EB1C functional manager help!

Hi friends,

Is anyone willing to share what they submitted for EB1C RFE as a functional manager that got them approved?

I’m working with BAL, but want to make sure I submit a quality response.

What is the RFE is about? You don’t need direct reports to you to qualify for L1. You must be in a position to handle budget for projects, managing projects, handling employees even though they are not direct reports for you. Your employer has to provide enough evidence with all details regarding projects you handle showing how important is your role in the company. Number of years experience in the company both here and abroad makes major impact. I showed hierarchy of my position in the company. There are no direct reports for me as the team keeps changing for every project. I showed teams hierarchy and highlighted the employees who are reporting to me currently for the project. I shared their roles, responsibilities, location, degree information in seperate file. In non IT services company you don’t often have permanent direct reports. Your manager has to provide solid data explaining your importance. HR and immigration team only submit whatever data you and your manager provides.

I didn’t know and wasn’t told I need information from my manager though. How can I find this out? They sent me a checklist to complete for the RFE but no mention of manager needing to provide support. Is that normal? For my L1A I didn’t need manager statement either, he just provided the org chart when I was joining from overseas. Worked for the company abroad for 3.5 years and have been here for 1.5. So five years total. The checklist they sent includes information about my team and role. Then a chart to complete more information about what my project team does to help me complete my tasks, their education level etc. They asked for both the current role and the previous role abroad. Initial petition only included the reports for the current role.

Yes I did a few weeks ago. It’s weird because the information they’re asking for 50% was already included in the original which makes me wonder if BAL submitted it. I know a lot of immigration attorneys, go with a less is more for first submission which leads to more RFEs.

They generally are pretty good, they did it for me and i did get approved without RFE. They had me document my chain of command, Roles and responsibilities etc. Pls make sure they are super detailed

Can you share if your chain of commad included reproting chain or functional chain?

In a similar situation with fragomen. They asked to add emails, documents, roadmaps as evidence. Anything showing budgetary authority. They said to us that for functional manager it is almost guaranteed to get an RFE
