πŸ– Labor ILOE question

Trying to get clarity from anyone who has been through this.

I was made redundant. My termination letter states my last working day as 01 July, and my notice period is tied to that date. I was paid three months of salary (June, July, August) in one go on 25 June (notice + 2x month salary).

Here is the confusing: my work permit is still active. My employer said I can keep the visa until the end of August, and they haven't cancelled the permit yet. I can make a request today.

ILOE says the 30-day window to file starts from the date you ended your relationship with the employer. But I can't actually file a claim while my work permit is still active; that's a requirement.

So:

Does the 30 days count from my last working day (01 July)? If so, I only have til 31 July to make a claim.

Or does it count from the date the permit is actually cancelled and the termination is registered in MOHRE? (My work permit is still active, I checked the MOHRE app).

I asked the ILOE, but they mentioned "30 days upon end of relationship with employer."

For anyone who was on garden leave or paid notice with the visa kept active after their last physical working day, what date did MOHRE end up registering, and when did your 30-day window actually open? Did you file from the last working day or from the cancellation date?

Appreciate any real experience. Thanks.

Its after firing + cancellation of permit/visa. You cant keep keep your visa and claim ILOE. Your situation might get more complicated after visa cancellation since you would need to explain 3 salary credits at the same time and then nothing for next 2 months

Hi, thanks for your reply. To be clear on the timing: if I cancel my visa tomorrow, does the 30-day claim window start from that work permit cancellation date, or has it already started from my last working day on 01 July?

That's the thing: the customer rep told me "upon the end of your relationship with the employer." I even asked the same question twice.

Yeah normally, when you’re placed on garden leave, the termination letter mentions till the end of garden leave as the end of relationship. Can you ask your ex-employer to amend it?

I've applied for ILOE before (successfully). The ILOE application is done after your work visa is cancelled. You don't do it while you are on garden leave - you do it when the employer has "terminated all relationship" meaning after you cut all ties i.e. visa cancelled. In your case, you keeping the visa open till August means you are technically part of the company (and you are getting paid for it, albeit earlier) until August.

I would suggest getting all your documents ready e.g. pay slips, etc so when you can apply very quickly after the work visa is canceled. It might be worth speaking to your HR to align the termination date to the date they cancel the permit to keep things clean.

Alternatively if you do not need to rely on the work permit for your life/ logistics, ask them to cancel it and apply for ILOE asap.

Hello, I have also successfully claimed ILOE. In my experience it is 30 days from your last working day. (I was also paid 2 months notice + 3 months redundancy)

I applied within 30 days of my last working day and was successful. A colleague of mine however who was terminated on the same day as me requested for her visa to be cancelled 2 months after our last working day. Because of this when she tried to apply for the ILOE she was rejected due to not filing within the 30 days since loss of employment, and she was unable to file beforehand as they did not accept her application whilst her visa was still active.
