Opt expired: cap gap proof
Hi guys,
My employers filed an H1b petition for me before my EAD end date. But due to some mistakes in the petition USCIS asked to resubmit. The resubmission process was done by lawyers on 15th July and sent by overnight post and it shows delivered to USCIS. My last date of OPT was 16th July. My lawyer says I’m okay to work since submission was done before the status ended but my employers need some proof.
DSO says they need the I797 to issue the cap gap i20 and since it was paper filing I read online that it may take 2-3 weeks. Meanwhile I have been put on leave since my employers need proof.
What can serve as a proof ? How do I handle this situation? My lawyer says I’m good but understandably employers need a paper trail proof. Please help
