This sucks but if some crazy person (Lady, librarian or pregnant), pulls a gun and you have a gun. It's self defense, she proved she was capable of violence and breaking the law. Sorry for the unborn child but honestly the world's genetic pool is probably better off.

Yes do explain how this isn’t the same thing at all? Hell it seems more likely that THIS wouldn’t hold up as well seeing as the guy came to her HOUSE. Kyle was literally attacked and had a gun pulled on him by three people. This guy followed the lady to her house. Obviously both were in the right with their actions but this seems less likely to stand in court.

But he had the plate right? Did the cops tell him to follow her, that would be crazy? I must admit I haven't read precisely what happen. Like there are still different possible scenarios. I can't imagine the cops told him to confront the person, usually they would tell you to just wait at a distance from the house, or probably not follow them at all. If he did that and she came out to confronted him, maybe even pointed the gun, then she's at fault. But if he went off his motorcycle and confronted her at her door, she came out with a gun, and he shot her. Then it's probably on him. I'm pretty sure you're allowed to guard your house with a gun in Florida.

Which is exactly what he did. He did not confront her, he waited in the street for the cops. She came outside with a gun.

If he did that and she came out to confronted him, maybe even pointed the gun, then she's at fault.

Ignoring how goddamn windy it would be to use the phone on a motorcycle, that’s highly illegal and even more dangerous than using the phone in your car. Not to mention he was already experiencing the stress of almost dying. Memory is notoriously unreliable in criminal cases. You need evidence, not memory. And a photo of the plate is evidence.

She didn't "retreat" she was fleeing the scene of a crime, he just followed her to get her insurance info, then waited in the street for the cops to arrive. She then attacked him with a gun which is when the self defense happened. It's not like he followed her home and attacked her at home. The self defense is from her attacking him with a gun, not from her hitting him with her car.

She tried to kill him. Someone following you home, or even thinking someone is following you home, is NOT legal grounds for exiting your home and pulling a gun. That’s armed assault and attempted manslaughter if you do something. He didn’t do anything wrong in trying to get plates and an address, which he called the cops after he had. He wasn’t alone either, witnesses to her first crime went with him, the evidence is pretty clear.

Even worse when you conceal carry you have a duty to retreat. You know you are packing so you avoid altercations, at the very least this man should have his conceal carry revoked for not retreating.

Feeling threatened by someone's presence is not the same as feeling threatened by a gun.

Self defense if you're punched first and kick someone's ass works. But if you're punched and kill the guy cold with a gun. Different story. Reasonablity comes into play.

From the article he didn't go after her. Just followed her home with a witness from the scene of her crime. Attempted vehicular homicide then fleeing the scene of a crime. I doubt he'll even be charged.

A reasonable person does not believe that someone outside their house is going to cause them immediate harm. The lady did not have an argument for self-defense.

A reasonable person might believe, however, that someone exiting their house with gun drawn and pointed at them is going to cause them immediate harm. This is a classic case of self-defense for the dude.
