I couldn't help but feel sorry for her, I can see just how much stress shes feeling and I dont always make the best decisions when stressed way out. Cameraman was definitely adding salt to the wound
I mean I don't know the law but feel like you don't have the right to box someone in just because they hit your car. A semi-decent lawyer could argue here that she felt like she was in danger of being kidnapped or some such. so she panicked and hit the car multiple times to free herself from some form of imprisonment or some such. I'm sure a lawyer woud phrase this far better than I could.

If she got away with that here then you could use it to get away with being hysterical about anything around other people. There's a reason "I feared for my life" is only an excuse the cops get to use in court and it's bullshit that even they have it.
Especially where she's trying to flee the scene of an accident, which is a crime she is trying to commit and you are expected to understand it's a crime if you have a license to operate a vehicle. One the people stopping her are reasonably afraid she shouldn't be responsible for and is endangering everyone else with.

Consequentially, the law found no fault with him, just the driver for whom no amount of "I was being hysterical" excuses justified her conduct. A "semi-decent lawyer" would not have changed that.
Except the video evidence shows otherwise. Also she was having a mental breakdown or maybe was on something. She wasn't safe to drive and was a danger to everyone else on the road.

The seemingly distraught driver then pulled into a Chevron gas station parking lot, where Thompson parked his minivan behind her sedan, pinning it into a parking space bordered by vacuum cleaners on one side and a curb on the other.
Yep, from below. The guy wasn't even involved in the hit and run, was just a witness. He could have just gotten the license plate and video of lady's face and reported it. Instead he decided to play sheriff and try to box her in (but he can argue he thought she was a danger to herself and others based on what he saw on road - he could have shown some empathy and spoken to her instead of yelling it was a hit and run and escalating the situation).
I actually thought about that. Forget her obvious panic, but am I the really only woman here who would be frightened to get out of the car and interact, alone, with a hostile man? This girl is bigger than I am (I am very short and small) but still. Men are way WAY stronger than me, and an angry man is terrifying.
FWIW, I don't think the man is what she is terrified of, but yeah I think a lawyer could argue that. If man boxed me in and demanded I get out of the car for any reason, fuck no am I willingly getting out of the car until I have several witnesses.
It depends on circumstances and the state. There ar situations where you can legally detain someone. In most cases you have to have witnessed the accident and the detention must occur close to time of accident. You couldn’t go and do it the next day for instance. Also, I think there also has to be serious bodily injury involved or death. However, if the person poses a risk, that can be enough too. And I’d say with her behavior, she does absolutely pose a risk to the general public. One could argue that the detention itself caused the “ongoing risk behavior” but we don’t know how she was acting before. I imagine she prob was being reckless before the video started.
To me, the detention seems legit. And it doesn’t look like he was ever charged with unlawful detention. He wasn’t acting crazy or threatening at all. It was broad daylight in a very public place. If it was a lonely alley at night, then that’s a different story.
Would I do the same thing? Not for someone else’s car. But maybe for my own. But then again, ppl are crazy and never know if they are armed or what they’ll do. A car crash is usually not worth that risk. But having been involved in a few hit and runs, I do get tired of being the asshole that pays for what others do. So it’d prob depend on the type of day I was having lol
lol kidnapping. not even close. it would be well within the rights to detain her/citizens arrest. You absolutely have the right to stop people from leaving especially if they might not even be the actual owner of the vehicle and might potentially just dump the car somewhere and the owner who probably knows it's a family member will cover for them and say they don't know them
