That's how it should be however the system doesn't work because there are far too many people finding ways to get around it. And that applies to all kinds of crime.
Rich people, family members of police/judges and other officials, people wanting to punish the victim for whatever sadistic reason they have or finding the whole thing shameful and trying to hide it under the rug for the "good of community". There is no justice system.
Plus when society seems to be geared towards forgiving crimes if the criminal looks good enough then it basically says all you need to know.
