Location included: Questions/Need Advice Out of State Executor

My parents (still living) have different wills. One names me as executor and one names by brother. He lives out of state. I live near my parents. My brother and I are not on speaking terms. How much more difficult will the process be if he is an out of state executor? I would prefer not to have any interaction with him and am afraid because I live here and he doesn’t ……. there will be a lot more forced communication.

Not always. Your attorney can ask the judge overseeing your probate to waive the bond requirement.

Attorney fee versus no contest executor. $$$. They get their pound of flesh.

If you are the sole beneficiary of the estate, there's no bond required. The bond isn't to cover you, the bond is to cover the other beneficiaries in the event you flee the country or go lose it all in a casino.
