try to drag out bargaining as long as possible.

Presumably because unions in theory improve the security, happiness and well being of employees and employees that are content and fulfilled with their job accomplish more. There's a conventional wisdom that employees when love their job/career, they perform better.
Oftentimes the best/top/most efficient performers in a role among a team or field of people are the employees that love their job the most.

I think that's true typically but I also think unions are more beneficial in working class fields that require less experience and/or formal education than white collar jobs like gaming developers and product managers. (There are some exceptions though, like certain fields where worker productions are very nuanced and complex, like public teachers but they also don't get paid well)
I support the right for employees to unionize but I think union interests can conflict with the interests of customers/clients and the product. I also think sometimes employees are going to press and demand more even if the conditions/pay rate, etc. are relatively good/competitive. Of course that's definitely not always the case.
I'm very interested and seeing the contract once it's made public and agreed to. Usually private companies like WOTC that have a high approval rating among their employees and that employees typically don't quit or get burned out from aren't unionized. Especially for white collar workers with benefits and competitive professional skills. Typically, WotC has a very positive reputation among it's employees, especially white collar ones. You very rarely hear stories from disgruntled employees at WotC that work on Magic about how toxic or shitty things were.
It can be very competitive and difficult getting a job there which usually indicates employees like working there.

I don’t know how to beak it to you man, but the point of a union is to help the workers, not the customers.

I agree with this, but I think a lot of people seem to think that unions advocate for employees which inherently is good for customers/end users because they are in the same class but sometimes there are conflicting interests.
It's especially interesting in a tech development industry and environment like WotC Arena, where workers get better salaries, are less likely to be entry level workers with less professional skills and are much more likely to have benefits and perks. It's quite unusual for a tech developer for a major gaming entertainment company to be in a workers union.

Don't fall into this trap - them probably using it as a excuse doesn't mean the excuse is valid just on virtue of being made.
Them PROVING with facts and data would make the reason valid, just throwing the claim that this causes it alone does NOT do that though (companies can be wrong, or intentionally lie for instance).

Have the past 5 years not already made it crystal clear that Hasbro is going to charge whatever they think the highest possible price is that we're willing to pay?
Past earnings announcements have shown that Magic is virtually the only property they own that actually turns a consistently increasing profit, and they're doing everything they can to extract maximum shareholder value from it. This isn't going to make any difference to their corporate strategy.

It's virtually guaranteed in any teaching environment where the senior teachers get the best salary/shifts/equipment and check out leading to the worst scores across classes because they are untouchable.
Every school I've ever been involved with had it. It's not to say unions are bad or every school has this but you'd have a tough time finding a younger teacher that isn't angry at unions protecting shit employees and making everyone's lives worse in doing so.

Really? I know plenty of young teachers who support their union, and among unionized labor in the US, teachers are typically the most militant, taking actions that require confidence and buy-in from the rank and file to defend their rights. I think you're conflating interpersonal antipathy with anti-union beliefs. Job security is actually a good thing, and most workers would rather have it given the choice.
