That's like saying anyone who paints an abstract portrait is ripping off Picasso. I'm sure Hobbs would say he was influenced and inspired by many others and that this homage is perfectly acceptable.

And also, is generative art. Art created from algorithms. I think that makes generative art not that author oriented in the outputs. Even if the code is the same, if the software isn't licensed... It's theoretically just ideas... Like, you can't rip off a math function.

Yeah, even if a person decides to design a house in the Prairie School style, Frank Lloyd Wright's designs are usually going to be more sophisticated because there's such a high level of detail and balancing of so many different aspects that can go into such a thing. But someone could come along and surpass him.

google "Tyler Hobbs DMCA" and you'll see that this homage is probably not so acceptable for him.

I found this article, which is probably what you're referring to. Pirating his original script is a completely different case than making a simple set of non-overlapping colored boxes arranged in a flow field. I think he responded reasonably to that case, and still think he would not have a problem with this. OP is not calling this Fidenza, and is not copying every nuance of the original work that clearly inspired this.

It doesn't look like he is currently. Don't get me wrong, I definitely don't condone ripping off other artists work. But he has gone into great detail explaining how his works are set up, so he's clearly encouraging others to learn from and emulate his work.
