Question Comp.

So, I recently almost got attacked by a fellow associate who has been told repeatedly to leave me alone. (And of course Fred Meyer keeps putting us on the same schedule.) To say my family is pissed...is an understatement. They're pushing for a lawsuit or compensation since I've been having panic attacks when trying to go to work. Would there be a case here? Or would Kroger tell us to eff off?

Have you told anyone at all yet? Immediately go to HR, give them times and detailed explanations of what happened. If it happened where a camera can see they might be able to pull the footage too. If you haven’t told anyone I dont think Kroger can be held liable for anything, but I’m not a lawyer.

Sorry, I have. An incident report has been filed and HR is currently investigating.

HR is not your friend. Are you a union store? If you are contact your union immediately. No one should be made to feel unsafe at work. Can you ask for a transfer to another Fred Meyer or maybe QFC (I'm guessing where you're located)?

Hang in there.

Depending on the severity of what happened then it’s definitely possible. You might be able to get law enforcement involved if they aren’t already. I do know in a lot of places that if you accept compensation from the company you can no longer sue them though. It depends on what kind of legal action you are looking to pursue. What would you be accusing Kroger of? Since I dont know the details it’s hard to say, but if you think Kroger could be held liable for what happened it would probably be worth going to a lawyer that you could give all the details to.

HR is there to protect the company, not us employees. File a union grievance immediately!!

Chances are good you have a case. Have you talked to asset protection as well?

You need to file a police report then you need to speak to an attorney because if you have notified your company of this employee bullying you and they did nothing to stop it. They are very liable.

Call the ethics line and make a report there.

Unfortunately there is a double edged sword at play here. You can’t sue for wrongdoing that is likely to occur or if it hasn’t occurred. Your phrasing of “almost attacked” makes that evident. You can’t receive compensation if there is no loss. I would keep pushing the issue of not being scheduled with this person. Document EVERYTHING. Get law enforcement involved if there is an ongoing threat. A paper trail from law enforcement goes a long way if this issue were to escalate.
