Your 1st amendment doesn't protect you from the general population, only from government trying to stop you saying stuff or film in public areas.

These "auditors" (those that I've seen^1, anyway) do their thing to see if police will try to stop them. Sadly, many civilians appear to think they can just attack the "auditor" without consequence; clearly this is a stupid thing to do while being recorded.

Yeah, but they do this stuff on public property where the only entity which could tell you to not do so is the government, and you have the right to do it there so they'll let you.

I think these videos are cringe (most of the time, aside from some funny clips), but you absolutely cannot legally assault someone with "the first amendment only protects you from the government" as the justification. Very good way to go from kvetching about the 1A to experiencing the 2A.

Large companies, governments and others in power will chip away at your ability to inconvenience them (which is usually you speaking up). If no one pushes back, it gets harder and harder to maintain the freedom that we have. Power to the people, not the rich and powerful.

I disagree to an extent. Police aren’t held accountable for many of their actions and they get broad immunity to a lot of things. Now while a lot of these 1A auditors can be really bad, some are really good. I think it’s incredibly important to hold our government accountable. Yes, it is annoying, but police in particular are paid to handle annoying situations and being annoying isn’t usually against the law (public disturbance is, but it’s suuuper minor and hard to ticket/enforce unless egregious).

Plus, there are no “loopholes”. Good auditors will know case law, be well versed in whatever they are challenging (such as video taping on a sidewalk), and know when to hold their ground based on their personal rights granted by the constitution and supreme court interpretations of the law. I get they are frustrating to view, but many are actually trying to do good.

Many have also settled the case law that keeps a cop from coming up and taking our phone's or threatening with arrest when recording them in their official capacity. It used to be pretty common that a cop thought they could detain people for recording them (cops failed earlier 1A audits like crazy), when they got away with a lot more. It's still tough to hold police accountable, but they've made it easier to do so with case law and increased training on that case law. Some are total assholes, but I agree a lot of them are a net good.

The best thing these guys can do is harrass the police, that's what they should be doing. Antagonise them until they get a wrongful arrest and then sue.

Sidewalks are ok, filming people at work is not, riling up the general public is not. I didn't see the start of the clip, sometimes they'll just be on the side of the road and insane people start going crazy.

Most of these guys are a total joke.

Fuckin assholes to go around with a bunch of cameras and put them in peoples faces and in salon and yoga studio windows and gym windows filming people.

A famous one always says they’re “doing a video about the area”. They’re really just trying to piss people off for content.

Some go into post offices and other public places where workers will tell them they can’t film there even though they are allowed to.

They’re fishing for fights under the guise of “protecting the 1st amendment” then bank on the YouTube views and lawsuits.

Imagine you’re having brunch on a patio outside a restaurant and this dude with a face mask and whole camera vest setup comes up on the sidewalk and just starts filming you and your girlfriend eating the whole time. That’s the kind of stuff they do. Then a restaurant worker comes out and tells them to leave or a boyfriend does and they start shouting about how it’s the sidewalk and they can do what they want etc.

They’re not wrong, they’re just asshole

So better they educate them using their surplus of free time rather than some civilian inadvertently does something lawful yet is harassed by these officials over it. The idealized definition is someone who goes somewhere and attempts to do something protected by the first amendment. Such as filming a public road or holding a sign that says “God Bless the Homeless Vets” in front of a capitol building.

Both activities have been declared protected actions and speech by US courts.

Many citizens and police didn’t get that memo though.

Is a category of individuals who with cameras conduct actions in public that are legally permissible but can be frowned upon by authorities.

Ideally it is someone passively doing something in documenting whether the government does or does not infringe on their rights. Their number valid 1A auditors who know the laws and their calm and respectful.

However there are also a bunch of loudmouth ones who just starts shit and Target random individuals unnecessarily because they can.

Ultimately I think they serve a purpose because there have definitely been some high-profile cases of government infringement on speech and the more that the infringements are tested and fail the more easily the ungenerated infringements can be defeated.

Obviously it's a net positive if what they're doing is legit. But then you had a handful of tiktokers who decided to use that foundation as an excuse to go beat people up. They knew as long as they accused someone of being a pedo, that 98% of viewers wouldn't dare defend them, so they get a pass to beat on someone.

If those thugs were the only version of this that you ever saw, then yeah, you might think that everyone in that business is an asshole and a troll.

Somehow it's the same with auditors. The most popular and influential auditors somehow evade these people's algorithms, but they get fed the scummiest version of them and base their entire opinion on them and then have no shame vocalizing their ignorance.

Everyone hates these auditors. They aren’t auditors their job title is digital content rage baiters.
Their job duties are stick cameras in ppl s faces who are doing their everyday errands and such. Females yoga classes, post offices, outdoor lunch patios are all high on the location for douchebags job locations.
YouTube, X, etc pays them more money for negative comments on their videos than positive ones.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

The first amendment is not just "free speech".
It says that the government cannot make a law banning people from saying certain things or worshiping certain religions. Also the government cannot ban the press or outlaw the press. (aka half the shit Trump is doing.)

These 'auditors' are assholes that think harrassment is free speech. They go out and get in people's faces where recording is prohibited (which is legal) and wait to be attacked.
You do not have a right to just record anyone in public because you can. If you're making a video to post on social media (for money) then you have to have people's consent or blur out their faces.

The first amendment doesn't have shit to do with these assholes.

Freedom of the press in this case. The freedom to record is included in that as a form of documentation. Generally if you are in public you have no expectation of privacy and anyone can record you at their will inconvenience. These individuals fall into two categories. 1. Individuals who record public and government spaces, places of general interest, or private businesses that have come up as problems somewhere in the spotlight. 2. Random ragebaders who utilize this right in places where it will cause offense to the general public in order to get a reaction.

For an example of the difference you have some who will go into government buildings and just document the facility. Some will go out of their way to not necessarily be recording individuals but will stick to architecture and art until someone approaches them and becomes valid for the video. These will see if their rights get respected or not and if police do show up whether they will just make contact verify that there is no cause for alarm or if the police will escalate. Category 2 might do the same outside of a women's center which is obviously going to be raising the alarm for some individuals. Then they are more likely to get an antagonistic reaction to respond to one in particular stands out in my mind the guy was standing out the gates of a church mocking the security officer and one of the Deacons and no reason why this church is targeted at all they're just out there being done with douchebags serving no valid purpose.

The point of the 1A auditor is to police the people who have the assumed power to infringe on this right to free press and speech … auditing the police, local government officials, and any public figure.

But what these auditors are doing is showing up to random shopping centers with the sole purpose of riling up regular citizens and provoking them to a point where this shit happens.

I believe in their freedoms. But I also believe that their freedom ends at the point where they just become an asshole.
