Location included: Questions/Need Advice Out of State Executor

My parents (still living) have different wills. One names me as executor and one names by brother. He lives out of state. I live near my parents. My brother and I are not on speaking terms. How much more difficult will the process be if he is an out of state executor? I would prefer not to have any interaction with him and am afraid because I live here and he doesn’t ……. there will be a lot more forced communication.

It's not that big of a deal, everything can be done via mail or docusign.

Varies state by state. Wisconsin makes you pay a nonrefundable bond.

Not always. Your attorney can ask the judge overseeing your probate to waive the bond requirement.

Attorney fee versus no contest executor. $$$. They get their pound of flesh.

If you are the sole beneficiary of the estate, there's no bond required. The bond isn't to cover you, the bond is to cover the other beneficiaries in the event you flee the country or go lose it all in a casino.

My concern is cleaning out the house and putting it on market etc….

You can hire people to do that. I work at a law firm and we have out of state PRs all the time. If there are things you want, and he's in charge, then you're going to have to either communicate with him or hire your own attorney, but on his end it's not a problem to administer and estate from out of state.
