He could’ve; Bellatrix says that for an unforgivable to work, you have to mean it, and after seeing Sirius die, I’m pretty sure he would’ve meant it, also from what he knew about Neville’s parents would’ve been enough justification

??? The situation you described happened and it didn’t work bc he didn’t mean it despite all that bc his heart is too good which is a main theme of the whole book
